RESOLUTION NO. 91 - 02
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
AUTHORIZING THE CHIEF OF POLICE TO WITHDRAW UP
TO $25,000 FROM THE CITY'S CONTINGENCY FUND
ACCOUNT FOR A PERIOD NOT TO EXCEED 24 HOURS TO
BE USED AS FLASH MONEY IN STING OPERATIONS.
WHEREAS, the city commissioners of the city of Ocoee,
Florida, wishes to ensure the safety and well being of the citizens
of Ocoee by controlling the flow of illegal drugs in the City of
Ocoee, Florida; and

WHEREAS, large sums of money are often needed on short
notice by the Ocoee Police Department to use as flash money to
apprehend illegal drug dealers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF OCOEE, FLORIDA, as follows:
section 1. Authoritv. The city commission of the city
of Ocoee, Florida, has the authority to adopt this Resolution
pursuant to Article VIII of the Constitution of the State of
Florida and Chapter 166, Florida Statutes.
section 2. Authorization. The city commission of the
city of Ocoee, Florida, hereby authorizes the Ocoee Chief of
Police to withdraw from the City of Ocoee's Contingency Fund
Account an amount not to exceed $25,000.00 for a period of time
not to exceed twenty-four (24) hours. The exclusive purpose of
any such withdrawal of funds shall be for use as "flash money" in
police sting operations. Such funds shall be redeposited into
the city of Ocoee's contingency Fund Account within twenty-four
(24) hours after withdrawal by the Ocoee Chief of Police. The
city Finance Department shall maintain an accounting of all such
withdrawals and deposits and shall promptly notify the city Man-
ager in the event such funds are not redeposited within twenty-
four (24) hours of withdrawal. The Ocoee Chief of Police shall
maintain records regarding the custody of any such funds with-
drawn pursuant to this Resolution.
Section 3. severability. If any section, subsection,
sentence, clause, phrase or portion of this Resolution is for any
reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portion hereto.
section 4. Effective Date. This Resolution shall become
effective immediately upon passage and adoption.
