RESOLUTION NO. 9l~01
A RESOLUTION OF THE CITY OF OCOEE,
ORANGE COUNTY, FLORIDA, ESTABLISHING
A FEE FOR FURNISHING COPIES OF FORMS
AND PRINTED STATEMENTS AS REQUIRED BY
SECTION 713.135, FLORIDA STATUTES;
PROVIDING FOR SEVERABILITY; PROVIDING
FOR AN EFFECTIVE DATE.

WHEREAS, section 713.135, Florida Statutes requires
the City to provide applicants for building permits with a
printed statement stating that the right, title, and interest
of the person who has contracted for the improvement may be
subject to attachment under the Construction Lien Law; and
WHEREAS, Section 7l3.l3(~), Florida Statutes provides
that a city may by resolution establish reasonable fees for
furnishing copies of forms and printed statements required by
the Construction Lien Law; and
WHEREAS, Chapter 713, Florida Statutes, provides
that the fee permitted shall not exceed Five and 00/100 ($5.00)
Dollars; and
WHEREAS, all applicable legal requirements pertain-
ing to public notices and hearings have been satisfied within
specified deadlines and prior to final adoption of this Re-
solution; and
WHEREAS, the City Commission has, in meeting duly
assembled, examined and carefully considered the proposed
fee and determined that $5.00 is a reasonable fee for fur-
nishing copies of the forms and printed statements required
by the Construction Lien Law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS:
SECTION 1. Authority. The City Commission of the
City of Ocoee has the authority to adopt this Resolution pur-
suant to Article VIII of the Constitution of the State of
Florida and Chapters 166 and 713, Florida Statutes.

SECTION 2. Collection of fee. The City of Ocoee
Building Department is authorized and directed to collect a
fee of Five and 00/100 ($5.00) Dollars to cover the cost for
furnishing copies of forms and printed statements as required
by Chapter 713, Florida Statutes; provided, however, that said
fee shall not be collected from those applicants for permits
exempted from payment of said fee under Florida law. Said fee
shall be paid by the applicant for each building permit prior
to the issuance of a building permit and shall be in addition
to all other costs of the building permit.
SECTION 3. Severability. If any section, subsection,
sentence, clause, phrase or portion of this Resolution is for
any reason held invalid or unconstitutional by any court of com-
petent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion hereto.
SECTION 4. Effective date. This resolution shall
be effective immediately upon passage and adoption.
