Background Summary:
The City of Ocoee applied for and was awarded a $200,000 matching grant under the Florida Recreation
Development Assistance Program (FRDAP) to complete a number of improvements at the City's Prairie Lake
Park. Among the portions of the proposed project funded by the FRDAP grant is a boat dock extending into
Lake Hackney. The construction of the proposed boat dock is similar to an observation pier recently completed
on Lake Moxie in the City's Central Park. The plan is to construct an eight-foot-wide boat dock extending 70
feet from the wetlands buffer line with a 12 ft. by 12 ft. terminal platform and a16 ft. by 8 ft. floating platform with
aluminum ramp. The floating dock, which would be placed longitudinally across the end of the higher structure,
would provide a means for boating users to access their vehicles from the structure. (They presently have to
wade to the boat after launching.)
Staff developed a scope of work, plans, and technical specifications for the work and solicited price proposals
from the firm that did the work at Lake Moxie (Doherty Brothers Marine Construction, Inc., as a subcontractor to
C&L Landscaping) and the firm that was awarded the work of making other improvements at Prairie Lake Park
(The Watauga Co.). Doherty Brothers Marine Construction provided the low bid. The Watauga Company bid
was significantly higher.
Issue:
Should the City of Ocoee execute the proposed Project Agreement with Doherty Brothers Marine Construction,
Inc., to construct a boat dock at Prairie Lake Park?
Recommendations
The City's Engineering Department recommends that the City Commission authorize the Mayor and City Clerk
to execute the Project Agreement as the most efficient and cost-effective way for the City to construct and/or
improve boating facilities at Lake Hackney in Prairie Lake Park. The specific improvements to authorize are:
1. Construction of a 70' x 8' dock with a 12' x 12' terminal platform @ $26,572.00
2. Construct and install a 16' x 8' floating dock with a 4' x 16' hinged aluminum ramp at the end of the new
Prairie Lake Park boat dock (Item 1, above) @ $7,296.00
Total cost of the work at Prairie Lake Park is $33,868.00.

Financial Impact:
The $33,868.00 cost of the improvements at Prairie Lake Park are included in the approved budget for

REQUEST FOR PROPOSALS (RFP)
PRAIRIE LAKE PARK BOAT DOCK
SCOPE OF WORK
The City of Ocoee seeks a qualified contractor to construct an elevated pressure-treated lumber
boat dock on Lake Hackney in Prairie Lake Park, which is located on Hackney Prairie Road in
the northeast part of the city. The dock consists of a series of standard 8 ft. wide by 10 ft. long
rectangular segments arranged end to end and extending 70 feet into the lake from the
demarcated 25-foot wetlands buffer line of the lake's north shore. At the end of this structure
will be a 12 ft. x 12 ft. terminal platform of similar construction.
Because the fixed structure is likely to be two to three feet above the level of the water for much
ofthe year, the City also seeks proposals for the option of including a floating platform that
would be accessed from the fixed structure through a gangway. The floating platform would
provide more effective access to the water for boarding and leaving the small watercraft likely to
use the facility. (Lake Hackney is restricted to non-motorized boats.) An Add-alternate Proposal
is solicited for an 8 ft. x 16 ft. floating platform with a hinged 4 ft. wide by 16 ft. long
commercial-grade aluminum ramp with handrails on both sides and 8 in. diameter wheels at the
floating platform end.
A large format drawing provides the design guidance required to prepare the Base Proposal. A
separate detailed drawing attached to this Scope of Work shows the modifications required to the
primary structure and the general arrangement and requirements of the floating platform and
gangway. These components and related work comprise the solicitation for an Add-alternate
Proposal. The conceptual plans include the location of the boat dock and other improvements
relative to the waterline. Future connections and adjacent improvements, such as a sidewalk and
a boat ramp, are indicated in the boat dock area; these improvements are outside the scope of this
solicitation.
It will be necessary for the selected contractor to secure final design for permitting purposes
from a professional engineer licensed in the State of Florida and qualified to review and modify
the conceptual plans so they can be used for construction. A signed and sealed set of drawings
should be provided to the City Engineer for review. Once approved by the City Engineer, two
copies ofthe approved design plans are to be furnished to the City's Building Department as part
of the contractor's building permit application. The permit itself will be provided without charge
to the contractor, but all normal approval and inspection requirements apply. No permit will be
required from the Florida Department of Environmental Protection or Orange County.
All lumber is to be pressure-treated #2 or better Southern Yellow Pine; #1 SYP is recommended
for decking and guardrail. Decking, ramp, and guardrail lumber is to be rated for Use Category
UC4A; e.g., 0.25 ACQ. Bent piles and braces from dimensional lumber are to be rated for Use
Category UC4C; e.g., 0.40 ACQ. Marine grade bent piles are required. Design parameters are:

