AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA TO EXTEND THE MUNICIPAL LIMITS TO ANNEX, PURSUANT TO SECTION 171.044, FLORIDA STATUTES, THE HEREINAFTER DESCRIBED LAND SITUATED AND BEING IN ORANGE COUNTY, FLORIDA AND PETITIONED BY CAROLINE BROWN AND FRANCES MCGEHEE; PROVIDING FOR AND AUTHORIZING THE UPDATING OF OFFICIAL CITY HAPS; PROVIDING DIRECTION TO THE CITY CLERK; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; PROVIDING AN EFFECTIVE DATE. WHEREAS, Frances McGehee and Caroline Brown, have petitioned the City Commission of the City of Ocoee, Florida, to annex property located in Orange County, Florida; and WHEREAS, Section 171.044, Florida Statutes, provides that a municipal corporation may annex property into its corporate limits, upon voluntary petition of the owners and by passing and adopting a non-emergency ordinance to annex said property; and WHEREAS, the City Commission of the City of Ocoee is desirous of annexing and redefining the boundaries of the municipality to include the subject property pursuant to Section 171.044, Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. That the following described property being situated in Orange County, Florida, totaling approximately 128 acres being the same as described below, and as shown in a sealed boundary survey provided to the City, is hereby annexed into the City of Ocoee, Florida, pursuant to voluntary annexation provisions of Section 171.044, Florida Statutes, and other applicable laws. LEGAL DESCRIPTION: Parcel 1 - The Southwest 1/4 of the Southwest 1/4 of Section 18, Township 22 South, Range 28 East (except that part deeded to the Tavares and Gulf Railroad Company). Also: The Southeast 1/4 of the Southwest 1/4 of Section 18, Township 22 South, Range 28 East. . Also Parcel 2 - Beginning at the intersection of the south side of the right of way of county brick road with the west line of Section 18, Township 22 South, Range 28 East, at a point 529 feet South of the Northwest corner of SW 1/4 of Section 18, Township 22 South, Range 28 East, thence South 818 feet, more or less, to the Southwest corner of the NW 1/4 of SW 1/4 of said Section 18, thence east to the Southeast corner of NW 1/4 of SW 1/4 of Section 18, thence north 796 feet, more or less, along the 40 line to the south line of the right of way of the county brick road, thence west along the south line of the right of way of the county brick road to the point of ~i I beginning. Also: Begin at e the S.W. corner of NE 1/4 of SW 1/4 of Section 18, Township lIBI1'~1 22 South, Range 28 East, run east to S.E. corner of said NE ~ . 1/4 of SW 1/4, thence north to R/W of T. & G. R.R., thence west along south side of said R/W 495 ft. thence north to I'~ south side of brick road, thence west along south side of said ~11 road 784.2 ft., more or less, to the east line of NW 1/4 of ~ SW 1/4 of said section, thence south 796 ft., more or less, \~ to beginning, except R/W of T. & G. Also Parcel 3 - Beginning at the southeast corner of the SW 1/4 of the SE 1/4 of section 18, Township 22 South, Range 28 East, run westerly along the south line of this "40", a distance of 597.3 feet to the point of beginning; now run north 671.6 feet, thence west 14 feet, more or less, to the big drainage ditch. Now follow ditch a short distance north, then northwest and then northeast to the north line of the "40" to a point 705 feet west of the northeast corner, thence west 611 feet, more or less, to the northwest corner, now run south 1261 feet, more or less, to the southwest corner, now run east 712 feet, more or less, to the point of beginning. SECTION 2. That the corporate territorial limits of the City of Ocoee, Florida, are hereby redefined to include said land herein described and annexed. SECTION 3. That the City Clerk is hereby authorized to update and supplement official City maps of the City of Ocoee, Florida, to include said land herein described and annexed. SECTION 4. That the land herein described and future inhabitants of the land herein described shall be liable for all debts and obligations and be subject to all species of taxation, laws, ordinances, and regulations of the City of Ocoee, Florida, and be entitled to the same privileges and benefits as other areas of the City. SECTION s. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is fer any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7. That this Ordinance shall take effect upon passage and adoption, and that thereafter the City Clerk is hereby directed to file a certified copy of this Ordinance with the Secretary of State of the State of Florida and with appropriate agencies in and for Orange County, Florida.
