Chairman Minarcin called the City of Ocoee Police Infraction Hearing Board meeting to order at 7:03 p.m. in the Commission Chambers of City Hall with the pledge of allegiance. The roll was called and a quorum declared. MEMBERS PRESENT: Chairman Minarcin, Members Arney, Chinelly, Garland, and Stein ABSENT: Members Laney and Torres (unexcused) Member Garland made a motion to aTJ/Jrove the minutes from the Februarv hearinz. seconded bv Member Amev and the motion carries unanimously. II. PRESENT A TION OF CASES - Chairman Minarcin asked the clerk to call the case. Case #1 - 2009003408 Chairman Minarcin swears in the officer and the defendant. Ofc Roberts states her case saying she marked the wrong box on the ticket, that it was not a $250 handicap parking ticket as marked but a $40 parking over the sidewalk. Pictures are shown to prove this. Chairman Minarcin asked if she wants to amend the citation to which she said she would. However. Member Garland makes a motion to decline the citation due to the error. seconded bv Member Amev. Discussion begins with Chairman Minarcin saying that he disagrees. Discussion follows. The defendant was asked if he was made aware of the mistake. Clerk Decker said she called him on behalf of Sgt Wagner telling him there was an error on the citation and he chose to contest it anyway due to the officer making an error. It is discussed that this is now a case for parking on the sidewalk. The officer presents her case again with the photos. Defendant Doodnath Ragnonth speaks and says he doesn't feel he should pay the citation and that it should be voided because of the error. Defendant is asked if he is aware of the ordinance about parking on the sidewalk, blocking pedestrians. He said he was not aware of that and that he has lived here for five years and has always parked in his driveway the way the photo shows. Member Garland makes a motion to find the defendant guilty of blockinz the sidewalk. seconded bv Member Chinellv. Motion carries. Member Amev makes a motion to zive him a warninz instead of the $40 fee. seconded bv Member Garland. Motion carries unanimous Iv. The Defendant and the Officer is dismissed. III. OTHER BUSINESS OR COMMENTS Sgt Wagner and the board discuss the City Ordinances and FL State Statutes. IV.
