Minutes of the Planning and Zoning Commission Meeting held on February 9, 2010 MINUTES OF THE PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY MEETING HELD TUESDAY, FEBRUARY 9, 2010 CALL TO ORDER Chairman Sills called the meeting to order at 7:01 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present. Chairman Sills announced that Member Darlene Rhodus, who has been a member of the P&Z Commission for 23 years, has resigned due to family issues that would not permit her to be present for the meetings. She will greatly be missed. He further announced that there are four applicants who are going to be considered for the open position on the board and the newly appointed member should be present at the March meeting. PRESENT: Chairman Sills, Members Campbell, Dillard, McKey, Morris, and West. Also present were Assistant City Attorney Watson, Principal Planner Fabre, and Deputy City Clerk Sibbitt. ABSENT: Vice Chair Golden and Member Conkling were absent excused. CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Tuesday, January 12, 2010. Member Campbell, seconded by Member Dillard, moved to accept the Minutes of the January 12, 2010, Planning and Zoning Commission meeting. Motion carried unanimously. OLD BUSINESS — None NEW BUSINESS PROPOSED AMENDMENT TO THE OCOEE LDC — EXTENSION OF PRELIMINARY/FINAL SUBDIVISION AND SITE PLAN APPROVALS Principal Planner Fabre gave a brief overview of the proposed LDC Amendment stating that due to the economic conditions many developers can not get final financing, construction loans, and so forth, so the city proposed to extend all preliminary/final subdivision and site plans that have been approved between the dates of January 1, 2005, through March 1, 2010. This will be consistent with the Senate Bill 360, which allowed a two-year extension on any development order that was already approved. Planning and Zoning Commission Meeting February 9, 2010 DISCUSSION Member McKey stated he would like to have clarification on what is exactly being proposed. Assistant City Attorney Watson explained that an extension would be granted until March 1, 2012 for only those preliminary/final subdivision and site plans that were approved between January 1, 2005, and March 1, 2010. A brief discussion ensued regarding the difference in an extension being granted and vested rights. The Public Hearing was opened. As no one wished to speak, the Public Hearing was closed. Member West stated he feels this is a good thing because the Commission would readily give an extension and this will help to keep the developer's from coming before them month after month to ask for an extension. Assistant City Attorney Watson explained that this proposed amendment was drafted to be in accordance with Senate Bill 360. The Senate Bill has not gone into effect because of litigation on how it is to be enacted. Member Campbell stated he thinks that this proposed amendment is stating, that as a municipality, we are willing to do this irrelevant of what the litigation with the state is. He further stated he feels that the city is being proactive because it still will not preclude the board from having these cases come before them. It just helps the developer arrange their finances and given the state of the economy this will help development get built. Member West, seconded by Member Morris, moved for approval of Section 4-12 of the Land Development Code, which extends certain previously approved Preliminary/Final Subdivision and Site Plans until March 1, 2012. Motion carried 4-1 with Member McKey opposing.. THROUGH: Craig Shadrix, Development Services Director SUBJECT: Homes in Partnership - Oak Level Heights Annexation/Rezoning AX-03-10-19 & RZ-10-03-02 ISSUE: Commissioners Gary Hood, District 1 Rosemary Wilsen, District 2 Rusty Johnson, District 3 Joel F. Keller, District 4 Should the Planning & Zoning Commission recommend approval of the Annexation and Rezoning of the Homes in Partnership - Oak Level Heights parcels? BACKGROUND: The t 1.3 acre subject parcel consists of lots 1, 2, 3, 19, 20, 21, & 22 of Block D, Oak Level Heights, platted in 1925. The subject properties are located on the west side of Adair Street, on both 2"d and Td street. All of the lots are vacant and were platted at 55 feet wide by t151 feet in depth for an average of 8,305 square feet. The subject property is located in a large enclave of unincorporated Orange County characterized as a mixture of single-family homes, vacant lots and a church. The lots are currently zoned A-1 (Agriculture) in Orange County. On August 21, 2007, the Orange County Board of Adjustment approved variances on all seven (7) lots. The variance approvals permitted a lot width of 55 feet in lieu of 100 feet and lot sizes of 8,300 square feet in lieu of 21,780 square feet. The applicant intended to obtain potable water from wells and use septic systems for sewer, but would require a variance from the State Department of Health because of separation requirements of 75 feet in between well and septic systems. By annexing into the City of Ocoee, the applicant can connect to the City's water service which would exclude the septic systems from meeting the 75 foot separation requirement. According to the Land Development Code, the R-1 zoning designation is intended for areas shown on the Future Land Use Map as "Low Density Residential". The R-1 zoning designation permits a lot size of 7,000 sq. ft. with a minimum width of 70 feet. The lots proposed for annexation exceed the lot size requirement but do not meet the minimum width of 70 feet. Annexation of the property will be subject to approval of an annexation agreement waiving the lot width requirement in order for the lots to be built upon without variances. The applicant is proposing to meet the front, side, and rear setback requirements of the district. The R-1 zoning designation is consistent with the adopted future land use designation of Low Density Residential, shown on both the City of Ocoee and Orange County Joint Planning Area future land use maps. Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5 that states in part, "The City shall consider requests for voluntary annexation into the City when those lands are logical extensions of the existing City limits, when services can be properly provided, and when proposed uses are compatible with the City's Comprehensive Plan, the JPA Agreement, and the City's Annexation Policy...." [Emphasis added]. The rezoning is consistent with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA Agreement..." Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long as it does not create an enclave. The subject property is considered contiguous to the City of Ocoee since the parcel located west of Adair Street is located within the Ocoee City limits. Joint Planning Area Agreement: The subject properties are located within the Ocoee -Orange County Joint Planning Area (JPA) and is being considered for annexation as outlined in the JPA Agreement. The applicant is concurrently requesting rezoning of the properties to R-1 (Single -Family Dwelling). Orange County has been notified of this petition in accordance with Subsection 13-A of the City of Ocoee -Orange County Joint Planning Area Agreement. DISCUSSION: Annexation Feasibility & Public Facilities Analysis Report: Based upon the projected impacts of the proposed use and size of the parcel, Staff determined that urban services, specifically water service could be adequately provided to the subject properties. Should the applicant choose to develop the property in the future; however, they will be required to make certain improvements in accordance with the Land Development Code. (See attached "Annexation Feasibility Analysis") Page 2 of 3 Summary: The proposed annexation is a logical extension of the City limits, urban services can be provided, and the annexation meets state and local regulations. Furthermore, the requested Future Land Use and initial zoning classifications are consistent with the land use classifications on the Future Land Use Map and the JPA Land Use Map. The land use and initial zoning are also consistent and compatible with surrounding properties. Additionally, the surrounding neighborhood will benefit from the annexation when the applicant develops the seven (7) vacant lots by increasing the land value in the area and by removing a vacant lot prone to being used as an area of illegal dumping. DEVELOPMENT REVIEW COMMITTEE (DRC) RECOMMENDATION: On April 7, 2010, the DRC met to determine if the proposed annexation was consistent with the City's regulations and policies. Based on the above analysis and subsequent discussions, the DRC recommended approval of the annexation and rezoning of the Oak Level Heights parcels as presented. STAFF RECOMMENDATION: Based on the above analysis and the subsequent DRC recommendation, Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval of the annexation of the 1.3 +/- acres of land known as the homes in Partnership - Oak Level Heights, and rezoning to "R-1" Single -Family Dwelling, subject to the applicant entering into an annexation agreement which would waive the provisions of Section 5-10 (B) of the Land Development Code which provides provisions for non -conforming lots.
