AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA,
REPEALING ORDINANCE NUMBER 1006 AND SECTION
11-8 OF THE CODE OF ORDINANCES RELATING TO
GARBAGE SERVICE; CREATING A NEW SECTION
11-8 OF THE CODE OF ORDINANCES, PROVIDING
FOR ESTABLISHING FEES FOR GARBAGE SERVICE
BY RESOLUTION, PROVIDING FOR BILLING PERIODS;
CREATING A NEW SECTION 11-9 OF THE CODE OF
ORDINANCES, PROVIDING FOR CLASSIFICATION OF
COLLECTION, PROVIDING FOR PRIVATE SERVICE;
PROVIDING FOR AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF OCOEE, FLORIDA:
Section 1. Ordinance Number 1006 is hereby repealed.
Section 2. Section 11-8 of the Ocoee Code of Ordinances
is hereby repealed.
Section 3. A new Section 11-8 of the Ocoee Code of Ordi-
nances is hereby created to read as follows:
Section 11-8. Collection of Garbage; Fees
(A) Garbage collection service rates shall be established
by the City Commission by resolution after a public hearing pre-
ceded by at least seven (7) days notice of the hearing and the
proposed action by publication in a newspaper of general circu-
lation in the City of Ocoee. The resolution may provide that
the new rate be retroactive to the beginning of the billing period
in which the resolution is passed.
(B) Rates shall be based on two pickups per week. Customers
requiring more frequent service shall be charged a proportionally
higher rate.
(C) Billing for garbage collection service shall be on
a monthly basis.
Section 4. A new Section 11-9 of the Ocoee Code of Ordi-
nances is hereby created to read as follows:
Section 11-9. Collection of Garbage
(A) Residential Premises.
(1) Single family residential units shall be charged
the base rate for garbage collection established by resolution.

(2) Multiple family residential units containing
four or less single family residential units shall be charged
the base rate for garbage collection established by resolution
for each unit.
(3) Multiple family residential units containing
more than four single family residential units shall be treated
as a commercial account and shall be charged the commercial rate
for garbage collection.
(B) Commercial, Industrial and Institutional Premises.
(1) Commercial, industrial, or institutional premises
using trash cans of thirty gallons or less capacity each shall
be charged the base rate for garbage collection established by
resolution for each can.
(2) Commercial, industrial, or institutional premises
using dumpsters shall be charged a commercial rate for garbage
collection established by resolution.

(3) Commercial, industrial, or institutional premises
using dumpsters may contract with licensed private companies
for garbage collection. While such a contract is in force and
collection performed, such premises shall not be charged for
City collection service.
Section 5. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion hereto.
Section 6. This Ordinance shall become effective immediately
upon passage and adoption.
