HomeMy WebLinkAboutOrdinance 392 ~~~ .,,~~ ~ " \ I ~, (' -1\/ \,----/"" ::; ii' ?, ORDINANCE No. .." 1 It\,..- ~N ORDINANCE OF THE CITY OF OCOEE, FLORIDA, REGUIATING THE: CONSTRUCTION, ~LTERATION, IMPROVEMENT, PIACEMENT AND USE OF BUILDING, STRUCTURES AND IANDS IN THE CITY OF OCOEE; PROVIDING A PENALTY FOR VIOLATION THEREOF. WHEREAS, It has been proposed that a comprehensive zoning plan for the City of Ocoee be formulated and adopted after study and recommendation therefor have been made by the zoning and planning board which has here- tofore been duly apd regulary appointed; and WHEREAS, It has been made to appear that the health, welfare and safety of the citizens of the City of Ocoee would be substantially protected by an interim regulation of the construction, improvement, alteration, place- ment, and use of lands, building and structures, while the study is being made for a comprehensive zoning plan, the purpose of such interim re- gulation being to prohibit the establishment of uses which would be con- trary to a comprehensive zoning plan; and WHEREAS, Adoption of an ordinance for the purpose of such intorim re- gulation has been determined to be a matter of urgency requiring im- mediate action, now therefore, BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF OCOEE: Section 1. No building or structure shall be constructed, altered, im- proved, or placed on any lands in the City of Ocoee, nor shall any lands in the City of Ocoee, buildings or structures thereon, be appropriated to any use different from the use being made of said lands, buildings or structures, ontha affective date of this ordinance, unless the prior approval of the zoning and planning board has been obtained in writing. Section 2. Any person desiring to construct, alter, improve or place any building on land in the City of Ocoee or to appropriate any land, building or structure to a usa other than the use being made thereof on the effective date of this ordinance shall make application tb the City Clerk therefor. Upon receipt of the application, the City Clerk shall forthwith notify the chairmen of the zoning and planning board, but shall not issue any permit until the approval of the zoniilg'and planning board has been obtained and all other pre-requisite provided by the ordinances of the City of Ocoee shall have been met. Section 3. Within not more than twenty days after an application has been received, the chairman of the zoning and planning board shall call a meeting of said board to consider the applications whichmve been re- ceived by the clerk more then forty eight hours prior to such meeting and the board shall approve or disapprove the application at such meet- ing and shall forward such approval cr disapproval to the Clerk, and in case of disapproval, the reasons therefor. Section 4. The zoning and planning board shall have authority to dis- approve any application for building permit or land use permit where the type, size, location, or primary "use design" of a building, or use to be made of any land or buildin* or structure thereon, is contrary to the type, size, location, primary 'use design", or use being made of lands, buildings and structures in the area wherein the permit is desired, or where the issuance of said permit would pe~nit the establishment of a use not in conformity with a proposed comprehensive zoning plan for the City of Ocoee. Section 5. Any person aggrived by the approval or disapproval of any permit, or other action by the zoning and planning board may appeal the decision of said zoning and planning board to the City Council who shall have the authority to overrule any action of the board. Such appeal shall be by written application to the City Council and the person making or taking the appeal shall give notice of their intention to appeal to all persons who own lands within six hundred feet in all directions of the lands for which the permit is desired. All decisions of the board shall be final unless appealed within fifteen days. Section 6. Any person, rirm or corporation violating any provision or this ordinance shall, upon conviction thereof, be ~unished by a rine not exceeding Five Hundred Dollars ($500000) and lor imprisonment not exceeding Sixty Days (60)0 Section 7. All ordinances and parts or ordinances in conflict herewith are hereby repealed. Section 8. Should any portion or this ordinance be held invalid, then such portion as are not declared to be invalid shall remain in rull rorce and erfect.
