I Subject: ORANGE. COUNTY LOCAL MITIGATION STRATEGY RESOLUTION
ISSUE:
Should the Honorable Mayor and City Commissioners approve a Resolution to adopt the Orange County
Local Mitigation Strategy and authorize the implementation thereof?
BACKGROUND/SUMMARY:
The Orange County Local Mitigation Strategy Working Group is intent on finding reasonable approaches to
making communities more resistant to disasters and ensuring that any redevelopment in the aftermath
continues to lessen future vulnerability to those impacts. One of the most effective ways to do this is to
have every local government recognize the importance of hazard mitigation and to develop and adopt the
Local Mitigation Strategy (LMS).
The City of Ocoee recognizes the importance of the LMS and is an active member of the LMS Working
Group. Nonetheless, to receive final approval all of the municipalities must adopt the LMS within one year
of the initial approval letter being issued. To this goal, Orange County has requested a Resolution to be
adopted to further solidify the City of Ocoee participation in the LMS system.
Adopting the LMS will enable the City to apply for Federal Mitigation Grants, such as the Pre-Disaster
Mitigation Grant Program, Hazard Mitigation Grant Program, Flood Mitigation Grant Program, etc. Failure
to adopt the LMS will make the City ineligible for these grant programs. In addition, the National Flood
Insurance Program requires participation and adoption of the LMS. Furthermore, an adopted LMS will also
help the City to lower its overall score in the Community Rating System.
STAFF RECOMMENDATION:
Staff recommends that the Mayor and City Commissioners approve the Resolution to adopt Orange County
Local Mitigation Strategy and the implementation thereof.

RESOLUTION NO. 2010-
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
APPROVING OCOEE'S DESIGNATED PORTION OF THE ORNAGE
COUNTY LOCAL MITIGATION STRATEGY AND PROVIDING FOR
THE IMPLEMENTATION THEREOF.
WHEREAS, the City of Ocoee is vulnerable to the human and economic costs of natural,
technological and societal disasters;
WHEREAS, the City Commission recognizes the importance of reducing or eliminating
those vulnerabilities for the overall good and welfare of the community;
WHEREAS, Section 322 of the Robert T. Stafford Disaster Relief and Emergency
Assistance Act, 42 V.S.C. 5165, as amended by the Disaster Mitigation Act of2000, provides for
States and local governments to undertake a risk-based approach to reducing risks to natural
hazards through mitigation planning;
WHEREAS, the Federal Emergency Management Agency has implemented various
hazard mitigation planning provisions through regulation at 44.CFR 201.6 requiring local
governments to have a FEMA approved Local Mitigation Strategy (LMS) in order to apply for
and/or receive project grants;
WHEREAS, 44 CFR 20 1.6( d)(3) requires local jurisdictions to review and revise their
LMS to reflect changes in development, progress in local mitigation efforts, and changes in
priorities, and resubmit it for approval within five (5) years in order to continue to be eligible for
mitigation project grant funding;
WHEREAS, the representatives and staff of the City of Ocoee have identified, justified
and prioritized a number of proposed projects and programs needed to mitigate the
vulnerabilities to the impacts of future disasters; and
WHEREAS, these proposed projects and programs have been incorporated into the 2009
edition of the Orange County Local Mitigation Strategy that has been prepared and issued for
consideration and implementation by the communities of Orange County.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE AS FOLLOWS:
1. The City of Ocoee hereby accepts and approves its designated portion of the
Orange County Local Mitigation Strategy.
2. The staff of the City of Ocoee are requested and instructed to pursue available
funding opportunities for implementation of the proposals designated therein.
3. The City of Ocoee will, upon receipt of such funding or other necessary
resources, seek to implement the proposals contained in its section of the strategy.
4. The City of Ocoee will continue to participate in the updating and expansion of
the Orange County Local Mitigation Strategy in the years ahead.
5. The City of Ocoee will further seek to encourage the businesses, industries and
community groups operating within and/or for the benefit of the City of Ocoee to also participate
in the updating and expansion of the Orange County Local Mitigation Strategy in the years
ahead.
