MINUTES OF THE PLANNING AND ZONING COMMISSION
ACTING AS THE LOCAL PLANNING AGENCY
MEETING HELD TUESDAY, OCTOBER 13, 2009
CALL TO ORDER
Chairman Sills called the meeting to order at 7:02 p.m. Following a moment of
silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared
present.
PRESENT: Chairman Sills, Vice Chair Golden, Members Campbell, Dillard,
Rhodus, and West. Also present were Assistant City Attorney
Watson, Development Services Director Shadrix, Building Official
Washington, and Deputy City Clerk Sibbitt.
ABSENT: Members Conkling, McKey, and Morris were absent excused.
CONSENT AGENDA
Minutes of the Planning and Zoning Commission Meeting held on Tuesday,
September 8, 2009.
Member West, seconded by Vice Chair Golden, moved to accept the Minutes of
the September 8, 2009, Planning and Zoning Commission meeting Motion
carried unanimously.

NEW BUSINESS
CHANGES TO THE OCOEE LAND DEVELOPMENT CODE — SECTION 7-2A, 7-4A, 7-5A, 7-
6A, OF PART IA OF ARTICLE VII OF CHAPTER 180
Building Official Washington gave a brief overview of the changes to the LDC
relating to FEMA National Flood Insurance Program Requirements. He stated
that the City had received a notification from FEMA State advising the City that
they needed to review their ordinance and if it was not updated they would not
allow the City to participate in the National Flood Insurance Program. Upon
review of the ordinance, which was given a good review, they made minor
grammatical changes and updated some new laws that had been passed since
the adoption of the ordinance.
The new ordinance has been drafted by the City Attorney with the help of FEMA
to insure that the ordinance before them would be accepted as meeting their
criteria.

DISCUSSION
Vice Chair Golden stated he had a question regarding definition 27 on page 7 of
the LDC. It states that: "Substantial Damage: Damage of any origin sustained
by a structure whereby the cost of restoring the structure to its before -
damages condition would equal or exceed 50 percent of the market value of
the structure before the damage occurred." Building Official Washington
explained that once your home or property is damaged then the owner is
responsible to bring it up to current FEMA regulations. He further gave a scenario
of when the 50% would most likely apply. Vice Chair Golden stated there was
another section which addressed elevating mobile homes and was wondering if
that would have to be a building code change. Building Official Washington
stated it is not a building code change and there are situations where mobile
homes are found in flood plain areas; however, Ocoee only has three zonings
which allow mobile home placement so that section would not be an issue at any
time for the City.
The Public Hearing was opened for Changes to the LDC. As no one wished
to speak the Public Hearing was closed.
Member Campbell, seconded by Member West, moved to recommend approval
of Ordinance No. 2009-028. Motion carried unanimously.
MISCELLANEOUS
Development Services Director Shadrix commended Building Official
Washington for his tremendous work with the redesign at the Building Department
counter and the changes in the way that they are operating. He further
announced they are in the testing mode of their on-line building permitting
computer system. He is planning to do a sneak preview briefing at the October
20th Commission Meeting. Development Services Director Shadrix stated this
program is being designed just for the Development Services Department at this
time but it is a methodology that can be easily applied on a City wide basis. He
further explained the user friendliness of the program.
Development Services Director Shadrix stated at their Founder's Day booth
they had over 100 residents fill out a survey regarding what they would like to see
in the CRA. On November 4th at 6 p.m. in the Community Center they are
planning a community workshop targeting businesses in the CRA. It will be a
really good meeting because it will follow-up on some of the workshops they have
had with the CRA Board and the citizen surveys they have at this point. They
received a lot of positive responses on the target of Area 1 properties which is the
corner of Maguire Road and State Road 50. Development Services Director
Shadrix stated the November Planning and Zoning Meeting will be a very

important meeting because they will likely have a special development plan that
will be executed under the activity center overlay of the code for that area. Also
there is a very strong likelihood that they will be bringing a draft of the E.A.R.
Chairman Sills inquired if the Hampton Inn had backed out because he heard
they were not building the hotel there. Development Services Director Shadrix
stated to his knowledge the issue holding up that development is that they are
trying to come up with the impact fees required. The applicant's representative
appeared at the City Commission meeting and made it known that they were
having a difficulty coming up with the funds. They may also possibly be hurt by a
change to the building code which may require them to go back and do a lot of
redesign.