All flathead wood screws used are to be #8x3" square drive with an ACQ-rated finish (or other
finish appropriate to the wood preservative used); stainless steel screws are a preferred
alternative. All bolts, washers, and nuts to be hot-dipped galvanized or stainless steel. All
flashing is to be formed from stainless steel.
Simpson StrongTieā¢ components typically used in such construction are (all ratings given for
SYP lumber):
. CBQ66-SDS2 for pile anchor to footer; 4,200 lb. uplift load rating.
. H8 hurricane strap for attaching joist to beam; 745 lb. uplift load rating.
. HDAHDG for attaching guardrail post to rim joist and other applications; 655 lb. lateral
force rating in horizontal use.
. LSU26 for attaching ramp joist to boardwalk rim joist; rated at 765 lb. for floor usage.
. MST A24 for connecting in-line joists to each other around an angle; 1,640 lb. tension
load rating.
All Simpson metal reinforcements are to use ZMAX corrosion protection.
Respondents should note that the submitted conceptual design fails to comply with the current
requirements for handrail post attachment, as defined in the existing Florida Building Code. This
new design uses a large number of metal reinforcement fasteners to preclude separation of the
handrail post from the rim joist and overturning of the rim joist through failure of the attachment
of solid blocking to the rim joist. Guidance on how to comply with these new requirements is
provided in such references as Designfor Code Acceptance 6: Prescriptive Residential Deck
Construction Guide (Based on the 2006 International Residential Code), American Forest &
Paper Association, December 2007, which can be downloaded free at
http://www.awc.org/Publications/DCAlDCA6/DCA6-09.odf. Compliance requires the use of the
above-listed Simpson StrongTieā¢ HDAHDG product or similar.
Design specifications for the floating platform and aluminum gangway are less prescribed than
those for the fixed wooden structure in order to allow respondents greater flexibility in design
and materials. The floating platform may be constructed from multiple segments, such as the
four 4 ft. x 8 ft. segments shown on the drawings, and anchored in place by wood piles that allow
vertical but not horizontal movement. The aluminum gangway shall be 4 feet wide and at least
16 feet long, with a hinge at the fixed end attached to the wooden structure and 8-inch diameter
wheels at the moveable end located on the floating platform. The gangway shall have
commercial-grade handrails on both sides. The quality of construction and materials must be
suitable for the intended use as a public facility.
Form of Proposal
The Base Proposal should address construction of 70 feet of elevated boat dock consisting of
seven 8 ft. x lOft. segments, a terminal segment 12 ft. x 12 ft. in size centered on the main
structure. The Base Proposal price shall include all required preparatory grading, removal of
invasive plants along the shoreline within the area of construction, concrete footer, all materials,
and all labor required to construct the finished facility, as shown on the project plans.
The Add-alternate Proposal should address the design and cost of substantially prefabricated
components providing a floating dock and gangway, along with their delivery to the site and
installation. The proposal should additionally include the manner and cost of modifying the
fixed wooden structure covered by the Base Proposal so as to accommodate the gangway and
floating platform. A respondent need not provide the Add-alternate Proposal; however, if the
City elects to accept an Add-alternate Proposal, it will be from the same respondent as it selects
for the base work.
Each proposal shall consist of two parts, a technical section describing how the respondent will
meet the requirements given in the Scope of Work and a price quote stating the cost of the work
following the manner of construction described in the technical proposal. Each response must
include the Base Proposal and may include the Add-alternate Proposal. Respondents are advised
to supply references listing the work performed, the price of the work, and a client contact for
two or three similar projects as an aid to the City in evaluating proposals.
The signed and sealed engineer's drawings are not required as part of the respondent's proposal.
Such drawings will only be required from the selected respondent. However, catalog cut sheets
and shop drawings for proposed components will be useful in fully understanding each proposal
submitted. The length limit for each response is 25 pages, inclusive of all statements of
qualification, references and recent projects, product documentation, price quote, and other
elements of the proposal.
Manner of Award
The City of Ocoee will examine all Base and Add-alternate proposals and select the one proposal
that, in the City's sole discretion, provides the greatest value to the City and the users of Prairie
Lake Park. Potential respondents are advised that this is not a low-bid solicitation. The City will
attempt to negotiate a contract with the preferred respondent. If an agreement cannot be reached
in a reasonable time, the City will select an alternative provider from among the remaining
proposals. Construction details may change during the negotiation process.

