HomeMy WebLinkAboutOrdinance 1033 EMERGENCY ORDINANCE NO.: 1033 AN EMERGENCY ORDINANCE OF THE CITY OF OCOEE, FLORIDA PROVIDING THAT THE BASE FACILITY CHARGE ESTABLISHED BY THE PUBLIC SERVICE COMMISSION BE BILLED TO CONSUMERS IN ADVANCE ON THE FIRST OF EACH MONTH, PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. --- WHEREAS, the City of Ocoee, Florida is currently under contract to purchase the Prima Vista Sewage Treatment Plant (hereinafter referred to as "Plant"); and . WHEREAS, the date of closing of the purchase transaction and acquisition of the Plant is at this time uncertain; and WHEREAS, it is important to provide for regular and continuous collection of fees from consumers of the Plant's services in order to insure uninterrupted service; and WHEREAS, it is vital to do so immediately to protect the health, safety and general welfare of the citizens of Ocoee; NOW, THEREFORE, be it enacted by the people of the City of Ocoee, Flor ida, the Code of Ordinances, Ci ty of Ocoee, Flor ida is hereby amended to add the following section to be numbered Section 1. The above reci tals are hereby repeated and made a part of this ordinance. Section 2. The City hereby adopts the Base Facility Charge for sewer services, as approved by the Florida Public Services Commission, and currently being charged consumers as the rate the Plant's consumers shall be charged; which shall be due and payable in advance on the first day of every month beginning January 1, 1988. Section 3. Said rate shall remain in effect until such time as the City Commission, adopts, by duly enacted ordinance, a method of calculating Usage Charges based upon the actual volume of Plant treatment services used by each individual consumer. . Section 4. Severability. If any section or portion of a section or subsection of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of section or subsection or part of this ordinance. Section 5. Conflicts. All ordinances or parts or ordinances in conflict herewith are hereby repealed. Section 6. Effective Date.
