AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, TO AMEND THE 1979 CITY OF OCOEE COMPREHENSIVE PLAN, PURSUANT TO FLORIDA STATUTE 163.3187, PROVIDING FOR A CHANGE TO THE FUTURE LAND USE ELEMENT AND GENERALIZED FUTURE LAND USE MAP; PROVIDING DIRECTIONS TO THE CITY CLERK; AND PROVIDING FOR CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, the 1979 City of Ocoee Comprehensive Plan may be amended from time to time to accomodate changing growth patterns as provided in Florida Statute 163.3184; and WHEREAS, the City Commission of the City of Ocoee has considered recommendations of its Local Planning Agency to make changes to the Comprehensive Plan while preserving its internal consistency and maintaining compliance with Florida State Statutes; and WHEREAS, the City Commission of the City of Ocoee has made findings of fact that all public meetings, hearings, and notifications have been accomplished in accordance with applicable Florida State Statutes; and WHEREAS, the City Commission of the City of Ocoee has reviewed all available information including public, private, and governmental comments pertaining to the proposed change to its 1979 Comprehensive Plan. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA: SECTION 1: That, pursuant to authority granted by Florida Statute 163.3187, the following described parcel(s) shall henceforth be classified on the official Generalized Land Use Map of the City of Ocoee as indicated below, in accordance with the definitions of the Future Land Use Element of the 1979 Comprehensive Plan: TO BE CLASSIFIED RESIDENTIAL: PARCEL 1 e The Southwest 1/4 of the Northwest 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida and the East 3/4 of the Northwest 1/4 of the Northwest 1/4 and the Northwest 1/4 of the Northeast 1/4 of the Northwest 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida, and the South 3/4 of the East 1/2 of the Northwest 1/4 LESS: right-of-way for the Railroad in Section 3, Township 22 South, Range 28 East, Orange County, Florida. PARCEL 2 The South 1/2 of the North 1/2 of the Southwest 1/4 of the Northeast 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida. LESS: the Railroad right-of-way and less road right-of-way. AND e That part of the South 3/4 of the Southwest 1/4 of the Northwest 1/4 of the Southeast 1/4 of the Northeast 1/4 of Section 3, Township 22 South, Range 28 East, lying West of the Westerly right- of-way line of Apopka-Vineland Road (S.R. 435), all being in Orange County, Florida. PARCEL 3 Beginning at the Northwest corner of the Southwest 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida, run S.89 40'37" East along the North line of said Southwest 1/4 a distance of 1807.29 feet; thence leaving said North line, run S.OO 06'35" West 340.92 feet; thence N.89 48'58" West 150.00 feet; thence S.OO 06'35" West 75.00 feet; thence N89 48'58" West 466.81 feet; thence S.OO 06'35" West 250.00 feet to a point on the South line of the North 1/4 of said Southwest 1/4 of Section 3; thence run N89 48"58" West along said South line 1193.28 feet to the Southwest corner of said North 1/4 of the Southwest 1/4 of Section 3; thence run N.OO 21'01" West along the West line of said Section 3 a distance of 670.33 feet to the Point of Beginning. PARCEL 4 e A part of the North 1/2 of the Northeast 1/4 of the Southwest 1/4 lying West of the S.C.L. Railroad and a part of the Southeast 1/4 of the Northeast 1/4 of the Southwest 1/4 lying West of the S.C.L. Railroad all in Section 3, Township 22 South, Range 28 East, Orange County, Florida, LESS: the South 30.00 feet for road right- of-way, all of the above being more particularly described as follows: From the Southeast corner of the Northeast 1/4 of the Southwest 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida run N.89 e 57'18" West along the South line of said Northeast 1/4 of the Southwest 1/4 of Section 3 a distance of 626.20 feet; thence NOO 02'34" East 30.00 feet to the Point of Beginning on the Northerly right-of-way line of Hackney-Prairie Road; thence run N89 57'18" West along said Northerly right-of-way line 41.37 feet to a point on the Westerly line of the Southeast 1/4 of the N.E. 1/4 of the S.W. 1.4 of aforesaid Section 3; thence N.OO 06'35" East along said Westerly line 635.48 feet to a point on the South line of the North 1/2 of the Northeast 1/4 of the Southwest 1/4 of the aforesaid Section 3; thence N89 48'58" West along said South line 189.88 feet; thence NOO 06'35" East 665.94 feet to a point on the North line of said North 1/2 of the Northeast 1/4 of the Southwest 1/4 of Section 3; thence S89 40'37" East along said North line 745.19 feet to a point on the Westerly right-of-way line of the S.C.L. Railroad; thence S06 36'38" West along said Westerly right-of- way line 703.44 feet; thence N89 42'26" West 435.04 feet; thence SOO 02'34" West 601.23 feet to the Point of Beginning, LESS: the Southerly 601.23 feet thereof. PARCEL 5 e From the Northwest corner of the Southwest 1/4 of Section 3, Township 22 South, Range 28 East, Orange County, Florida, run S.89 40'37" E. along the North line of said Southwest 1/4 a distance of 1807.29 feet; thence leaving said North line run S.OO 06'35" W. 340.92 feet to the Point of Beginning; thence run N.89 48'58" W. 150.00 feet; thence S.OO 06'35" W. 75.00 feet; thence N.89 48'58" W. 466.81 feet; thence S.OO 06'35" W. 250.00 feet to a point on the South line of the North 1/4 of said Southwest 1/4 of Section 3; thence run S.89 48'58" E. along said South line 616.81 feet; thence N.OO 06'35" E. 325.00 feet to the Point of Beginning. SECTION 2: That the City Clerk is hereby authorized :0 update and supplement the official Generalized Future Land Use Map of the City of Ocoee to include said amendment herein described. e e SECTION 3: or subsection unlawful, or invalidate or other section That if any section or portion of a section of this Ordinance proves to be invalid, unconstitutional, it shall not be held to impair the validity, force, or effect of any or subsection or part of this Ordinance. SECTION 4: That all Ordinances or parts of Ordinances In conflict herewith are hereby repealed. SECTION 5: That the City Clerk is hereby directed to file a certified copy of this Ordinance with the Florida Department of Community Affairs immediately following its passage and adoption. SECTION 6: That this Ordinance shall take effect days following its passage and adoption, and thereafter, City Clerk is hereby directed to file a certified copy of Ordinance with the Secretary of State of the State Florida. 22 the the of 4tJt CL-rJ , 1987.
