DISCUSSION IS DESIRED BY A MEMBER OF THE COMMISSION, IN WHICH CASE THE MAYOR WILL
INSTRUCT THE CITY CLERK TO REMOVE THAT ITEM FROM THE CONSENT AGENDA AND SUCH ITEM
WILL BE CONSIDERED SEPARATELY.
1. Approval of the Regular City Commission Minutes Held on April 6, 2010. (City
Clerk Eikenberry)
2. Reappointment to the Human Relations Diversity Board. (City Clerk
Eikenberry)
The two-year term of Fay Alston will expire in May. The member has indicated she is willing to serve
another term, if reappointed. The current request for reappointment not withstanding, there is currently
one vacancy on the board and no pending applications.
3. Approval of Purchase of Police Portable Radios. (Police Chief Brown)
The FY 2009/2010 budget provided up to $115,588 for the purchase of digital portable radios and
accessories. The City of Ocoee was awarded reimbursement grants for the purchase of digital radios
and earpieces for radios. The American Recovery Act-JAG Countywide Grant # 20 1 O-AARC-ORAN-
27-W7-222 awarded the purchase of 9 (nine) digital radios totaling $49,500 and 32 earpieces totaling
$3,488. The Justice Assistance Grant # 2010-JAGC-ORANG-15-4X-092 awarded the purchase of 3
(three) digital radios totaling $16,500 and 13 earpieces totaling $1,453. The above mentioned grants
will reimburse the City for the purchase of 12 radios. The police department will also purchase 5 (five)
digital radios totaling $27,500 from the budgeted Capital Outlay fund. In order to maintain
compatibility and interoperability with Motorola radios currently utilized by the Orange County radio
users group, Motorola radios must be purchased. Motorola is a sole source provider for these radios
and offers only the Orange County contract pricing of $5500 per radio. These radios will also be
compliant with pending Federal mandates.

4. Approval of Lakewood Manor - Non-Substantial Amendment to the PUD.
(Principal Planner Rumer)
The owner/builder of the site, Homes in Partnership (HIP), approached the City back in February about
an issue with the size of the building pad envelope of Lot 38. Homes in Partnership does not have a
home plan that fits within the building pad envelope and is requesting relief to the side yard setback.
Homes in Partnership is requesting a non-substantial amendment to the PUD to permit an eastern side
yard setback reduction from 15 feet to 12.8 feet for lot 38.
5. Approval of Funding for the Employee Assistance Program. (Human Resources
Director Carnicella)
This Agreement is for mental and emotional healthcare claims, including psychiatric initial
assessments, individual and family counseling, group counseling, and training seminars for employees
and their dependents. The budgeted amount this fiscal year is $55,000 and the funds are available.

6. Proposed Code Amendment for Temporary Deferral of Road Impact Fee
Payments. (Second Reading and Public Hearing scheduled for May 4, 2010, Regular Commission
Meeting at 7: 15 p.m. or soon thereafter). (Development Services Director Shadrix)
As an economic incentive for new development, City Staff is proposing a Code Amendment for
Temporary Deferral of Road Impact Fee Payments. In lieu of the payment of Road Impact Fees prior
to the issuance of a Building Permit as provided in Sections 87-3 and 87-11, an applicant for a
Building Permit will be able to defer the payment of applicable Road Impact Fees until the
authorization of "Prepower" or issuance of a "Certificate of Occupancy" (C.O.) with respect to the
structure or building for which the deferral has been requested. The provisions of this amended section
shall not be applicable to single-family or multi-family housing projects with less than four dwelling
units. Furthermore, the road impact fee deferral set forth in this amended section shall "sunset" on
May 1,2012, without further action by the City Commission.
I H. SECOND READING OF ORDINANCE - PUBLIC HEARING I
7. Proposed Amendment to Chapter 1 of the Code of Ordinances By Adding
Article III, Entitled "Administrative Service Charges" and Section 1-14 Entitled
"Lien Search Fees". (Advertised in the Orlando Sentinel Legal Classified on Sunday, April II,
2010. Public Hearing scheduled at 7:15 p.m. or soon thereafter). (City Clerk Eikenberry)
The City of Ocoee receives numerous requests for lien searches which consume a significant amount
of staff time in four departments with no current form of reimbursement to the City. In recent months
these lien search inquiries have skyrocketed due to foreclosures, short sales, and investors "flipping"
properties. During the first three months of 2010, the City Clerk's office has coordinated and
responded to 175 requests for lien searches, which would average approximately 700 per year at that
continued pace. In addition to collecting a fee for the lien search, other cities have reported that
including any delinquent utility fees as part of the lien report procedure often assisted in collecting
such outstanding fees at closing even if no lien existed. Fees from other municipalities ranged from
$10 - $100. Staff recommends that the standard Lien Search Fee be set at $25, with a $75 fee for
expedited searches requiring a response in less than two business days.
