CODE ENFORCEMENT BOARD MEETING
MAY 25, 2010
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:01 p.m. in the Commission Chambers at City Hall. Member Lowery led the Invocation
and Alternate Member Kelley led the Pledge of Allegiance to the Flag. The roll was called
and a quorum was declared present.
PRESENT: Chairman Godek, Vice Chair M. Godek, Members Alexander, Hopper,
Lowery, Osborne, and Alternate Member Kelley. Also present were Code
Enforcement Officer Loeffler, Code Enforcement Officer Delgado, Code
Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez,
Administrative Assistant Ballard, Attorney Feeney, and Deputy City Clerk
Sibbitt.
ABSENT: Member Sais and Alternate Member Arney were absent excused.
GUESTS: None.
Administrative Assistant Ballard administered the oath to Code Enforcement Officer
Loeffler, Code Enforcement Officer Delgado, Code Enforcement Officer Siegrist, Code
Enforcement Officer Rodriguez, and anyone intending to speak regarding a case.

Observation: Abandoned unsafe swimming pool, electrical system (missing cover for clothes dryer/outlet
exposured/220 electrical wires, holes in interior walls throughout the house.
Officer Loeffler gave a brief history of the case providing exhibits and stated, as of today, the
property is in non-compliance. He further stated a representative of the owner did contact the
office to ask for an extension as the owner was seriously ill and in the hospital. After an
initial 30-day period and without any further contact to the city, the property was re-inspected
and found to still be in non-compliance. Prior to the scheduled hearing in April, Officer
Loeffler was contacted by a potential buyer who presented a letter of intent to buy the
property; however, due to minor legal hurdles involving the title, the case was continued to
this hearing date. Officer Loeffler stated he was again summoned to the property by the
Police Department while they conducted an investigation of reported squatters.
Richard McCree, 330 Spring Bluff Drive, stated his wife's name is on the title but she is
deceased. He further stated that George Richards is buying the home and has made the
electrical repairs. Mr. Richards stated that he is trying to purchase the house and has made
repairs, as well as, put a padlock on the fence to keep people out of the pool. He further stated
he has contacted a pool company and will take care of everything else that is left as soon as he
gets ownership of the house. To the best of his knowledge there are no people in the house
now. He has put a contract on the house and is trying to do what he can but since he does not
officially own the house he does not want to continue to put money into it. Chairman Godek
stated that Mr. Richards is actually not responsible for anything involving this case, as of right
now. He further inquired from Mr. McCree, as to when to house could be fixed so violations
would be in compliance. Member Hopper stated all they would really need to do for the
pool is throw in chlorine and shock the pool. Officer Loeffler stated that was correct, he is
not looking for a swimmable pool, just anti-mosquito. Vice Chair M. Godek inquired if the
Officer has been back to the property to inspect it. Officer Loeffler stated he has driven by
on his own but would be happy to meet with anyone who has access to verify the two items
they stated have been corrected. A brief discussion ensued regarding bring the pool into
compliance. Chairman Godek stated the board is looking for a date in which they think they
could have the violations in compliance. Mr. Richards stated that he his waiting for the
home to be probated which he was told could be in 3-4 weeks. Mr. McCree stated there is
not much they can get done with his sister-in law still in the home. Member Hopper inquired
as to who owned the house. Mr. McCree stated the home was in his mother-in-law and then
his wife's name (both are deceased). Attorney Feeney briefly explained the title search and
how probate works with a life estate. Member Hopper stated that regardless of the probate
issues, there are violations that need to be corrected and someone needs to go in and at least
take care of the pool. Officer Loeffler stated that if they a standard eviction on the sister-in-
law then they can go into the home to patch up the holes in the wall. Member Lowery stated
he feels it is hard to put a time line on this case because it will be up to the judge to first
decide on the probate. Member Hopper asked the Officer to explain the codes cited.

