Background Summary:
The widening of Maguire Road from Mercantile Court to Geneva/Story Road has been a project
that the City has been planning for some time. The project scope was to include a five-lane section
from Mercantile Court to Marshall Farms Road and a four lane divided section, with turn lanes, on
to Geneva/Story Road. The project started in early 2001 with an alignment study and conceptual
design. Detailed design has been on-going on and off over the past eight years.
Additional services for this change order include redesign of a portion of the project to utilize the
site on Marshall Farms Road for the stormwater pond, resubmittal to the St. Johns River Water
Management District for permitting associated with the new pond site and design changes, and
design and permitting of utility relocations on Marshall Farms Road affected by the changes to the
stormwater design. The changes in design due to the new pond site were not included in the
previous change order because staff and PEC, Inc. wanted to see if the new pond site would be
usable. The project was originally designed to utilize a portion of the Roper property for the
stormwater pond. When land and construction costs increased it was determined that if the
Marshall Farms Road site was usable approximately $500,000 could be eliminated from the project
cost. The cost for these additional services is $66,252.49.
The plans for this project are almost complete, awaiting permit approvals from FDEP and
SJRWMD. Foley & Lardner is working on securing the needed additional right-of-way and pond
site. Staff has proposed this project to be included in the Federal Highway Act for 2009 and the
completion of the design and permitting will make this project a "shovel ready" addition to that
Federal Act.
Issue:
Approval of Change Order #3 to Addendum No. 005 to the Agreement For Consulting Engineering
Services with Professional Engineering Consultants, Inc. for the Maguire Road Phase V Project
Design Phase Services in the amount of a not to exceed increase of $66,252.49 to cover roadway
and utility design changes associated with using the Marshall Farms Road pond site.
Recommendations
The Engineering Department recommends that the City Commission approve Change Order #3 to
Addendum No. 005 to the Agreement For Consulting Engineering Services with Professional
Engineering Consultants, Inc. for the for Maguire Road Phase V Design Phase Services in the
amount of a not to exceed increase of $66,252.49 to cover roadway and utility design changes
associated with using the Marshall Farms Road pond site and authorize staff to issue a purchase
order for the work.

Financial Impact:
The Maguire Road Phase V project is being funded from Road Impact Fees. These additional
service will be funded from that same source.

Re: Maguire Road Segment 3 - Stormwater Permitting, Pond 7 Modifications
and Utility Design
Dear Mr. Wheeler:
The following is a brief historical summary of the design and budget concerning Maguire
Road Segment 3.
Maguire Road Segment 3 is a road widening project from Mercantile Road to Story Road
located north of State Road 50. The design began in January 2001 and was halted April
2002 due to negotiations with the Florida Department of Transportation (FDOT)
concerning functional classification and re-designation of jurisdiction (City roads). As a
result of the FOOT negotiations, the City received a grant from FOOT to improve
McKey Street. The Segment 3 design plans were approximately 30% complete when
work stopped. The City authorized PEC to complete the design and permitting of
Maguire Road Segment 3 in August 2005. The plans were completed to 60% to allow
acquisition of right-of-way. The project was put on hold February 2006 to analyze
proposed changes in Ponds 7 to reduce right-of-way costs by approximately $500,000.
Boundary surveys were recently completed on five (5) parcels and the Pond 7 site.
We have received direction from City staff concerning Pond 7 and have been requested to
complete the determination of whether the Pond 7 site is viable and, if so, to proceed with
re-design of Pond 7. Additionally, we received direction from City staff to include in this
proposal the relocation of approximately 700' of 12" watermain. The following is PEC's
manhour and fee estimate for the additional engineering services required for, preparing
construction drawings for Pond 7, stormwater permitting and relocation of an existing 12-
inch water main along Marshall Farms Road The major items which require additional
work efforts are as follows:

Complete the storm water analysis of the Pond 7 site
Complete re-design of Pond 7. This re-design will result in a reduction in the
right-of-way costs for the project in the order of $500K. The re-design will result
in revisions to:

PEC and the City's financial staff have reviewed purchase orders, contract modifications
and invoices to-date and conclude an authorized Lump Sum budget of $474,232.61 for
the design I permitting of Segment 3, Maguire Road. A total of $474,232.61 has been
invoiced for the design and permitting as of October 7, 2008, therefore, there is no
remaining balance. A change order in the amount of $66,252.49 is requested to complete
the analysis of the pond 7 site, re-design of pond 7 and associated construction plan
revisions, and 12" watermain design.