ISSUE:
Should the Planning & Zoning Commission recommend approval of a Substantial
Amendment to the Land Use Plan for Prairie Lake PUD?
BACKGROUND:
The Prairie Lake PUD is located on both sides of Clarke Road between Hackney
Prairie Road and AD Mims Road. However, this particular request will only affect Tract
"G" (AKA: "Villa Roma" property) of the Prairie Lake PUD. Specifically, Tract "G" is
located on the southwest corner Hackney Prairie Road and Clarke Road and is
approximately 21.13 acres in size of which approximately 6.39 acres are designated
as wetlands. The subject property is currently vacant, undeveloped and is partially
covered with trees.
The existing land use to the east is single-family residential & townhome (Westchester
& Wentworth) developments zoned Medium Density PUD; to the south, there is a
town home/single-family (Reserve at Meadow Lake) residential development currently
being developed which is zoned Medium Density PUD. To the north is an
unincorporated parcel (+/- 36 acres) which is heavily treed and currently undeveloped,
zoned (Orange County) A-1. Lake Meadow and its associated wetlands are on the
property's western boundary. Additionally, a water retention pond owned by the City is
situated west and adjacent to the subject property. Currently, it is being utilized for
stormwater abatement for Clarke Road.
The Future Land Use designation for the subject site is "Medium Density Residential"
which allows up to 8 dwelling units per acre. The surrounding future land uses are
"Low Density Residential" to the north and "Medium Density Residential" to the east.
To the south and west there is "Conservation/Floodplains" future land use designation
that is mostly associated with the Lake Meadow basin.

DISCUSSION:
The Prairie Lake PUD/Land Use Plan was officially approved by the City Commission on
April 16, 1991. Then it was later amended twice, once on June 4, 1996 and on
December 16, 2003. The existing Prairie Lake PUD Land Use Plan indicates that
Townhomes, Patiohomes and Villas are all permitted uses on Tract "G"; however, due to
the current market conditions, the applicant/owner has requested to add Assisted
Congregated Living Facility (ACLF), Nursing Home, Two -Family Dwelling and Single -
Family Dwelling as permitted uses for Tract "G". The proposed ACLF/Nursing Home
development standards, if approved, would be limited to a maximum of 300 assisted
living units with a maximum building height of 55 feet. The other requested uses will use
the existing residential development standards for Prairie Lake PUD. Accordingly, the
Land Use Plan was amended to reflect the Applicants' request. This requested Land
Use Amendment will only affect Tract "G" of the Prairie Lake PUD. Accordingly, the
existing Development Agreement will also have to be amended.
It should be noted that the requested Assisted Living Facility use is consistent with the
adopted City of Ocoee Comprehensive Plan. The Comprehensive Plan states, "This use
[Medium Density Residential] is intended to provide a buffer between low density
residential uses and more intense uses, such as high density residential or professional
offices and services. This includes patio homes, zero lot line houses, townhouses,
assisted living facilities, garden apartments, and other forms of detached or semi-
detached houses." Therefore, staff can support this requested land use change as
presented.
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on December 16, 2009 and reviewed
the Amendment to the PUD Land Use Plan for Prairie Lake PUD. According to the
City's Land Development Code, alterations to an approved PUD Land Use Plan shall be
classified as either substantial or nonsubstantial by the DRC. The Committee
determined that the proposed amendment was considered a substantial amendment due
to the criteria established in the City's Land Development Code. Accordingly, the
proposed substantial amendment will be presented at a public hearing before the
Planning and Zoning Commission and a public hearing before the City Commission.
There were minor technical issues to be addressed from the Planning Division and the
City Attorney's Office that were presented via memorandums. There was also some
discussion on the existing Development Agreement, potential/vested impact fees, and
residential units versus ACLF units. Nevertheless, all of the changes to the Land Use
Plan were discussed and agreed upon by the Applicant. Finally, the Applicant felt
confident that an Amendment to the existing Development Agreement and Title Report
for the property will be finalized before the City Commission meeting.
When the discussion was finished, the DRC voted unanimously to recommend approval
of the Amendment to the Prairie Lake PUD, subject to resolving the outstanding staff
comments and making the changes agreed upon at the DRC meeting before the City
Commission meeting.
After subsequent submittal and review, the Land Use Plan (date stamped
December 29, 2009) addressed all remaining plan review comments.

STAFF RECOMMENDATION:
Based on the recommendation of the DRC, Staff recommends that the Planning and
Zoning Commission recommend approval of the Amendment of the PUD Land Use Plan
for Prairie Lake, as date stamped received by the City on December 29, 2009.
