RESOLUTION NO. 90-04

A RESOLUTION RELATING TO THE FLORIDA
RECREATIONAL TRAILS SYSTEM AS CREATED BY
CHAPTER 260, FLORIDA STATUTES; PROVIDING FOR
SUPPORT AND ASSISTANCE TO THE TRI-COUNTY
CHAPTER OF RAILS TO TRAILS, ORANGE COUNTY AND
NEIGHBORING MUNICIPALITIES IN EFFORTS TO
ACQUIRE ABANDONED RAILROAD LINES AND OTHER
PROPERTIES NECESSARY WITHIN THE APOPKA TO LAKE
COUNTY RAILROAD CORRIDOR FOR CONVERSION OF THE
CORRIDOR TO A LINEAR PARK SYSTEM OR "RAIL
TRAIL" PARK; URGING THE LEGISLATURE OF THE
STATE OF FLORIDA TO APPROPRIATE FUNDS FOR THE
PURCHASE OF THE CSX OWNED PORTION OF SAID RAIL
CORRIDOR; PROVIDING THAT THE MUNICIPALITY
SUPPORT THE CONCEPT OF A "RAIL TRAIL" PARK BY
APPROPRIATE ACTION AND NEGOTIATIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida enacted
Chapter 260, Florida Statutes, the Florida Recreational Trails Act
1979, which creates and provides for the expansion of a network,
of recreational and scenic trails designated as the Florida
Recreational Trails Systems;
WHEREAS, the Tri-County Chapter (Orange, Seminole, Osceola
Counties) of the Rails to Trails Conservancy is dedicated to the
creation of an interconnected linear park system of rail and trails
accessible to communities in the Tri-County area (a "rail trail"
park) and to the use of such by a diverse variety of users;
WHEREAS,
wi thin Orange County there exists an abandoned
railroad corridor, extending from Apopka to Lake County, which is
suitable for development as a "rail trail" park;
WHEREAS, the Department of Natural Resources of the State of
Florida,
Orange County,
Florida;
and various neighboring
municipalities wish to acquire and assemble parcels within this
"rail trail" corridor by utilizing abandoned railroad rights-of-
way and land adjacent or interstitial thereto, as well as necessary

alternative routes,
for use and development as a public
recreational trail, and to encourage the multiple use of such for
horseback riding, hiking, biCYCling, and jogging; and
WHEREAS, the acquisition, organization and maintenance of such
a "rail trail corridor" will require the negotiation, execution and
implementation of an interlocal agreement among the affected local
governments.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF OCOEE THAT:
section 1. The City of Ocoee supports the Tri-County Chapter
of Rails to Trails and Orange County, Florida in their efforts to
acquire abandoned railroad lines and other necessary parcels of
public or private property and to convert the same into a linear
park system or "rail trail" which will be jointly operated by the
aforementioned jurisdictions through an interlocal agreement.
section 2. The Legislature of the State of Florida is hereby
urged to appropriate sufficient funds to enable the Florida
Department of Natural Resources to purchase the CSX owned sections
of the Apopka to Lake County railroad corridor for "rail trail"
park purposes and incorporation of the same within the said "rail
trail."
section 3. The City of Ocoee hereby authorizes the City
Manager and/or his designee to enter into negotiations with all
proper parties for the purpose of negotiating an interlocal
agreement under which railroad lands and other privately owned (or
nonrailroad owned) lands and/or municipally owned lands or other
public land would be combined within the aforementioned "rail-
trail" corridor and said corridor would be operated jointly as a
public park.
section 4. Effective Date. This Resolution shall become
effective upon adoption by the City.
