ORDINANCE No. 412
AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, ESTABLISHING BUILDING RE-
STRICTIONS ON MARION PARK SUBDIVISION A SUBDIVISION OF THE THE CITY OF
OCOEE, FLORIDA, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK
"L", PAGE 48, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA; PROVIDING A
PENALTY FOR VIOLATION.

Whereas, the lands included within Marion Park Subdivision are developed
predomimantly with single family dwellings on lands of generous area; and
Whereas, the subdivision is generally divided into lots of small dimension;&
Whereas, to preserve and protect the characteristics of single family use
within it; and
Whereas, the regulations and requirements herein set forth have been made
in accordance with prevailing land use, growth characteristics and the
character of the area and itfs peculiar suitability for particular uses
and to encourage the most appropriate use of the land; and
Whereas, the interpretation and application of the provisions of sections
of this ordinance shall be the minimum requirements to promote the public
health, safety, morals and general welfare; to conserve the taxable value
of land and buildings, and to protect the character and ma.intain the
stability of residential area and to promote the orderly and beneficial
development of such area. And where, among other purposes, such pro-
visions are intended to provide adequate light, air, privacy and con-
venience of access to property; to establish building lines; the size
of lots and open spaces surrouding buildings; to regulate the construction,
reconstruction, alteration and use of building, structures and land for
residential purposes; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCOEE:
Section 1. All lots in the said Marion Park Subdivision shall be known
and described as residential lots, and no building, structure shall be
erected, altered, placed, or permitted to remain on any residential build-
ing plot other than one single family dwelling and private garages or
car portes shall be attached to the ground floor area of the main structure.
Section 20 No building or structure shall be built on a lot or parcel of
land in Marion Park Subdivision haveing an area of ~ less than sixty five
feet in width at the building line and one hundred ten feet in depth and
the front yard shall not be less than twenty five feet, th,rear yard
thirty five in depth and side yards shall be provided on each side of
every dwelling of not less than five and one-half feet. And where lots
comprising forty per cent or more of the frontage on one side of a block
are developed with buildings at the time of the passage of this ordinance,
the average alignment of the existing building along such frontage shall
be the front yard line of sa.id side of said block, and no building here-
after erected or structl~ally altered shall project beyond it.
Section. 30 The ground floor area of the main structure, e~usive of
open porcbes, garages and car portes, shall be not less than Eleven
Humrlred (llOO) square feet, and the building or structure shall be built of
of concrete block,or well burned brick and a fire resisting roof.
Section 4. This ordinance shall beoome effective immediately upon its
passage and approval by the Mayor, or upon its otherwise becoming a law.
Section 5. Any person, firm or corporation violating amy provision of
this ordinance shall, upon oonviction thereof, be punished by a fine not
exceeding Five Hundred Dollars ($500000) and/or imprisonment not exceeding
Sixty Days (60) days, and each day such violation shall continue to exist
shall constitute a separate offense.
Section 6. Should any portion of this Ordinance be held invalid, then
) such portions as are not declared to be invalid shall remain in full force
and effect.
