HomeMy WebLinkAboutOrdinance 408 ORDINANCE NO. /)0:3 AN ORDINANCE OF THE CITY OF OCOEE, ORANGE COUNTY, FLORIDA, PRO- HIBITING THE CUSTODIAN OF A PINBALL MACHINE FROM ALLOWING ANY MINOR UNDER 17 YEARS OF AGE TO PLAY, USE OR OPERATE ANY SUCH PINBALL MACHINE; PROVIDING PENALTY FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCOEE: Section 1. Any person, or the employee of any person, who is the custodian of a pinball machine, whether as owner, agent, lessee or otherwise, is hereby prohibited from encouraging, allowing or per- mitting any minor under seventeen to play, use or operate any such pinball machine. Section 2. There shall be displayed on all pinball machines a sign reading "Playing by minors under seventeen years old is prohibited.1I Section 3. teen years welfare of Statutes. The playing of a pinball machine by a child under seven- of age shall be construed as a condition adverse to the the child within the provisions of section 39.03, Florida Section 4. "Pinball machinell shall be construed to include any coin or slug-operated device, commonly known as such, or any similar coin or slug-bperated mechanical game or device. Section 5. Any person, firm, corporation, partnership, or other legal entity violating any provision of this ordinance shall upon con~ viction thereof be punished by a fine of not more than $500.00 or by imprisonment for a term not exceeding 60 days or by both such fine and imprisonment; and in addition thereto, any such conviction shall be construed as grounds for revocation of any occupational license certificate for operating pinball machines theretofore issued by the city to any person operating the establishment where the pinball machine involved is located; such revocation to be made by the city council at a public hearing after giving to the convicted person at least ten day's written notice of such hearing. Section 6. The ordinance shall become effective immediately upon its passage by the Council and approval by the Mayor. Section 7. All Ordinances and parts of Ordinances in conflict here- with are hereby repealed. Section 8. Should any portion of the Ordinance be held invalid, then such portions as are not declared to be invalid shall remain in full force and effect.
