Background Summary:
The City and the IAFF Union agreed upon several re-openers in the present Collective Bargaining
Agreement. Recently the City and the Union began negotiations over the several articles that were scheduled
to be re-opened between October 08/09 through September of 10/11.
Issue:
The City and the Union have reached a tentative agreement regarding the number of paid time off hours the
employees should receive as part of their incentive for actively participating in the disease management
wellness plan coordinated through the health center Doctors, Nurses and CareHere Professionals.
Recommendations
Staff recommends the Mayor/Commission approve the attached Memorandum of Understanding. This
agreement provides any employee that participates in the structured wellness program an additional 24 hours
of paid time off. This 24 hour accrual will be a one-time event during the duration of the present Collective
Bargaining Agreement.

MEMORANDUM OF UNDERSTANDING
The following Memorandum of Understanding is entered into between the City of Ocoee, (The
Employer) and the International Association of Fire Fighters, Local 3623, (The Union), hereinafter
referred to as the "Parties" in accordance with the provisions of the collective bargaining agreement
approved by The City of Ocoee Mayor/Commission on November 20, 2008.
The Parties originally agreed to re-open Article 11- Insurance and Pension, Article 15- Paid Time
Off and Article 25- Safety. Health and Physical Fitness within the three year timeframe of the
collective bargaining agreement. The Union requested the Parties fe-open the above mentioned
Articles on March 16, 2010. The Parties have continued negotiations over the above mentioned
Articles on several occasions. The Parties have agreed to resolve Article 25 Section C-4, which was
to determine the number of paid time off hours employees would receive that have reached desired
benchmarks under the disease management plan designed by and through the Employee Health
Center.
The Parties have agreed to the following;
To provide twenty four (24) hours of paid time off for all employees considered to have complied
with the disease management plan through the Employee Health Center, immediately after this
Memorandum is ratified by the Union and approved by the Employer.
This twenty four (24) hours of paid time off is for any employee that is compliant with the disease
management plan as a result of the annual physicals completed in 2009 & 2010.
The above entitlement of additional paid time off will be considered a one time event and shall
cease on October 1, 2010 unless a successor agreement contains a provision to continue the above
benefit on an annual basis. The above constitutes the Parties entire understanding of the resolution
of the re-opener regarding Article 25 of the collective bargaining agreement. The other re-openers
relative to Articles 11 and 15 are still under consideration and continued negotiations.
