ORDINANCE NO. -I,t-a-7-
AN ORDINANCE OF THE CITY OF OCOEE, ORANGE COUNTY, FLORIDA, PROHIBITING
TIlE SALE OF ALCOHOLIC BEVERAGES IN THE CITY OF OCOEE CONTAINING
ALCOHOL OF MORE THAN 8% OF ALCOHOL BY WEIGHT: PROVIDING A PENALTY
FOR VIOLATION.
WHEREAS, the voters of the City of Ocoee at a duly regular held
election in the City of Ocoee on November 4, 1958, voted 262 against
having a liquor store in the City to only 62 for it; and
WHEREAS, the City desires to prohibit the sale of alcoholic beverages
within: the City of Ocoee containing alcohol of more than 8% of
alcohol by weight and providing a penalty for violation, now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCOEE:
Section 1. It shall be unlawful for any person, firm, corporation,
partnership, or other legal entity to engage in, sell, or manage a
business for the sale of alcoholic beverages containing alcohol of
more than 8% of alcohol by weight in the City of Ocoee.
Section 2. Any person, firm, corporation, partnership, or other
legal entity having possession, custody or control of more than
one fifth of a gallon of alcoholic beverages containing alcohol
of more than 8% of alcohol by weight shall be presumed to have
possession of said alcoholic beverages for sale, barter, or exchange
contrary to the provision of this ordinance.
Section 3. The term "alcoholic beverages" shall include all
beverages containing more than 8% of alcohol by weight.
Section 4. Any person, firm, corporation, partnership, or other legal
entity violating any provision of this ordinance shall upon convic-
tion thereof be punished by a fine of not more than $500.00 or by
imprisonment for a term not exceeding 60 days or by both such fine
and imprisonment. Each sale shall constitute a separate offense.
Section 5. This ordinance shall become effective immediately upon
its passage by the Council and approval by the Mayor.
Section 6. All Ordinances and parts of Ordinances in conflict here-
with are hereby repealed.

Section 7. Should any portion of this Ordinance~held invalid, then
such portions as are not declared to be invalid shall remain in full
force and effect.
