RESOLUTION NO. 92-18
CITY OF OCOEE
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
ADOPTING ADDITIONAL FORKS FOR THE
IMPLEMENTATION OF THE LAND DEVELOPMENT CODE
PURSUANT TO SECTION 1-13 OF CHAPTER 180 OF THE
OCOEE CITY CODE; PROVIDING THAT THIS
RESOLUTION IS SUPPLEMENTAL TO PREVIOUS
RESOLUTIONS ADOPTING LAND DEVELOPMENT CODE
FORKS; PROVIDING FOR SEVERABILITY; PROVIDING
FOR CONFLICTS AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 1-13 of Chapter 180 of the Code of
Ordinances for the City of Ocoee authorizes the City commission of
the City of Ocoee to from time to time adopt by resolution forms
for the implementation of the Land Development Code; and
WHEREAS, forms for the implementation of the Land
Development Code have been prepared by the staff of the City of
Ocoee, and the city commission of the City of Ocoee, after
reviewing the forms, desires to adopt and approve such forms.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA:
SECTION ONE: Authoritv. The City commission of the City
of Ocoee has the authority to adopt this Resolution pursuant to
Section 1-13 of Chapter 180 of Code of Ordinances of the City of
Ocoee, Article VIII of the Constitution of the State of Florida and
Chapter 166, Florida Statutes.

. SECTION TWO: Additional Land DeveloDment Code Forms.
The city commission of the City of Ocoee hereby adopts and approves
the additional CITY OF OCOEE LAND DEVELOPMENT CODE FORMS as set
forth in Exhibit "A" attached hereto and by this reference made a
part hereof.
SECTION THREE: Resolution SUDDlemental. This resolution
is supplemental to Resolution No. 92- 12 and all resolutions
adopting Land Development Code Forms which may hereafter be adopted
by the city Commission of the City of Ocoee.
SECTION FOUR: Severability. If any section, subsection,
sentence clause, phrase or portion of this Resolution is for any
reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
validity of the remaining portion hereto.
SECTION FIVE: conflicts. All resolutions, parts of
resolutions or acts of the City commission of the City of Ocoee in
conflict herewith are hereby repealed and rescinded.
SECTION SIX: Effective Date. This Resolution shall
become effective immediately upon passage and adoption.

CITY OF OCOEE
CONCURRENCY MANAGEMENT APPLICATION
.
The purpose of the city of Ocoee's Concurrency Management system (CMS)
is to ensure the availability of public facilities and services
concurrent with new development in an equitable manner to small and
large developers. The concurrency requirement is a provision in the
1985 Growth Management Act that gives local governments the authority to
manage growth effectively. Essentially, the concurrency requirement
means that needed public facilities must be in place concurrent with the
impacts of new growth. This provision ensures that all users of public
facilities will be guaranteed a specific level of service (LOS) and that
new development will not degrade those levels of service.
The City of Ocoee's Comprehensive Plan was adopted on September 18, 1991
and contains the LOS standards and policies for meeting the state
concurrency requirements. The Comprehensive Plan also contains the
goals, objectives and policies which will direct future development in
the City of Ocoee. The Land Development Code (LDC) is the implementing
mechanism for the Comprehensive Plan. This document contains all the
rules, standards and criteria which govern all land development. The
LDC also includes the adopted procedures for the CMS, to be known as
Article IX of the LDC.
A concurrency evaluation is required for all new development and
redevelopment that has an impact on the LOS of public facilities and
services. Refer to Article IX of the LDC to ascertain if your plans
need a concurrency evaluation.
An ini tial determination of concurrency must be performed by the
Development Administrator for preliminary development orders and a
Preliminary certificate of Concurrency will be issued if there are no
deficiencies. This Preliminary certificate of Concurrency shall not be
binding upon the City. Only those certificates of Concurrency issued
for final development orders or permits shall be binding upon the City.
The Final certificate of Concurrency is valid for one (1) year for all
elements except for traffic circulation. subject to the extension
provisions set forth below, the transportation capacity reservation is
valid for ninety (90) days. It is non-renewable. A Final certificate
of Concurrency shall evidence satisfaction of all concurrency
requirements with respect to the issuance of the building permits
related thereto, subject to the terms and conditions of such
certificate. In the event all or a portion of the Final certificate of
Concurrency has expired, it will be necessary to reapply to the City for
a new certificate with respect to portions of such initial Final
certificate of Concurrency which have expired. The term of the Final
certificate of Concurrency may be extended for one (1), two (2), or
three (3) years with respect to traffic circulation by Obtaining a
. Transportation Capacity Reservation Certificate pursuant to Section 9-7
of Article IX of the Land Development Code.

Sanitary sewer and potable water reservation capacity is done in
accordance with the terms of independent developer agreements to be
entered into with the City of Ocoee.
A Transportation Capacity Reservation Certificate reserves capacity
for a set period of time. If I do not use the capacity within that
time, I lose my reserved capacity and a percentage of my deposit.
My building permit will not be approved if the proposed use(s),
square footage and/or number of units listed on the permit
application are greater than those submitted on this application.
The Development Administrator may require additional information in
order for an accurate assessment to be conducted. I understand that
the City of Ocoee cannot conduct special studies such as traffic
counts on roads not regularly monitored and that I may be required to
submit a traffic study obtained at my own expense. I also understand
that review and approval of proposed development may be postponed for
a reasonable. time period in order for me to gather additional
information. I also understand that proposed development may be
denied approval for my failure to provide adequate information on the
projected impacts created by the development.

The potable water and sanitary sewer capacity reservations are done by separate Developer
Agreements. This certificate bases the reservations for potable water and sanitary sewer on those
Developer Agreements and does not modify or extend the terms thereof. In the event of any conflict
between this Certificate and the provisions of the separate Developer Agreements, the provisions of
the separate Developer Agreements shall prevail.

applicable, in compliance with the Land Development Code and other such stormwater drainage
approvals as may be required by the Land Development Code.
This certificate is non-renewable and subject to the provisions of Article IX of the Ocoee Land Development Code,
In the event all or a portion of the certificate expires, it will be necessary to reapply for a new Final Certificate of
Concurrency with respect to portions which have expired.
The terms of this certificate may be extended for one (1), two (2), or three (3) years with respect to traffic circulation
