HomeMy WebLinkAboutItem #03 Changes to the Ocoee Land Development Code Meeting Date: August 4, 2009 "- Item # .3 Contact Name: Contact Number: ?171< Michael Rumer 407-905-3100, Ext. 1018 Reviewed By: Department Director: City Manager: ~ Subject: Changes to City of Ocoee Land Development Code (LDC) Addition to Definitions in Article II, Subsection 2-4 Change in Article V, Subsection 5-7 Public Buildings and Services Change in Article V, Table 5-1 Permitted Use Regulations Background Summary: The City's Land Development Code (LDC) does not specifically define or list transfer stations in the permitted use regulations, as most Industrial uses are grouped into either the 1-1 (Restricted Manufacturing and Warehousing) or the 1-2 (General Industrial) zoning classifications. In order to more adequately site transfer stations, staff is proposing to amend the City's LDC regulations for transfer stations. The City Attorney has drafted an ordinance proposing amendments to the Land Development Code to specifically establish a zoning district to regulate transfer stations. The attached ordinance details the following: Subsection 2-4 of Article II The following definition will be inserted into the LDC: (259.1) Transfer Station: shall mean a site, the primary purpose of which is to transfer waste from one (1) vehicle to another immediately for transport to a processing or disposal facility. It does not include green boxes, compactor units, permanent dumpsters and other containers from which such wastes are transported to a landfill or other solid waste management facility. Storage of waste in vehicles on site shall be prohibited. Table 5-1 Inserts Transfer stations under the Industrial Uses regulations. Transfer Stations will be prohibited in the 1-1 (Restricted Manufacturing & Warehousing) and will be permitted as a Special Exception in the 1-2 (General Industrial). Subsection 5-7 of Article V Amended by adding a new Subsection 0 which states: Notwithstanding the foregoing, the provisions of this Subsection 5-7 do not apply to the location of Transfer Stations. Issue: Should the Honorable Mayor and City Commissioners approve Ordinance 2009-021 providing amendments to the Land Development Code (LDC) relative to Subsection 2-4 of Article II of Chapter 180 of the Code of Ordinances regarding Language and Definitions; Subsection 5-7 regarding Public Buildings and Services and to Table 5-1 of Article V of Chapter 180 regarding permitted use regulations? Planning & Zoning Commission Recommendation: The Planning & Zoning Commission met on July 14, 2009 to consider the amendments to the Land Development Code (LDC) relative to Subsection 2-4 of Article II of Chapter 180 of the Code of Ordinances regarding Language and Definitions; Subsection 5-7 regarding Public Buildings and Services and to Table 5-1 of Article V of Chapter 180 regarding permitted use regulations. After a brief discussion explaining the City's role in permitting transfer stations, the Planning and Zoning Commission voted unanimously to recommend approval of the proposed amendments to the Land Development Code. Recommendations: Staff respectfully recommends that the Mayor and City Commissioners approve Ordinance 2009-021 providing the amendments to the Land Development Code. Reviewed by 0 N/A N/A N/A 2 ORDINANCE NO. 2009-021 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA AMENDING CERTAIN PROVISIONS OF THE OCOEE LAND DEVELOPMENT CODE; AMENDING SECTION 2-4 OF ARTICLE II OF CHAPTER 180 OF THE CODE OF ORDINANCES OF THE CITY OF OCOEE REGARDING DEFINITION OF TERMS BY ADDING A DEFINITION OF TRANSFER STATION; AMENDING SECTION 5-7 OF ARTICLE V OF CHAPTER 180 REGARDING PUBLIC BUILDINGS AND SERVICES IN ORDER TO EXCLUDE TRANSFER STATIONS; AMENDING TABLE 5-1 OF ARTICLE V OF CHAPTER 180 TO PROVIDE PERMITTED USE REGULA TIONS APPLICABLE TO TRANSFER ST A TIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: SECTION 1. Authority. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 163 and 166, Florida Statutes. SECTION 2. Section 2-4(C) of Article II of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended by adding a new Subsection 259.1 to read as follows: (259.1) Transfer Station: A site, the primary purpose of which is to transfer waste from one vehicle to another for immediate transport to a processing or disposal facility. A Transfer Station shall not include green boxes, compactor units, permanent dumpsters or other containers for the storage of waste. Storage of waste at a refuse transfer station, including in vehicles left at the site, is prohibited. ORLA_1351936.2 SECTION 3. Section 5-7 of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended by adding a new Subsection D to read as follows: D. Exceptions. Notwithstanding the foregoing, the provisions of this Subsection 5- 7 do not apply to the location of Transfer Stations. SECTION 4. Table 5-1 entitled "Use Regulations" of Article V of Chapter 180 of the Code of Ordinances of the City of Ocoee, Florida, is hereby amended to read as set forth on Exhibit "A" attached hereto and incorporated herein by this reference, which amends Table 5-1 so as to add "Transfer Station" as a Special Exception in Zoning District 1-2 and as a prohibited use in all other zoning districts. SECTION 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. SECTION 6. Codification. It is the intention of the City Commission of the City that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City; and that sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "chapter," "section," "article," or such other appropriate word or phrase in order to accomplish such intentions; and regardless of whether such inclusion in the Code is accomplished, sections of this Ordinance may be renumbered or relettered and the correction of typographical errors which do not affect the intent may be authorized by the City ORLA_1351936.2 -2- Manager, without need of public hearing, by filing a corrected or recodified copy of same with the City Clerk.
