THE CITY OF OCOEE POLICE PARKING INFRACTION
HEARING BOARD MEETING JUNE 18,2009
I. Chairman Minarcin called the City of Ocoee Police Infraction Hearing Board meeting to
order at 7:01 p.m. in the Commission Chambers of City Hall with the pledge of allegiance. The
roll was called and a quorum declared.
MEMBERS PRESENT: Chairman Minarcin, Members Arney, Chinelly, and Garland. Also
present are Sgt Wagner, Ofc Koch, the defendant and Recording Clerk Decker.
ABSENT: Members Laney and Stein (excused) and Member Torres (unexcused)
II. PRESENTATION OF CASES - Chairman Minarcin asked the clerk to call the case.
Case #1 - 2009012862
Chairman Minarcin explains the procedure to the defendant and then swears in the officer and
the defendant. Ofc Koch states his case beginning with dismissing one part of the citation for
parking too close to a fire hydrant. He stated that he should have issued two separate citations
instead on one citation with two violations marked. Pictures are shown to prove the second part
of the citation of parking opposed to traffic.
The defendant, Michael Cote, states he was not aware of this rule so did not know he was
committing a violation. The comment was made that it is common that young adults are not
aware of all of these parking citations when getting their drivers license.
A motion is made bv Member Garland and seconded bv Member Amev that the defendant is
fluilty of the violation of parkinfl opposed to traffic. Motion passes unanimouslv.
A motion was then made bv Member Garland and seconded bv Member Amev for a court cost of
$40.00 be added. along with the citation fine of $40. 00. for a total of $80. 00. Motion passes
unanimous Iv.
Defendant is given 30 days to pay since he was willing to come in and pay it the next day.
III. OTHER BUSINESS OR COMMENTS
Sgt Wagner mentioned there are changes that the board needs to review in the Resolution and
By-laws. Clerk said she would email them out for their review before the next meeting.
Member Amev made a motion to approve the minutes from the Mav hearing. seconded bv
Member Garland and the motion carries unanimouslv.
IV. ADJOURNMENT
Meeting adjourned at 7:23 p.m.
