HomeMy WebLinkAboutOrdinance 979 l ORDINANCE NO. 919 FIRST READING: 06/16/87 08/04/87 SECOND READING: CASE NO.04C-87 e AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, TO AMEND THE 1979 CITY OF OCOEE COMPREHENSIVE PLAN, PURSUANT TO FLORIDA STATUTE 163.3187, PROVIDING FOR A CHANGE TO THE FUTURE LAND USE ELEMENT AND GENERALIZED FUTURE LAND USE MAP; PROVIDING DIRECTIONS TO THE CITY CLERK; AND PROVIDING FOR CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, the 1979 City of Ocoee Comprehensive Plan may be amended from time to time to accomodate changing growth patterns as provided in Florida Statute 163.3184; and WHEREAS, the City Commission of the City of Ocoee has considered recommendations of its Local Planning Agency to make changes to the Comprehensive Plan while preserving its internal consistency and maintaining compliance with Florida State Statutes; and WHEREAS, the City Commission of the City of Ocoee has made findings of fact that all public meetings, hearings, and notifications have been accomplished in accordance with applicable Florida State Statutes; and WHEREAS, the City Commission of the City of Ocoee has reviewed all available information including public, private, and governmental comments pertaining to the proposed change to its 1979 Comprehensive Plan. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA: SECTION 1: That, pursuant to authority granted by Florida Statute 163.3187, the following described parcel(s} shall henceforth be classified on the official Generalized Land Use Map of the City of Ocoee as indicated below, in accordance with the definitions of the Future Land Use Element of the 1979 Comprehensive Plan: TO BE CLASSIFIED RESIDENTIAL: The North 1/2 of the NE 1/4 of the Section 31, Township 22 South, Range Orange County, Florida. LESS: The East for Maguire Road right-of-way, Plus, the NE 1/4 of 28 East, 40 thereof following: e From the NE corner of Section 31, Township 22 South, Range 28 East, Orange County, Florida; go South 670.03 feet, thence 40 feet South 89 19'12" West, thence 150 feet S 00 15'30" East to the Point of Beginning; thence 260 feet S 89 19'12" West, thence 142 feet N 00 15'30" W, thence South 89 19'12" W to the NW corner of the South 1/2 of the NE 1/4 of the NE 1/4 of said Section; thence 15 feet South 00 15'30" East, thence 1005 plus or minus feet N 89 19'12" East to a point being 15 feet West of the West boundary line of the following property, to wit: The North 150 feet of the East 300 feet of 1/2 of the S 1/2 of the NE 1/4 of the NE 1/4 the East 40 feet} of Section 31, Township 22 Range 28 East. the N (less South, Thence 142 feet South 00015'30" East, thence 275 feet North 89019'12" East to the Western right-of- way line of Maguire Road, thence 15'N. 00015'30" W along said Maguire Road western right-of-way lineto the POB. e SECTION 2: That the City Clerk is hereby authorized to update and supplement the official Generalized Future Land Use Map of the City of Ocoee to include said amendment herein described. SECTION 3: or subsection unlaHfLll, or invalidate or other section That if any section or portion of a section of this Ordinance proves to be invalid, unconstitutional, it shall not be held to impair the validity, force, or effect of any or subsection or part of this Ordinance. SECTION 4: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 5: That the City Clerk is hereby directed to file a certified copy of this Ordinance with the Florida Department of Community Affairs immediately following its passage and adoption. SECTION 6: That this Ordinance shall take effect 22 days following its passage and adoption, and thereafter, the City Clerk is hereby directed to file a certified copy of the Ordinance with the Secretary of State of the State of Florida.