1. ACCESS: Materials of construction shall be delivered and moved across the property to
the work site. DBMC employees shall park their vehicles in a safe and lawful rnanner
cornpliant with community rules as applicable.
2. BILLING RATE: $60.00 straight tirne, $90.00 overtime.
3. CHANGE ORDERS: Work not within the scope of this proposal shall be submitted and
approved in writing before commencement. Change orders shall be due with final
payment unless otheIWise agreed upon in writing.
4. CONCEALED OR UNKNOWN CONDITIONS: In preparing this proposal DBMC has
assumed there are no concealed or unknown physical conditions (subsurface or
otheIWise) which will aversely affect DBMC ability to perform the scope of this
proposal. If such conditions are encountered, DBMC will immediately notifY the owner
in writing of adverse conditions and will be entitled to an adjustment of contract value,
schedule, or both.
5. FORCE MAJEURE: Neither party shall be liable in darnages or have the right to
terminate this Agreernent for any delay or default in performing hereunder if such delay
or default is caused by conditions beyond its control including, but not limited to Acts of
God, Government restrictions, and/or any other cause beyond the reasonable control of
the party whose performance is affected.

6. HEA VY WEATHER: During a named storm DBMC reserves the right to dernobilize and
remove equipment from the jobsite without penalty for schedule delay(s).
7. IN CLEMENT WEATHER: Due to the nature of outdoor construction inclement weather
rnay affect schedule. Every effort shall be made to maintain proposed schedule, however
DBMC shall not incur additional expenses due to weather delays.
8. INSURANCE: Certificate available upon request.
9. LANDSCAPING: Project may require use of equipment that will disturb/darnage sod
and/or landscaping. No allowance is made for repair/replacement of sod or landscaping.

II. PAYMENT TERMS: Due upon receipt. Interest will be charged on past due accounts at
18% per annum. IfDBMC is required to employ an attorney to collect any amount past

including reasonable attorney's fees and court costs.
12. PERMITS: Not included with this proposal.
13. PRICE VALIDITY: Thirty (30) days from date of quotation except stainless steel items
which are five (5) days.
14. UNDERGROUND SERVICES: Project may require excavation. Owner is responsible
for locating and identifying all underground utilities, sprinkler systems, pool piping,
septic tanks, drain fields, or other items subject to damage from equipment movement or
excavation. DBMC is not responsible for accidental damages, direct or consequential.
Any relocation required shall be the responsibility of the owner.
IS . WARRANTY: Workmanship and material will be free frorn defects for one (I) year
from cornpletion and final acceptance. Owner shall subrnit in writing clairn of defect
within ten (10) days of discovery. Owner's sole and exclusive remedy for defective
rnaterials or workmanship is limited to the repair or replacement of the defect by DBMC.
16. DISCLAIMER OF WARRANTIES: Section 15 sets forth the exclusive rernedy for
claims based on failure of or defects in services, workmanship, or rnaterials furnished by
DBMC, whether claim is based on contract, warranty, tort (including negligence) or any
other cause of action, and however instituted, and upon expiration of the warranty period
all such liability shall terminate. The foregoing warranty or repair or replacernent is
exclusive in lieu of all other warranties, whether written, oral, implied, or statutory. IT IS
SPECIFICALLY UNDERSTOOD AND AGREED TO BY BUYER THAT (1) DBMC
SHALL NOT IN ANY WAY BE LIABLE OR REPSONSIBLE FOR ANY
NEGLIGENT ENGINEERING, CONSTRUCTION, REPAIRS, OR DEFECTS IN THE
WORK AFTER THE EXPIRATION OF ONE YEAR FROM COMPLETION AND
