AN ORDINANCE OF THE CITY OF OCOEE,
FLORIDA AMENDING SECTION 3-8 OF
ARTICLE II OF CHAPTER 3 OF THE CODE OF
ORDINANCES, CITY OF OCOEE, FLORIDA,
PERMITTING BUSINESSES LICENSED FOR THE
SALE OF ALCOHOLIC BEVERAGES IN THE CITY
OF OCOEE TO REMAIN OPEN FOR THE SALE
OF ALCOHOLIC BEVERAGES BETWEEN THE HOURS
OF 12:00 MIDNIGHT ON DECEMBER 31 and 2:00
a.m. ON JANUARY 1 WHEN DECEMBER 31 FALLS
ON A SATURDAY: PROVIDING FOR SEVERABILITY,
CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, Section 3-8 of Article II of Chapter 3 of
the Ocoee Code of Ordinances permits businesses licensed for
the sale of alcoholic beverages in the City of Ocoee to remain
open for the sale of such beverages on December 31 for one hour
after their regular closing time except when December 31 falls
on a Saturday in which case such businesses are required to close
at 12:00 midnight on Saturday, December 31; and
WHEREAS, the City of Ocoee desires to permit businesses
licensed for the sale of alcoholic beverages in the City of Ocoee
to remain open for the sale of such beverages between the hours
12:00 midnight on December 31 and 2:00 a.m. on January 1 when
December 31 falls on a Saturday; and
WHEREAS, the City Commission of the City of Ocoee has
the authority to adopt this Ordinance pursuant to Chapter 166
of the Florida Statutes.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE
CITY OF OCOEE, FLORIDA THAT:
SECTION 1. Section 3-8 of Article II of Chapter 3
of the Code of Ordinances, City of Ocoee, Florida, is hereby
amended to read as follows:
Sec. 3-8. On New Year's Eve.
Businesses licensed for the sale of alcoholic beverages in
the City of Ocoee shall be permitted to remain open for the
sale of such beverages on New Year's Eve (December 31) for
one hour after their regular closing time established in Article
II of this Chapter. However, notwithstanding anything contained
in Article II of this Chapter to the contrary, when December
31 falls on a Saturday, such businesses shall be permitted
to remain open for the sale of alcoholic beverages between
the hours of 12:00 midnight on Saturday, December 31, and
2:00 a.m. on Sunday, January 1.

SECTION 2. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion hereto.
SECTION 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 4. This Ordinance shall take effect immediately
upon its final passage and adoption.
