AGENDA ITEM STAFF REPORT Contact Name: Contact Number: Item # Michael Rumer JVl/- 407 -905-3100/1018 Meeting Date: April 20, 2010 ~ Reviewed By: Department Director: City Manager: l Subject: Lakewood Manor Non-Substantial Amendment to the PUD I Commission District # 1 - Gary Hood I BACKGROUND SUMMARY: The Lakewood Manor PUD is located on the west side of Lakewood Avenue at the intersection of Wurst Road and Lakewood Avenue. The PUD consists of 49 single-family lots with a minimum lot size of 60x120. A waiver was granted to the 25 foot side yard setback for properties abutting Lakewood Avenue to a reduced setback of 15 feet. The applicant agreed to dedicate ten (10) feet of property for a future right-of- way expansion for granting the waiver. Also, the lots benefitting from the waiver reduction were permitted to have building pad widths of 40 feet in lieu of 45 feet. A total of three lots (1, 37, and 38) are affected by the setback reduction. The owner/builder of the site, Homes in Partnership (HIP), approached the City back in February about an issue with the size of the building pad envelope of Lot 38. Homes in Partnership does not have a home plan that fits within the building pad envelope and is requesting relief to the side yard setback. Homes in Partnership is requesting a non-substantial amendment to the PUD to permit an eastern side yard setback reduction from 15 feet to 12.8 feet for lot 38. ISSUE: Should the Honorable Mayor and City Commissioners approve the Non-Substantial Amendment to the Land Use Plan for Lakewood Manor PUD to permit Lot 38 a reduced side yard setback reduction from 15 feet to 12.8 feet? DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on April 7, 2010 and reviewed the Non-Substantial Amendment to the PUD Land Use Plan for Lakewood Manor PUD. According to the City's Land Development Code, alterations to an approved PUD Land Use Plan shall be classified as either substantial or non-substantial by the DRC. The DRC Committee determined that the proposed amendment was considered a non-substantial amendment and recommended the City Commission approve the non- substantial amendment. STAFF RECOMMENDATION: Based on the recommendation of the DRC and Staff's support, staff recommends that the Mayor and City Commissioners Approve the Non-Substantial Amendment to the Land Use Plan for Lakewood Manor PUD reducing the side yard setback for Lot 38 from 15 feet to 12.8 feet.
