Request for a one (1) year time Extension of the Approved Final Subdivision Plan

BackQround Summary:
Oak Trail Reserve PUD is located on the northeast quadrant of the intersection of Clarke Road and Clarcona-
Ocoee Road. The subject property is approximately 38.6 acres in size of which 3.1 acres are designated as
conservation/wetlands. The subject property is currently undeveloped and is partially covered with trees mostly
on the south side of an isolated wetland and along the eastern boundary of the property. The remainder is
open field.
On September 2, 2008, the Honorable Mayor and City Commissioners approved a Final Subdivision Plan for
Oak Trail Reserve PUD. The Final Subdivision Plan allows for a 61 single-family residential lot subdivision. On
September 4, 2009, the Development Services Department received a letter from the developer/owner of the
property requesting for a one (1) year time extension of the Final Subdivision Plan approval.
Per Article IV, Section 4-4, G, (3) of the land Development Code, approval of the Final Subdivision Plan shall
be automatically voided if construction has not commenced within one (1) year. This Section of the land
Development Code allows the City Commission to grant a one (1) year time extension of the plan approval
upon written request of the developer, provided the plans still comply with current land Development Code
regulations. No major updates to the land Development Code have been undertaken since the approval of the
plans; therefore, it is staff's opinion that the plans still comply with the current Land Development Code
regulations.
Issue:
Should the Honorable Mayor and City Commissioners approve a one (1) year time Extension of the Approved
Final Subdivision Plan for Oak Trail Reserve PUD?
Staff Recommendation:
Staff recommends that the Honorable Mayor and City Commissioners grant a one (1) year time extension
consistent with Article IV, Section 4-4, G, (3) of the land Development Code for the Approved Final
Subdivision Plan for Oak Trail Reserve PUD.
