The project proposes 108 one and two bedroom units in an urban garden apartment layout. The target market for the proposed project is low to moderate income senior citizens. The applicant has indicated that only 10% of the units developed would be designated as low income, which staff supports. The applicant needs an approval by the City in order to complete their funding application with the Department of Housing and Urban Development (HUD). This conceptual site plan approval, subject to the conditions attached hereto, provides a level of approval that would permit the City to sign the attached application forms. Based on initial market research and cost estimates, the new construction one (1) bedroom unit sizes will be approximately 755 square feet and the new construction two (2) bedroom unit sizes will be approximately 900 square feet. Fifty-four (54) new tax credit units will include one (1) bedroom and one (1) bath. Fifty-four (54) of the new tax credit units will include two (2) bedrooms and one (1) bath. All of the multifamily units will be designed to be harmonious with the architectural style as proposed for the Downtown Ocoee town center development. Financing for the multifamily units will include a combination of proceeds from: (i) the sale of Housing Tax Credits; (ii) long term permanent debt; (iii) a financing contribution from Orange County; and (iv) FHFC TCEP monies. The Downtown Ocoee at Lake Bennett PUD has been officially submitted to the City and is currently under review. This project provides the umbrella underneath which projects such as the Bennett Senior Village will be officially submitted as part of the City's site plan review process. The conditions of approval for this conceptual site plan reflect a commitment on the applicant's part to adhere to the City's traditional development review process, which includes approval of the Downtown Ocoee at Lake Bennett PUD. The City of Ocoee has few remaining large scale economic and development-related impact areas. Of these, the property along Lake Bennett remains one of the most important. The City has been working with the collective land owners for years in coming up with an appropriate plan that addresses community needs and represents a true economically viable development opportunity. Several important factors work synergistically in examining these properties, including design format, transportation benefits, mixture of uses, and demographic impacts. The application for the conceptual site plan approval meets the City's desired urban format development goal for the property, as well as maintains the desired multi-modal connectivity. Additionally, the applicant has provided a detailed representation of the appearance of the proposed Bennett Senior Village, and the illustration exceeds the City's expectations. The project will integrate affordable senior housing (one of the City's largest areas of need) into a quality mixed use development. Studies have shown that integration of a range of housing types and costs into such projects provides the maximum likelihood that they will be successful in the long term, and the City is committed to ensuring that the Downtown Ocoee at Lake Bennett will do the same within its standard review process. Issue: Should the honorable Mayor and City Commission approve the Bennett Senior Village Conceptual Site Plan? Recommendations Staff recommends approval of the proposed Conceptual Site Plan by the honorable Mayor and City Commissioners subject to the conditions of approval and proposed rendering. The City hereby approves the Conceptual Site Plan for Downtown Ocoee on Lake Bennett as prepared by under Job No. (the "Conceptual Plan"). 2. The Conceptual Plan shall comply with, adhere to, and not deviate from or otherwise conflict with any verbal or written promise or representation made by the Ownerl ApplicantlDeveloper (or authorized agent thereof) (collectively, the "Developer") to the City Commission at any meeting where this Conceptual Plan was considered for approval, where such promise or representation, whether oral or written, was relied upon by the City Commission in approving the Conceptual Plan, could have reasonably been expected to have been relied upon by the City Commission in approving the Conceptual Plan, or could have reasonably induced or otherwise influenced the City Commission to approve the Conceptual Plan. For purposes of this Condition of Approval, a "promise" or "representation" shall be deemed to have been made to the City Commission by the Developer if it was expressly made to the City Commission at a meeting where the Conceptual Plan was considered for approval. 3. The City of Ocoee is subject to the terms, provisions and restrictions of Florida Statutes Chapter 163 concerning moratoria on the issuance of building permits under certain circumstances. The City has no lawful authority to exempt any private entity, or itself, from the application of such state legislation and nothing herein should be construed as such an exemption. 4. Nothing contained herein shall be construed to obligate the City to undertake any on site or off-site roadway, infrastructure and utility improvements which may be needed to support the development of the Property. Prior to or contemporaneous with the approval of the PUD Land Use Plan, the Developer shall be required to enter into an agreement with the City which addresses onsite and off-site roadway, infrastructure or utility improvements which may be needed to support the development of the Property. The party responsible for funding such improvements and the timing of the construction thereof. 