III and Cathy A. Nagel 703 Wurst Road. Background Summary: On September 4, 2001, Officer Bob Siegrist observed violations of city code on the property located at 703 Wurst Road, Ocoee, Florida. The violations observed were failure to obtain a permit to install a fence and enclose a garage (scope of work was exterior walls, interior walls, electrical, mechanical). The occupant was given a Notice of Violation to be in compliance by September 14, 2001. Property was reinspected and found to be in Non-Compliance and was presented before the Code Enforcement Board (CEB) meeting on October 23, 2001. The CEB gave the occupant until November 27, 2001 to come into compliance or receive an order of fine and lien of $250.00 per day. The property was reinspected on November 28, 2001 found to be in Non- Compliance. A Affidavit of Compliance was completed on May 7,2009. On May 8,2009 a request for a re- hearing for a reduction was filed. A hearing before the CEB on May 26, 2009 was heard for a reduction of fine in the amount of $594,000.00. Staff recommended a reduction in fine to the amount of $2,500.00. The CEB is recommending the fine be reduced to $500.00. Issue: Should the Honorable Mayor and City Commission consider the property owner's request for a reduction of fines and release of lien on Code Enforcement Board Case No. 01-048 established on September 4, 2001, at 703 Wurst Road? Recommendations The Code Enforcement Board recommended the property owner's request for a reduction of fines to $500.00 if paid within 2 weeks of commission approval. Staff recommended fine be reduced to $2,500.00. Attachments: Request for Re-Hearing/Reduction of Fine Form, and City Code Enforcement Board Case #01-048 Case History. Financial Impact: A reduction in fines as requested by the Respondent, if paid, would compensate the city for time and processing expenses associated with this case.
