CITY OF OCOEE, FLORIDA
RESOLUTION NO.
A RESOLUTION PROVIDING FOR A SPECIAL
ELECTION FOR THE OFFICE OF MAYOR OF
THE CITY OF OCOEE, FLORIDA, TO BE HELD
NOVEMBER 27, 1973.
WHEREAS, on November 6, 1973, a regular municipal
election was held for the office of Mayor of the City of Ocoee
and one City Commissioner, pursuant to Article VII, Section 1,
of the Charter of the City of Ocoee, the candidates for Mayor
in said election being HUBERT W. FOX, SAM SCOTT VANDERGRIFT,
and LEWIS WHITEHEAD; and
WHEREAS, Article VII, Section 1 of the Charter of
the City of Ocoee provides that any candidate for Mayor who
shall receive a majority of the votes cast for such office
shall be elected; and
WHEREAS, in said election held on November 6, 1973,
no candidate for Mayor received a majority of the votes cast;
Hubert W. Fox receiving 253 votes, Sam Scott Vandergrift
receiving 262 votes and Lewis Whitehead receiving 202 votes
of a total of 717 votes; and
WHEREAS, advice has been received from the City
Attorney for the City of Ocoee that said Article VII, Section
1, requires that to be elected Mayor, a candidate must receive
a majority of the votes cast, and
\~EREAS, the City Charter is silent as to any
provision for a runoff election in the event that no candidate
for Mayor receives less than a majority of the votes cast,
BE IT THEREFORE RESOLVED:
THAT the above vote totals are declared by the
City Commission to be a true and accurate count of the votes

received by each candidate for the office of Mayor of the
City of Ocoee.
BE IT FURTHER RESOLVED:
THAT, pursuant to the power of the City Commission
under Article II, Section 27, of the City Charter of the City
.
of Ocoee to provide rules and regulations for special elections,
and under Florida Statutes, Sections 165.13 and 167.005, a
special election for the office of Mayor of the City of Ocoee
shall be held on November 27, 1973, between the two candidates
receiving the most votes in said election of November 6, 1973.
BE IT FURTHER RESOLVED:
THAT the City Manager be instructed to make the
appropriate arrangements for said election.