5. The Developer will be required to submit an application for approval of a PUD Land Use Plan for the Property included with the Conceptual Plan (the "PUD Land Use Plan") within 90 days from the date of approval of the Conceptual Plan. The approval of the Conceptual Plan will expire if such PUD Land Use Plan application is not submitted; provided, however, that the City Commission may grant one 90-day extension of this deadline. At such time as the PUD Land Use Plan is approved, this Conceptual Plan shall be of no further force and effect and shall be deemed to have been merged into the PUD Land Use Plan. ORLA_1396343.1 6. The Developer will maintain an active application for approval ofthe PUD Land Use Plan and proceed in good faith to seek approval of such plan. 7. This Conceptual Plan does not approve or authorize any site work, construction or other development activities on the Property. No such activities shall occur on the Property until a preliminary and final subdivision and site planes) is approved by the City and such plans are in compliance with the requirements of the Ocoee Land Development Code, including but not limited to, if applicable, (i) those regulations related to activity centers, and (ii) those regulations related to the special development plan applicable to the activity center. 8. This Conceptual Plan approval is subject to any overlay plans or special development plans which may hereafter be adopted by the City. In the event of any conflict between this Conceptual Plan and any such overlay plans or special development plans, the overlay plans or special development plans shall control. 9. The approval of the proposed uses and the bubble plan layout shown on the Conceptual Plan is conceptual only. The City will have the right to approve or disapprove the proposed uses in connection with its review of application of the PUD Land Use Plan. 10. In connection with its review of the PUD Land Use Plan, the City may require such additional conditions of approval as it deems appropriate. 11. The approval of the Conceptual Plan will be good for one year. In the event a PUD Land Use Plan has not been approved within one year from the date of approval of the Conceptual Plan, then the City Commission approval of the Conceptual Plan will automatically terminate, unless extended by the Ocoee City Commission. 12. Nothing contained in the Conceptual Plan shall be construed as a guarantee by the City that the PUD Land Use Plan will be approved by the City as submitted by the Developer, it being recognized that any the PUD Land Use Plan must meet being reviewed by the Ocoee Planning and Zoning Commission at an advertised public hearing and must be approved by the Ocoee City Commission at an advertised public hearing, and it being further recognized that the Conceptual Plan does not reflect the level detail required for the review and approval of the land use plans by the City. 13. This project shall be developed in multiple phases which will be identified in the PUD Land Use Plan. 14. Each phase of the project will stand on its own with respect to public services (sewer, water, stormwater management, access and other related services). 15. A site plan shall be required in connection with the development of each block or lot with the property as shown on an approved final subdivision plan. 16. The Developer shall be responsible for installing reuse lines along with the other subdivision infrastructure. At such time as reuse water is available to the property. 2 ORLA_1396343.1 17. All on-site utilities including electrical, cable TV and telephone shall be placed underground. 18. Any damage caused to any public roads as a result of the construction activities related to the project or any portion thereof shall be promptly repaired to the applicable government standards at the sole cost and expense of the owner of the portion of the project being developed in connection with such construction activities. 19. All existing structures (including buildings, power lines, eXlstmg aerial and utility facilities) and Progress Energy easements will be removed and/or terminated prior to or during construction of the development replacing those uses. 20. The development of this project will incorporate the stormwater needs of all public roads within the project. 21. The Property is subject to that certain City of Ocoee/Colburn Development Agreement dated November 17, 1998 as recorded in Official Records Book 5623, Page 2313, Public Records of Orange County, Florida. Said Development Agreement is inconsistent with the Conceptual Plan. Prior to or contemporaneous with the approval of the PUD Land Use Plan, the Developer shall be required to obtain an amendment to said Development Agreement so that it will be consistent with the PUD Land Use Plan. 22. All roads will be dedicated to the public unless otherwise noted. 23. All legal instruments related to the project, including but not limited to, restnctlve covenants, deeds, and conservation, utility or other easements, shall be provided to the City for review and approval prior to any approval of a Final Subdivision Plan for the Property or any portion thereof. 24. Nothing herein shall be construed to waive any provIsion of the Ocoee Land Development Code. 25. A portion of the property has vested rights pursuant to City of Ocoee Certificate of Vesting Nos. 98-01 and 99-01. Except as set forth in said Certificates of Vesting the property shall be subject to all applicable concurrency laws and the approval of the Conceptual Plan shall not be construed to grant any vested rights or to create any concurrency exemption. 26. One hundred eight (108) new affordable elderly units will be constructed under the Housing Tax Credit Program as administered by the Florida Housing Finance Corporation. Based on initial market research and cost estimates, the new construction one (1) bedroom unit sizes will be approximately 755 square feet and the new construction two (2) bedroom unit sizes will be approximately 900 square feet. Fifty-four (54) new tax credit units will include one (1) bedroom and one (1) bath. Fifty-four (54) of the new tax credit units will include two (2) bedrooms and one (1) bath.
