RESOLUTION NO. 92-~
A RESOLUTION OF THE CITY OF OCOEE,
FLORIDA ESTABLISHING NEW RATES FOR
RESIDENTIAL GARBAGE COLLECTION
SERVICES; REPEALING RESOLUTION NO.
91-17; REPEALING INCONSISTENT
RESOLUTIONS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the City Commission of the City of Ocoee has
heretofore established by Resolution No. 91-17, adopted September
12, 1991, the base rate for residential garbage collection services
based on two Class I pick-ups per week, one yard waste and one
recyclable materials, for a total of four pick-ups per week; and
WHEREAS, the City Commission has determined that it is
possible to decrease the base rate for residential garbage
collection services from $18.00 per month to $16.00 per month and
to limit garbage collection services through active home composting
yard waste programs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
Section 1. Resolution No. 91-17, adopted September
12, 1991 is hereby repealed in its entirety.
Section 2. Pursuant to Section 11-8 of Chapter 11 of
the Code of Ordinances of the City of Ocoee, the base rate for
residential garbage collection services is hereby established at
$16.00 per month for two (2) Class I pick-ups per week with a limit
of three (3) thirty (30) gallon containers per pick-up, one (1)
yard waste pick-up per week with a limit of the equivalency of four
(4) lawn bags per pick-up, and one (1) recycling pick-up per week.
Section 3. Pursuant to Section 11-8 of Chapter 11 of
the Code of Ordinances of the City of Ocoee, the rates for the
pick-up of containers/lawn bags which exceed the per pick-up limits
set forth in Section 2 above shall be as follows:
(a) Customers exceeding the per pick-up limit set
forth in Section 2 hereof for containers shall
be charged $2.50 per each additional Class I
thirty (30) gallon or less container that is
picked up by the City.

(b) Customers exceeding the per pick-up limit set
forth in Section 2 hereof for lawn bags of
yard waste shall be charged $1.25 for each
additional lawn bag, up to a maximum of the
equivalency of six (6) additional lawn bags.
Over six (6) additional lawn bags shall be
considered a bulk pick-up subject to the
following charges:

Unless otherwise provided by ordinance, the procedure for the pick-
up and billing of the additional services not included within the
base rate for residential garbage collection services shall be
established by the Director of Public Works.
Section 4. The provisions of resolutions or parts
thereof in conflict herewith are hereby repealed or superseded.

Section 5. If any section, subsection, sentence,
clause, or phrase or portion of this Resolution is for any reason
held unconstitutional or invalid by any court of competent

jurisdiction such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
validity of the remaining portion thereto.
Section 6. This Resolution has been adopted after a
public hearing preceded by at least seven days notice thereof and
of the proposed action by publication in a newspaper of general
circulation in the City.
Section 7. This Resolution shall become effective
retroactive to April 1, 1992.
