RESOLUTION NO.

A RESOLUTION OF THE CITY OF OCOEE,
FLORIDA CONCERNING SERVICES PROVIDED
BY ORANGE COUNTY, FLORIDA WHICH ARE
RENDERED SPECIALLY FOR THE BENEFIT OF
PROPERTY OR RESIDENTS IN THE UNINCOR-
PORATED AREAS OF ORANGE COUNTY, FLORIDA
AND FINANCED FROM COUNTY-WIDE FUNDS;
REQUESTING THE BOARD OF COUNTY COMMISS-
IONERS OF ORANGE COUNTY, FLORIDA TO REMIT
TO THE CITY OF OCOEE AND OTHER MUNICIPAL-
ITIES WITHIN ORANGE COUNTY THE IDENTIFIABLE
PROPORTIONATE SHARE OF THOSE REVENUES COLLEC-
TED BY ORANGE COUNTY FOR SERVICES PERFORMED
EXCLUSIVELY FOR THE UNINCORPORATED AREAS OF
ORANGE COUNTY, FLORIDA.
WHEREAS, Section 125.01(6) (a), Florida Statutes will become
effective on January I, 1975, which is during the 1974-1975
taxable year that will permit a municipality to identify services
rendered specially for the benefit of the property or residents
in unincorporated areas and financed by county-wide revenues
and to petition the Board of County Commissioners to finance
such services by levying against persons or property within the
unincorporated area or to petition said Board to remit to the
municipality the cost of such service paid by taxes levied upon
property situate within the municipality; and
WHEREAS, taxes are levied and revenues collected by Orange
County on a county-wide basis, which revenues go to fund a
variety of services a grossly disproportionate share of which
are rendered solely.for the benefit of residents of the unincor-
porated areas of Orange County, and
WHEREAS, examples of the above are (I) Law enforcement
services of the Orange County Sheriff, almost ninety percent

(90%) of which are rendered for the benefit of unincorporated
areas and only ten percent (10%) for the benefit of municipalities;
(2) services of the various county departments, such as building,
zoning, planning; (3) other county technical departments and

officials; (4) welfare; (5) motor vehicle inspection; (6)
ambulance service and many others services and activities,
and

WHEREAS, the City of Ocoee provides many or most of
these services, particularly police protection, the cost of
which is borne by taxes levied upon property situate solely
within the corporate boundaries of the City of Ocoee, and
WHEREAS, this has the effect of constituting double
taxation of the citizens and residents of Ocoee, Florida,
NOW, THEREFORE, be it resolved by the City Commission of
the City of Ocoee, Florida:
SECTION I. That the City Council of the City of Ocoee,
Florida, intends to petition the Board of County Commissioners,
Orange County, Florida under the provisions of Florida Statutes
125.01(6) (a) to afford relief to the citizens of the City of
Ocoee for that portion of taxes paid that are allocated to
services performed solely to unincorporated areas of the County.
SECTION 2. That the Board of County Commissioners of
Orange County, Florida is hereby requested to take cognizance
that the increases in county expenditures is due to population
growth in the unincorporated areas of Orange County and to
develop an appropriate mechanism to pass such increased costs
to the citizens of unincorporated areas being serviced.
SECTION 3. That the Board of County Commissioners of
Orange County is further requested to reduce the tax millage
assessed against the residents of the City of Ocoee and others
in Orange County municipalities in an amount which is identified
4It as that portion of county expenditures for services rendered
exclusively for the unincorporated areas of Orange County or
alternatively, to remit such sum to the municipalities.

SECTION 4. That since the county provides incidental
services only to municipalities in the areas set forth
above, as an alternative request to Section 3, above, the
Board of County Commissioners of Orange County, is requested
to remit to the City of Ocoee and other municipalities all
of the taxes paid by citizens of the municipalities which
~ are allocated to the county's total budget and services
in these areas, or to reduce the millage assessed against the
citizens of municipalities for such total service, with the
City of Ocoee and other municipalities being billed and paying
for services actually performed by the County for such
municipality.
SECTION 5. That the City of Ocoee hereby joins the
City of Maitland, Orange County, Florida, in making the
requests set forth above and urges other municipalities in
Orange County, Florida to do likewise.
SECTION 6. That this Resolution shall become effective
immediately upon its passage.
