AN ORDINANCE ESTABLISHING A CERTAIN BOUNDARIES; DESCRIBING PROVIDING UPDATING OF PROVIDING FOR OF THE CITY OF OCOEE, FLORIDA, THE ZONING CLASSIFICATION OF AREA WITHIN THE MUNICIPAL MAKING FINDINGS OF FACT; THE PROPERTY TO BE ZONED; FOR AND AUTHORIZING THE OFFICIAL CITY MAPS; AND AN EFFECTIVE DATE. WHEREAS, MOREMEN, SHEPPARD, MURRAY, AND DAVIS has petitioned the City of Ocoee Board of Commissioners for a zoning change; and WHEREAS, the City of Ocoee Board of Commissioners has annexed this property; and, WHEREAS, the Planning and Zoning Commission has reviewed the petition; and, WHEREAS, a Public Hearing as provided in Section 5-1, Chapter 2, Appendix A of the Code of Ordinances of the City of Ocoee, Florida Statutes 166.041 and 163.3184 and Laws of Florida Chapter 85-55, was held on the question of rezoning of said parcel of real property described below after due public notice; and, WHEREAS, the City Commission of the City of Ocoee, Florida has made an independent examination and determined that the zoning classification of the parcel of real property as set forth below is in the best interests of the City; and, WHEREAS, the rezoning is consistent with the 1979 City of Ocoee Comprehensive Plan. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA: SECTION 1. Pursuant to authority of the City Commission of the City of Ocoee, Florida, the following described parcel of real property shall henceforth bear the zoning classification as indicated below as defined by Appendix A of the Code of Ordinances of the City of Ocoee, Florida: . TO BE CLASSIFIED: R-3 MULTIPLE FAMILY DWELLING DISTRICT WITHIN SECTION 20, TOWNSHIP 22 SOUTH, RANGE 28 EAST, ORANGE COUNTY, FLORIDA; ALL OF LOTS 22, 23, 24, 25, 26, 27, AND 28 OF BLOCK 6, TOWN OF OCOEE, SECTION 20, TOWNSHIP 22 SOUTH, RANGE 28 EAST, ORANGE COUNTY, FLORIDA; LESS: THOSE PORTIONS OF LOTS 22, 23, AND 24 SITUATED NORTH OF A LINE GENERALLY DESCRIBED AS FOLLOWS: COMMENCING AT A POINT ON THE WEST LINE OF LOT 24 LOCATED 348 FEET EAST AND 390 FEET SOUTH OF THE N.W. CORNER OF THE S.E. 1/4 OF SAID SECTION 20; THENCE SOUTHEASTERLY 170 FEET; THENCE EAST 220 FEET AND CROSSING THE WEST LINE OF SAID LOT 24 AT A POINT 180 FEET NORTH OF GEORGIA STREET; THENCE SOUTHEASTERLY 265 FEET TO A POINT r ON THE WEST LINE OF LOT 23 AND SITUATED 100 FEET NORTH OF GEORGIA STREET; THENCE SOUTHEASTERLY 225 FEET TO A POINT ON THE SOUTH LINE OF LOT 22 SITUATED 120 FEET WEST OF THE N.W. CORNER OF GEORGIA STREET AND CALIFORNIA AVENUE. SECTION 2. That the City Clerk is hereby authorized to update and supplement the official City of Ocoee maps to include said land herein described. . SECTION or subsection unlawful, or invalidate or other section Ordinance. 3. That if any section or portion of the Ordinance proves to be unconstitutional, it shall not be impair the validity, force or effect or portion of a section or subsection of section invalid, held to of any of this SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this Ordinance shall take effect upon passage and adoption, thereafter the City Clerk is hereby directed to file a certified copy of this Ordinance with the Department of State of the State of Florida.
