AN ORDINANCE CREATING A BUREAU OF FIRE PREVE1~ION, ESTABLISHING ITS PERSONNEL A~D DUTIES, AND MAKING PROVISION FOR THE PREVENTION AND CONTROL OF FIRES IN THE CITY OF OCOEE. BE IT ORDAINED BY THE CITY OF OCOEE 1. A Bureau of Fire Prevention in the Fire Department of the City of Ocoee is hereby established, which shall be opera~- ed under the supervision of the Chief of the Fire Department. The Chief of the Fire Department may designate an of- J ",.-:' ~~ ficer (or member) of the Fire Department as Chief of the Bureau of Fire Prevention, who shall hold this office at the pleasure of the Chief of the Fire Department. The Chief of the Fire Department may detail such other members of the fire department as inspectors as shall, from time to time, be necessary. 2. It shall be the duty of the officers of the Bureau of Fire Prevention to enforce all laws and ordinances covering the following: (I) The prevention of fires. (2) The storage and use of explosives and flammable.s . (3) The maintenance and regulation of fire escapes. (4) The means and adequacy of exit in case of fire ,::':fr.om"sehools, hotels, lodging houses, churches, halls, theatres, and all other places in which numbers of persons work, live or con- gregate, from time to time, for any purpose. (5) The investigation of the cause, origin, .. and circumstances of fires. 3. The Chief of the Fire Department; Chief of the Bur- eau of Fire Prevention or any Inspector, may, at all reasonable hours, enter any building or premises within his jurisdiction, for the purpose of making any inspection, or investigation, which, un- " /'------., '\,." The Chief of the Fire Department, Chief of the Bureau of Fire Prevention, or an Inspector, upon complaint of any person, or whenever he or they shall deem it necessary, shall inspect any buildings and premises within their jurisdiction. Whenever any of said officers shall find any building or other structure whiCh, for want of repairs, lack of sufficient fire escapes or fire extinguish- ing equipment, or by reason of age or dilapidated conditions, or from any other cause, is especially liable to fire, and which is so situated as to endanger other property or the occupants thereof, and whenever such officer shall find in any building combustible or explosive matter or flammable conditions dangerous to the safety of such building, or the occupants thereof, he or they shall order such dangerous conditions or materials to be removed or remedied. 5. The Bureau of Fire Prevention shall investigate the cause, origin and circumstances of every fire occurring in the city, by which property h~s been destroyed or damaged, and, so far as pos- sible, shall determine whether the fire is the result of careless- ness or design. Such investigations ahall be begun immediately upon the occurrence of such a fire by the Inspector in whose dis- trict the fire occurs, and if it appears to the officer making such an investigation, that such fire is of suspicious origin, the Chief of the Fire Department shall be immediately notified of the facts; he shall take charge immediately of the physical evidence, shall notify the proper authorities designated by law to pursue the in- vestigation of such matters, and shall further cooperate with the authorities in the collection of evidence and in the prosecution of the case. Every fire shall be reported in writing to the Bureau of Fire Prevention within two days after the occurrence of the same by the officer in whGse jurisdiction such fire has occurred. Such report shall be in such form as shall be prescribed by the Chief of the Fire Department, and shall contain a statement of all facts relating to the cause,.origin and circumstances of such fire, and ..--. .1 ~ . . . , extent of the damage thereof, and the insurance upon such proper- ty, and such other information as may be required. 6.. It shall be the duty of the Ohief of.the Fire Denart- ment to require teachers of public, private and parochial schools and educational institutions to have one fire drill each month, and to keep all doors and exits unlocked during school hours. 7. The Chief of the Fire Department shall keep, in the e office of the Bureau of Fire Prevention, a record of all fires, and of the facts concerning same, including statistics as to the extent of such fires and the damage caused thereby, and whether such losses were covered by insurance, and if so~ in what amount. Such record shall be made daily from the reports made by the In- spectors under the provision of this ordinance. All such records shall be public. 8. The annual report of the Bureau of Fire Prevention shall be' made on or before the day of and transmitted to the City Oouncil; it shall contain all proceed- ings under this 'ordinance, with such statistics as the Chief of the Fire Department may wish to include therein; the Ohief of the Fire Department shall also recommend any amendments to the ordi- nance which, in his jVQgment, shall be desirable. 9. All reg1:j.l~tions issued by the State Fire Marshal under authority of Chapter 20,671 Laws of Florida, approved June 4, 1941, and entitled "AN AOT Relating to the State Treasurer as Ex-Officio Insurance, Oommissioner in Oonnection with Fires; to Provide for Payment of.Expenses of Administration; to Provide for e. Appointment of an Advi~ory Committee; and to Repeal All Laws in Conflict Herewith;" shall be enforceable by the proper authorities of this municipality, and the Chief of the Fire Department, are hereby authorized to perform within the corporate limits of this munlcipality any duties that may be imposed upon them by said law, or in accordance therewith, and to have such assistance as they may find necessary from other officials of this municipality in the discharge of such duties. ' , ' provisions of this ordinance or fail to comply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, or who shall build in violation of any detailed state- ment of specifications or plans submitted and approved thereunder, or any certificate of permit issued thereunder, shall severally, for each and every such violation and noncompliance respectively, forfeit and pay a penalty not to exceed the sum of twenty-five dol- lars, or punishment not to exceed ten days. The imposition of one penalty for any violation of this ordinance shall not excuse the violation, or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a, reasonable time; and when not otherwise specified, each ten days ~ !I that prohibited conditions are maintained, shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. II. All ordinances and parts of ordinances inconsistent herewith are hereby repealed. 12. This ordinance shall take effect and be in force.
