As part of the next phase of improvements to that park, the City plans to construct a sand-bottom, non-motorized boat ramp adjacent to the pier. The observation pier is too high above the water to serve effectively as a boat dock, so staff solicited bids from dock construction companies to build and install a 16 ft. by 8 ft. floating platform with aluminum ramp at the end of the pier. The floating dock, which would be placed longitudinally across the end of the higher structure, would both eliminate the ability for illicit divers to use the higher platform and provide a means for boating users to access their vehicles from the structure. (They would otherwise have to wade to the boat after launching.) The cost proposal is $7,296.00 for the floating platform and gangway, plus an additional $500 to modify the existing pier to mount the gangway. The price for the work is based on award of the similar construction at Prairie Lake Park. Issue: Should the City of Dcoee execute the proposed Project Agreement with Doherty Brothers Marine Construction, Inc., to construct a floating boat dock at Lake Moxie in Central Park? Recommendations The City's Engineering and Parks & Recreation departments recommend that the City Commission authorize the Mayor and City Clerk to execute the Project Agreement as the most efficient and cost-effective way for the City to improve boating facilities at Lake Moxie in Central Park. The specific improvement to authorize is to construct and install a 16' x 8' floating dock with a 4' x 16' hinged aluminum ramp at the end of the existing Central Park observation pier @ $7,796.00. Financial Impact: The $7,796.00 cost of the improvements at Central Park would be paid from the $10,709 in funds remaining in the original FY 2009 allocation for construction of the affected boardwalk and observation pier under Job No. 30501. DBMC employees shall park their vehicles in a safe and lawful manner compliant with community rules as applicable. 2. BILLING RATE: $60.00 straight time, $90.00 overtime. 3. CHANGE ORDERS: Work not within the scope of this proposal shall be submitted and approved in writing before commencement. Change orders shall be due with final payment unless otherwise agreed upon in writing. 4. CONCEALED OR UNKNOWN CONDITIONS: In preparing this proposal DBMC has assumed there are no concealed or unknown physical conditions (subsurface or otherwise) which will aversely affect DBMC ability to perform the scope of this proposal. HEA VY WEATHER: During a named storm DBMC reserves the right to demobilize and remove equipment from the jobsite without penalty for schedule delay(s). 7. INCLEMENT WEATHER: Due to the nature of outdoor construction inclement weather may affect schedule. Every effort shall be made to maintain proposed schedule, however DBMC shall not incur additional expenses due to weather delays. 8. INSURANCE: Certificate available upon request. 9. LANDSCAPING: Project may require use of equipment that will disturb/damage sod and/or landscaping. No allowance is made for repair/replacement of sod or landscaping. I O. PAYMENT SCHEDULE: 15% upon mobilization Progress payments based upon percent complete Balance upon final acceptance 11. PAYMENT TERMS: Due upon receipt. Interest will be charged on past due accounts at 18% per annum. PERMITS: Not included with this proposal. 13. PRICE VALIDITY: Thirty (30) days from date of quotation except stainless steel items which are five (5) days. 14. UNDERGROUND SERVICES: Project may require excavation. Owner is responsible for locating and identifying all underground utilities, sprinkler systems, pool piping, septic tanks, drain fields, or other items subject to damage from equipment movement or excavation. DBMC is not responsible for accidental damages, direct or consequential. Any relocation required shall be the responsibility of the owner. 15 . WARRANTY: Workmanship and material will be free from defects for one (1) year from completion and fmal acceptance. Owner shall submit in writing claim of defect within ten (10) days of discovery. Owner's sole and exclusive remedy for defective materials or workmanship is limited to the repair or replacement of the defect by DBMC. 16. DISCLAIMER OF WARRANTIES: Section 15 sets forth the exclusive remedy for claims based on failure of or defects in services, workmanship, or materials furnished by DBMC, whether claim is based on contract, warranty, tort (including negligence) or any other cause of action, and however instituted, and upon expiration of the warranty period all such liability shall terminate. The foregoing warranty or repair or replacement is exclusive in lieu of all other warranties, whether written, oral, implied, or statutory.
