AN ORDINANCE OF THE CITY OF OCOEE.
FLORIDA. REPEALING ORDINANCE NO. 894
AND ORDINANCE NO. 904 TO REESTABLISH
DEVELOPMENT REVIEW FEE ASSESSMENTS
FOR REZONINGS. SPECIAL EXCEPTIONS.
VARIANCES. COMPREHENSIVE PLAN
AMENDMENTS. PLANNED UNIT
DEVELOPMENTS. PROPOSED SUBDIVISIONS
AND COMMERCIAL SITE PLANS= PROVIDING
FOR ADMINISTRATIVE PROCEDURES=
PROVIDING FOR FEE SCHEDULES =
PROVIDING FOR SEVERABILITY= AND
PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS. it is the policy of the Ocoee City
Commissioners that whenever possible, the
development shall be incurred by the developer,
the taxpayers in general; and,

WHEREAS. the Ocoee City Board of Commissioners believes
the most practical method of defraying the costs of
development review functions is through a system of fees
directly associated with actual and/or historical staff,
advertising, legal and engineering expenses; and,
WHEREAS. the administrative prodedures set forth below
are an accurate method of assessing the costs of development
review functions.
NOW THEREFORE. BE IT ENACTED BY THE PEOPLE OF THE CITY
OF OCOEE. FLORIDA

The following Administrative Procedures shall be
utillzed when collecting and processing all development
review fees and deposits paid to the City of Ocoee:
A. ~~~~__~~~~ - A flat fee shall be collected from the
petitioner by the City Clerk at the time of filing each
petltion for a rezoning, special exception, variance, or
comprehensive plan amendment. No petition shall be accepted
until the fee is paid in full.

B. B~y!~~_Q~eQ~!~~ - A Review Deposit shall be
collected from the developer by the City Clerk at the time of
submission of each proposed subdivision, planned unit
development, or commercial site plan. No review of any plan
shall commence until the Review Deposit is paid. Said Review
Deposit shall be held in reserve by the City Finance Director
and returned to the developer upon completion of his entire
proJect, unless it must be utilized as reimbursement for non-
payment of any City development review invoices.
C. f~Q~~g~_~ggQYn~ - Once a proposed subdivision,
planned unit development, or commercial site plan has been
submitted and the Review Deposit has been collected, the City
Finance Director shall establish an individual ProJect
Account through which all fees and deposits will be
monitored. The ProJect Account will be maintained throughout
the entire review process until final action by the City
Board of Commissioners or until no further involvement of the

Clty staff lS required to process a proJect, whichever is the
later occurrence. City staff time expended and directly
related expenses, including advertising, legal and
engineering costs will be charged to the account.

D. g!~Y_InY2!g!! - Upon the timely receipt of all
current charges levied against a proJect, the City Finance
Director shall send a corresponding City invoice to the
developer for payment. The developer shall have ten (10)
days from the date of the City invoice to reimburse the City
for any current charges posted against his proJect. If
payment is not received within the required time, the City
Finance Director shall send notice of non-payment to the
developer and to all City staff associated with the project
informing them that all review activities shall cease until
further notified. Should payment not be received by the City
within thirty (30) days of the original invoice, the City
Finance Director may apply the Review Deposit funds held in
reserve to retire any outstanding amounts due. Should fees
owed exceed the Review Deposit amount, the City Finance
Director shall take whatever legal means are available to
collect the deficiency. Work will not be reactivated on any
project where the Review Deposit was once accessed until a
new Review Deposit is established for the project in an
amount twice the original deposit.
E. g!~Y_~~~ii_!!m!_~gg2Yn~!ng - City Staff members, both
in-house and consultants, involved in the review and
processing of proposed Planned Unit Developments,
subdivisions, and commercial site plans shall maintain bi-
weekly records of their time expended upon specific proJects.
Said records will be submitted to the City Finance Director
on standardized forms designed by him for processing. In-
house staff hourly rates including overhead will be
determined by the City of Ocoee's Wage and Salary Plan and
consultants' time will be billed to the petitioner at the
same rate charged to the City.
Section 2.

Upon submittal of any petition or plan, the City Clerk
shall ensure that the required Flat Fee or Review Deposit is
posted to an appropriate Project Account in coordination with
the City Finance Director. The City Clerk will also forward
all petitions and plans, with proof of payment of all
required fees and deposits, to the City Planning Director for
further processing.
The City Clerk shall collect the following Flat Fees for
petitions made to the City of Ocoee Board of Commissioners:
Petition for Rezoning to all Classifications
including PUD
$ 250.00
Petition for Special Exception or Variance
$ 250.00

The City Clerk shall collect the
Review Deposits for all plans submitted
approval within the City of Ocoee:

Should the City Manager o~ his designee determine that
tile anticipated review deposit ~or a proJect is inadequate to
cover the reasonably anticipated cost of review he shall
direct the City Clerk to adJust the minimum deposit
accordingly.
Section 3.

If any portion of this Ordinance is determined to
void, or otherwise Unconstitutional, the remainder of
Ordinance shall retain its ef~ectiveness.
