HomeMy WebLinkAboutResolution 89-04 RESOLUTION 89 - tJ t/ A RESOLUTION PROVIDING FOR CONCEPTUAL APPROVAL OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF OCOEE AND ORANGE COUNTY ON COLLECTION AND DELIVERY OF RECYCLABLE WASTE MATERIALS. . WHEREAS, the Florida Legislature has mandated a 30% reduction in the waste-stream, and WHEREAS, sharing in Department of Environmental Regulation grant monies is possible only by joining forces with Orange County, and WHEREAS, the City of Ocoee is anxious Lo be a part of the solution to the ever-increasing difficulty of waste-stream reduction, NOW, THEREFORE, be it resolved that the Ocoee City Council does hereby grant conceptual approval and authorize the Mayor and City Clerk/ Administrator to execute the Orange County Waste Management Interlocal Agreement. LIMITATION ON LEGISLATIVE MANDATES . This amendment limits the power of the Legislature to enact statewide laws which require counties or municipalities to expend local monies to comply with new law, unless the Legislature provides local governments with a new state source of revenue to fund compliance. New state funds must be in addition to all funds available from existing sources to local governments when the law is passed. The amendment does not apply to laws affecting the judiciary. TEXT OF THE AMENDMENT: The following new section is added to Article VII of the Florida Constitution: Section 17. Laws requiring expenditure by counties or municipalities. The Legislature may not enact a general law if compliance with that law will require a county or municipality to spend local monies (which shall include all funds available from then existing revenue sources to counties or municipalities on the date the law is enacted), unless the Legislature provides adequate state monies to fund the cost of compliance with the law.
