AN ORDINANCE ESTABLISHING A CERTAIN BOUNDARIES; DESCRIBING PROVIDING UPDATING OF PROVIDING FOR OF THE CITY OF OCOEE, FLORIDA, THE ZONING CLASSIFICATION OF AREA WITHIN THE MUNICIPAL MAKING FINDINGS OF FACT; THE PROPERTY TO BE ZONED; FOR AND AUTHORIZING THE OFFICIAL CITY MAPS; AND AN EFFECTIVE DATE. WHEREAS, C. WAYNE ATWOOD, GENERAL PARTNER OF SKYLARK VENTURES, LTD. has petitioned the City of Ocoee Board of Commissioners for a zoning change; and WHEREAS, the City of Ocoee Board of Commissioners has annexed this property; and, WHEREAS, the Planning and Zoning commission has reviewed the petition; and, WHEREAS, a Public Hearing as provided in Section 5-1, Chapter 2, Appendix A of the Code of Ordinances of the City of Ocoee, Florida Statutes 166.041 and 163.3184 and Laws of Florida Chapter 85-55, was held on the question of rezoning of said parcel of real property described below after due public notice; and, WHEREAS, the City Commission of the City of Ocoee, Florida has made an independent examination and determined that the zoning classification of the parcel of real property as set forth below is in the best interests of the City; and, WHEREAS, the rezoning is consistent with the 1979 City of Ocoee Comprehensive Plan. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA: SECTION 1. Pursuant to authority of the City Commission of the City of Ocoee, Florida, the following described parcel of real property shall henceforth bear the zoning classification as indicated below as defined by Appendix A of the Code of Ordinances of the City of Ocoee, Florida: . TO BE CLASSIFIED: R-1-A SINGLE FAMILY RESIDENTIAL TRACT A: LOT 1 (LESS THE SOUTH 237 FEET LYING EAST OF THE LAKE AND LESS THE NORTH 208 FEET OF THE WEST 208 FEET). LAKE JOHIO SHORES, AS PER PLAT THEREOF RECORDED IN PLAT BOOK "Q", PAGE 54, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA, AND LYING IN SECTION 16, TOWNSHIP 22 SOUTH, RANGE 28 EAST. ALSO LESS AND EXCEPT THAT PORTION OF SAID LOT 1 ACCORDING TO BOOK 3636, PAGES 178 AND 179, OFFICIAL RECORDS OF SAID ORANGE COUNTY, DESCRIBED AS FOLLOWS: A PART OF LOT 1 AS SHOWN ON THE PLAT OF LAKE JOHIO SHORES, RECORDED IN PLAT BOOK "Q", PAGE 54, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA DESCRIBED AS FOLLOWS: . BEGIN AT THE NORTHWEST CORNER OF SAID LOT 1 RUN THENCE SOUTH 00 16 25 WEST ALONG THE WEST LINE THEREOF 512.00 FEET, THENCE NORTH 51 04 25 EAST 306.20 FEET; THENCE NORTH 36 44 25 EAST 274.70 FEET; THENCE NORTH 12 52 08 EAST 102.87 FEET (100' RECORD) TO A POINT ON THE NORTH LINE OF AFORESAID LOT 1. SAID POINT BEING 423.00 FEET EAST OF AFORESAID NORTHWEST CORNER THEREOF; THENCE SOUTH 89 52 20 WEST ALONG SAID NORTH LINE 423.00 FEET TO THE POINT OF BEGINNING. CONTAINING 4.534 ACRES, MORE OR LESS. SECTION 2. That the City Clerk is hereby authorized to update and supplement the official City of Ocoee maps to include said land herein described. . SECTION or subsection unlawful, or invalidate or other section Ordinance. 3. That if any section or portion of section of the Ordinance proves to be invalid, unconstitutional, it shall not be held to impair the validity, force or effect of any or portion of a section or subsection of this SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this Ordinance shall take effect upon passage and adoption, thereafter the City Clerk is hereby directed to file a certified copy of this Ordinance with the Department of State of the State of Florida.