Observation: Excessive weed or grass, misc. junk/debris littering property on front porch and rear of property.
Officer Loeffler gave a brief history of the case providing exhibits and further stated, as of
today, the property is in non-compliance. The front yard has been mowed but rear yard has
not; minor amount of debris still in yard.
Fred Kountz stated when he received the notice he quickly mowed the grass and removed the
debris. He thought that would bring him into compliance and was shocked when he received
the notice of hearing. He further stated he has pictures of his yard now that he can show the
board. He further stated he does not have a lawn mower and has to borrow a friend's mower
so he is trying to do the best he can on keeping it cut. Mr. Kountz further inquired as to what
is excessively high because he does not believe his yard is that bad. Officer Loeffler stated
that the code states 10-inches as excessive. After a brief discussion, Mr. Kountz stated he
can have his yard cleaned up by this weekend.

Officer Rodriguez gave a brief history of the case and stated as of today, the property is in
non-compliance. She further explained the slab and roof was an existing structure; the
respondent added the walls and a window, thus enclosing the structure and requiring a permit.
Maggie Jones Keen stated that since the citing by the officer she has gone down to the
Building Department and has spoken with Mike Rumer and Johnny Navarro about a permit.
She further explained that when the previous owner pulled the permit for the open structure he
also had a garage in the back. It seems with the new ordinance passed she has not met the
required setback of 5ft. Ms. Keen stated she has paid $250 for a variance but has to wait until
after the Board of Adjustment meeting to see if her 3ft. setback will be allowed first before
she can get a permit. A brief discussion ensued regarding the original permit. Chairman
Godek inquired if there was any indication if the permit would be approved if the variance
was approved. Ms. Keen stated that Mr. Navarro stated he did not see a problem with the
construction of the structure and could inspect the structure. Officer Rodriguez stated the
city is looking for continuance of this case.

Officer Siegrist gave a brief history of the case with exhibits and further stated, as of today,
the property is in non-compliance. The violations and case is only against Jose Medina since
the property was quick-claimed to him.
Jose Medina (Interpreter Juan Oseguera (nephew), 628 Jay Street), stated that he did not
realize he needed a permit until after the structure was up. Mr. Medina stated he went to the
city and was told he could get a permit for a structure for the front but with work he has not

had the time to pull a permit. Officer Siegrist explained that the original work was done
without a permit. When he came to the city they told him the structure would not work where
he had built it because it was too close to the setback; however, if he wanted to it could be
built in the front of the home with a permit. Chairman Godek stated the board just needs to
know when the structure will be removed. Attorney Feeney explained to the interpreter that
it will have to be explained to Mr. Medina that the existing structure needs to be tom down
then he can worry about getting the permit for the front of the structure. Mr. Medina stated if
the city can give him a month because it is his daughter's room and he needs the weekends to
try to take it down. Officer Siegrist stated that the city would be fine with that time frame.

Edward Barzaga stated he is not the owner of the property but he is the owner of the vehicle.
Member Hopper inquired if Mr. Barzaga was aware that he is not allowed to drive semi-
trucks in that residential area. Mr. Barzaga stated he is aware of it now but would like to
know why the code states that a commercial vehicle can be parked behind the house and
screened with a fence. Officer Loeffler stated the code he is citing is reserved for vehicles
under 1 Y2 ton rated capacity such as trailers and recreational vehicles. Mr. Barzaga stated if
he is not allowed he will not do it again but he would like to know if the code applies to every
citizen in Ocoee because near his home there are other commercial vehicles parked in the
neighborhood. He further stated he feels they are being discriminated against. The board
informed Mr. Barzaga that the code applies to everyone and he should contact the Code
Enforcement Department if he feels there are other residents or vehicles in violation.
Attorney Feeney stated it would be beneficial for Mr. Barzaga to explain to his mother that if
the vehicle is parked there again this will be a repeat violation and she, as well as the vehicle
owner, may be fined up to $500/per day.

Officer Loeffler stated they originally did an affidavit of non-compliance; however, after the
board meeting he was able to speak with neighbors, tenants, and property owners and found
that the violations were fixed correctly, so the property is in compliance.
