AN ORDINANCE OF Tfffi CITY OF acOEE, Ol~\NGE COUNTY, FLORIDA, RELATING
TO AUTOMOBI LE~, TRUCKS, MOTORCYCLES AND OTHER MOTOR VEIU CLES PARKED
UPON THE PUBLIC STREETS, ALLEYS, PUBLIC PARKS AND PAR~~AYS OF Tfill
CITY OF OCOEE AND FOR THE TAKING UP, SEIZING, STORING AND DESPOSING
OF SAIvIB.
BE IT ORDAINED BY THE CITY COUNCIL OF T}lli CITY OF OCOEE:
section 1. No automobile, truck, motorcycle or other motor vehicle
shall be left parked in the same place continuously upon any public
street, alley, public park or parkways of the City of Ocoee for a
period of seventy-two (72) hours.
Section 2. Any automobile, truck, motorcycle or other motor vehicle
left parked in the same place continuously upon any public street,
alley, public park or parkway of the City of Ocoee for a period of
seventy-two (72) hours without being moved shall be considered for
the purpose of this Ordinance as abandoned.
Section 3. Any police officer of the City of Ocoee, Florida, is here-
by authorized to take ~p and seize any automobile, truck, motorcycle
or other motor vehicle abandoned in the City of Ocoee, Florida, and
to hold and store same to be turned over to the owner when called
for, or forfeited and sold as is herein provided.
Section 4. When any abandoned automobile, truck, motorcycle or other
motor vehicle is taken up and seized by the police of the City of
Ocoee in accordance with this Ordinance, or any Ordinance of the
City of Ocoee, within five (5) days thereafter public notice shall
be given of same, giving full and complete description of the auto-
mobile, truck, motorcycle, or other motor vehicle, for at least four
(4) weeks, published once in each week for four (4) weeks in a news-
paper of general circulation in Orange County, Florida, stating the
time and place of such seizure, and that the owner may have such auto-
motile, truck, motorcycle or other motor vehicle by calling for same,
and paying the expense of taking up and storing same, and if no one
appears and claims said automobile, truck, motorcycle or other motor
vehicle, then the chief of police shall proceed to have said auto-
mobile, truck, motorcytle or other motor vehicle forfeited and sold
as herein provided.
Section 5. Should any automobile, truck, motorcycle or other motor
vehicle taken up and seized by the police of said City of Ocoee under
the provisions of this Ordinance, or any Ordinance passed in pursuance
thereto, after advertisement as herein provided, then the chief of
police may proceed in the circuit court to have any such automobile,
truck, motorcycle or other motor vehicle forfeited and sold as is
now provided by law for the forfeiture and sale of property in any
case now provided; provided, however, that the chief of police shall
be substituted for the sheriff in such proceedings for the forfeiture
and sale under the provisions of this Ordinance.
Section 6. All money received from any such sale as herein provided
of abandoned automobiles, trucks, motorcycles or other motor vehicles,
shall be disposed of as follows:
All expenses of taking up and seizing any such automobile, truck,
motorcycle or other motor vehicle, together with advertising for the
owner, cost of proceedings to forfeit, and all costs and expenses,
shall first be paid, and the remainder shall be delivered to the City
of Ocoee to be held for a period of one (1) year, and if the owner of
said property forfeited shall claim such amount, same shall be paid
over to him, and after the expiration of said one (1) year, same
shall be paid into the general fund of the City of Ocoee, and all
persons after that time shall be barred from any claim to any such
sum.'

Section 7. All Ordinances and parts of Ordinances in conflict here-
with are hereby repealed.
section 8. Should any portion of this Ordinance be held invalid,
then such portion as are not declared to be invalid shall remain
in full force and effect.
Section 9. This Ordinance shall become effective immediately upon
its passage and approval by the Mayor.
