Background Summary:
Per Florida State Statutes 932.7055 "...any local law enforcement agency that acquires at least $15,000.00
pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than fifteen
(15) percent of such proceeds for the support or operation of any drug treatment, drug abuse education, drug
prevention, crime prevention, safe neighborhood, or school resource officer program(s).
Issue:
Should the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend
and/or grant $21,000.00 from its Forfeiture fund to law enforcement related uses/ charities?
Recommendations
It is recommended that the Honorable Mayor and Board of City Commissioners authorize the Police Department
to expend and/ or grant $21,000.00 from its Forfeiture fund to law enforcement related uses/ charities.

Financial Impact:
A total of $21,000.00 from the Police Forfeiture fund. During Fiscal Year 08/09, the Police Department
acquired approximately $8,527.00. There is approximately $185,785.00 in this fund.

ISSUE
Should the Honorable Mayor and Board of City Commissioners authorize the Police Department to expend and/or grant
$21,000.00 from its Forfeiture fund to law enforcement related uses/ charities?
BACKGROUNDIDISCUSSION
Per Florida State Statutes 932.7055 "...any local law enforcement agency that acquires at least $15,000.00 pursuant to the
Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than fifteen (15) percent of such
proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe
neighborhood, or school resource officer program(s). The local law enforcement agency has the discretion to detennine
which program(s) will receive the designated proceeds." During Fiscal Year 08/09, the Ocoee Police Department acquired
approximately $8,527.00. Although the police department did not bring in $15,000.00 during the fiscal year, the
department has made a practice of using these proceeds to help support programs and organizations that partner with the
police department in its crime prevention/ public safety mission and wishes to continue to do so. The department is
requesting to expend/grant a total of $21 ,000.00. There is approximately $185,785.00 in the Police Forfeiture fund.
The Ocoee Police Department would like $2,500.00 to sponsor its Citizen Police Academies throughout the year;
$1,500.00 to purchase bicycle helmets to be distributed by the department's Crime Prevention and School Resource
Officer unit to children in need; to transfer $3,000.00 to the City of Ocoee Spring Fling event; and to transfer $2,500.00 to
the Ocoee Police Explorers. Because of the services they provide to the Department and the community and because
duplication of some of these programs by the Ocoee Police Department is not possible, the Ocoee Police Department
recommends grants to the following non-profit organizations: $1,500.00 to Central Florida Police Athletic League, a non-
profit organization working with law enforcement that helps keep youth crime and drug free; $1,500.00 to Mothers Against
Drunk Driving (MAD D) which assists law enforcement with DUI enforcement events and educates the public on the
dangers of driving under the influence; $1,500.00 to A Child Is Missing, a public/private partnership, devoted to assisting
law enforcement in search and recovery efforts of missing children, elderly, and disabled persons and notifYing the public
about sexual predators; $1,500.00 to Spouse Abuse Inc. Harbor House, the domestic violence shelter and assistance center
for Orange County; $1,500.00 to the Orange County Sexual Assault Treatment Center; $1,500.00 to the Orange County
Victim Services Center; and $2,500.00 to Lakeside Behavioral Healthcare (aka Central Florida Crisis Intervention Team),
the facility that trains police officers how to deal with people in crisis.
