CODE ENFORCEMENT BOARD MEETING
JUNE 23, 2009
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation
and Member Lowery led the Pledge of Allegiance to the Flag. The roll was called and a
quorum was declared present.
PRESENT: Chairman Godek, Members Alexander, Elliott, Lowery, Morton, Sais, and
Alternate Member Hopper. Also present were Code Enforcement Officer
Loeffler, Code Enforcement Officer Delgado, Code Enforcement Officer
Rodriguez, Code Enforcement Officer Siegrist, Division Chief Stanley, Fire
Inspector Sorenson, Administrative Assistant Ballard, Attorney Sneed, and
Deputy City Clerk Sibbitt.
ABSENT: Vice Chair M. Godek was absent excused.
GUESTS: None.
Administrative Assistant Ballard administered the oath to Code Enforcement Officer
Loeffler, Code Enforcement Officer Delgado, Code Enforcement Officer Rodriguez, Code
Enforcement Officer Siegrist, Division Chief Stanley, Fire Inspector Sorenson and anyone
intending to speak regarding a case.
CONSENT AGENDA
ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED ROUTINE BY THE CODE ENFORCEMENT BOARD AND WILL BE
ACTED UPON BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS UNLESS DISCUSSION IS DESIRED BY A
MEMBER OF THE BOARD, IN WHICH CASE THE CHAIRMAN WILL INSTRUCT THE BOARD CLERK TO REMOVE THE ITEM FROM THE

Swimming pool dirty and green.
Officer Delgado gave a brief history of the case and stated this is a recorded lien with a total
fine amount of $119,600. She further stated that she went to look at the property yesterday,
and the swimming pool has been brought to compliance. It is clean and no longer green.
Mickey Hage, real estate broker for the property, stated the property is a foreclosure home,
and they took the property over at the end oflast year. They have a sale at this present time
and were just made aware during the title search that there is a lien on the property. They
have been maintaining the pool ever since they received the property by boarding it up so that
no one could fall in. In the past month and a half when they did the title search for sale of the
proper.ty, they realized there was a lien the whole time that they owned the property. They
have been maintaining the pool and grass and feel they have inherited the lien from the prior
owners. What they are asking since they have a great family ready to move in, is for
reduction because the bank cannot pay that kind of money, and the sale price is not much
more then the lien amount. Chairman Godek inquired as to how long they had the property
before they starting cleaning it up. Mr. Hage stated with foreclosed homes with pools one of
the first things they do is secure the pool so no one will fall in, and the yard is immediately
maintained. For this property, in order to have been in compliance with the lender, the pool
had to be up and running, which it has been for about 2-3 weeks. Alternate Member
Hopper inquired if this lien amount included both cases, Officer Delgado stated this was just
for the pool.

make a recommendation to the Citv Commission to reduce fine to $500.00.
Officer Delgado briefly added that they have calculated staff time to be $812.44. This total is
for both cases for this address.

May 7, 2009, and he made his first visit to the home last week. He stated there was a card
from Officer Loeffler on the garage door so he called him. The home was already in
compliance when he called Mr. Loeffler. Member Elliott inquired as to what the city costs
were. Officer Rodriguez stated it was $452.12

Gregory Keith Harris, 209 15th Ave., stated he has put shingle roof on but they had a money
issue with the flat roof. He went out of town due to work but is back to continue finishing the
roof; material for the flat roof is in his truck. Mr. Harris stated he is just asking for an
extension. He stated he could be done with roof in 3-4 days but with the rainy weather he

Observation: Overgrown grass/weeds. Swimming pool dirty and green. Miscellaneous junk and debris on
property. Deterioration of existing fence.
Officer Delgado stated she went out to the property yesterday, and the pool was filled up to
the top so the city sent Public Works out to empty and barricade the pool. Grass is still not in
compliance, and they have the cost of abatement for emptying the pool to add to the fine. The
cost for abatement was $577.00.

to impose fine for violations remaining in non-compliance as of June 20, 2009, and add
$577. 00 for the cost of abatement to the fine. Motion carried unanimouslv.

COMMENTS
Officer Rodriguez announced next week she will be on vacation with her son who will be
returning home from Africa. He is a Marine and will be deployed to Iraq and then
Afghanistan.
Memtier Alexander wished for everyone to have a safe and happy 4th of July.
Member Lowery thanked the Fire Department and code enforcement officers for a job well
done, He also thanked the citizens for their compliance.
Member Morton announced he will be missing a couple of meetings due to his trip back to
Germany.

For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father-in-law,
mother-in-law, son-in-law, and daughter-in-law. A "business associate" means any person or entity engaged in or carrying on a business
