G. AMICK and CHRIS W. AMICK, his wife, are owners of that certain property located in Orange County, Florida, known as BRENTWOOD HEIGHTS UNIT #4, City of Ocoee, Orange County, Florida, and further described as: ~ Begin at the NW corner of Section 16, Township 22 South, Range 28 East, thence run S 89044'24" E, along the N line of said Section16, 660.23 feet; thence S 0006'26" W, 443.79 feet; thence S 0032'36" E, 543.25 feet; thence N 89041'2611 E, 18.0 feet; thence S 0006'2611 E, 353.38 feet to a point on the north boundary line of Brentwood Heights Unit 112, as recorded in Plat Book "z /I, Page 131, Public Records of Orange County, Florida, thence run N 89053'24" W along the North Boundary line of said Brentwood Hights Unit #2, 680.53 feet to the Northwest corner of Brentwood Heights Unit #3, as recorded in Plat Book III", Page 67, Public Records of Orange County, Florida; thence run N 00000'5411 W 1341.77 feet to the Point of Beginning, the plat of said Brentwood Heights being recorded in Plat Book Page , Public Records of Orange County, Florida. IilHEREAS, in consideration of mutual covenants contained herein the owners and the City of Ocoee do hereby agree as follows: That all of the above described property shall ~ zoned and used in conformity with the zoning resolutions of Orange County, Florida, as they were approved by the County Board of Commissioners on December 3, 1964, and any changes or amendments to said ordinance. It being the intention of the parties that all of the above described property be utilized and zoned as R-I, single family dwellings and all of the requirements for this type of zoning as contained in the Orange County Zoning Resolutions are hereby incorporated by refer- ~ ence and are imposed on all of the lots, streets and improvements located in or on the aforementioned property. IN ADDITION, the owners, R. G. AMICK and CHRIS W. AMICK, his wife, shall cause all of the above described property to be plated and said plats admitted for approval to the City Council of the City of Ocoee, it being agreed by the parties that the City shall not be bound to approve said plats until and unless all of the streets, drainwells, curbs and gutters are completed prior to the admission of the plats for approval and further that all said . ., , '.~ t . . " '" . improvements shall be constructed in conformity with the Orange County requirements for such improvements in subdivisions of a similar nature. FURTHER, the owners, R. G. AMICK and CHRIS W. AMICK, his wife, shall impose certain deed restrictions, known as Notice of Restric- tions on Real Estate, previously submitted to the City Council on ~ all of that portion of the above described property which has been designated as R-I, single family dwelling districts, and said re- striciions shall be recorded along with the plat and all steps necessary to make these restrictions an imposition on the use of the subject property shall be taken by the owners. AND FURTHER, the owners, R. G. M~ICK and CHRIS W. AMICK, his wife, shall construct and maintain proper drainage facilities for said subdivision, all in conformity with the aforementioned Orange County Subdivision Regulations. The Owners and the Developer shall also dedicate on the plat to be submitted to the City Council of the City of Ocoee appropriate utilities and drainage ways, canals or streams. However, all curbs on the streets and roadways shall be of the construction known as "miami curbingll. The Building Inspector for the City of Ocoee shall inspect all construction subject to this agreement and he is authorized to call to the attention of the developer and/or his representative and/or the Owners any failure of work or material to conform with this agreement and the Orange County Subdivision Regulations, herein in- ~ corporated by reference, and said Building Inspector shall have the authority to reject the materials or suspend the work which is not in conformity with approved plans, specifications and this agreement. AND FURTHER, the owners, R. G. l\MICK and CHRIS W. AMICK, his wife, do hereby agree to pay to the City of Ocoee the sum of $2250.00 which money is paid to the City of Ocoee in lieu of their dedicating to the City a certain percentage of the property above described which would normally have been used as a park or recreational area for the benefit of the residents of the subdivision or the residents , ( :1 . .- .
