Michael Rumer Ext. 1018 Reviewed By: Department Director: City Manager: Subject: 10-Year Water Supply Facilities Work Plan (Proposed Comprehensive Plan Amendments) Backaround Summary: In 2005 the Florida Legislature significantly changed Chapters 163 and 369 of the Florida Statutes (F.S.) by strengthening the relationship between District Water Supply Plans (DWSP) prepared by the Water Management Districts and the Comprehensive Plans prepared and maintained by local governments. According to The Wekiva Parkway and Protection Act, Chapter 369, Part III, F.S., each local government is required to amend its comprehensive plan to include an up-to-date 10-Year Water Supply Facility Work Plan to include an evaluation of the present and projected growth and water demand for a 1 O-year planning period. The City of Ocoee is located in West Orange County and is predominately located within the jurisdiction of the St. Johns River Water Management District (SJRWMD) with a southern portion of south Maguire Road which is located within the South Florida Water Management District. The City's updated 10-Year Water Supply Facility Work Plan and amendments to the Comprehensive Plan will be reviewed and approved by the Florida Department of Community Affairs and the SJRWMD. Over the past year, the City's consultant, SMW GeoSciences, has been working with SJRWMD on the development of the 10-year plan. The staff reviewer for SJRWMD has afforded the City the option of going through a pre-transmittal review of the 10-year plan and associated comprehensive plan amendments and has provided comments that staff has addressed. The 10-Year Water Supply Facility Plan and proposed amendments to the Comprehensive Plan are being presented to the Planning & Zoning Commission I Local Planning Agency for recommendation to the City Commission, followed by the first public hearing before the City Commission. Next the proposed amendments will be transmitted to the Department of Community Affairs for review and approval. After addressing any comments that may be received from the Department of Community Affairs or SJRWMD, the amendments will be presented to the City Commission for final adoption. Issue: Should the Honorable Mayor and City Commissioners consider adoption of an ordinance that includes: 1) Addition of a 10-Year Water Supply Facilities Work Plan by Reference to the Comprehensive Plan, 2) Additions to the Future Land Use Element, Conservation Element, Potable Water Sub-Element, Sanitary Sewer Sub- Element, and Intergovernmental Coordination Element, for the purpose of implementing the 10-Year Water Supply Facilities Work Plan, and 3) Direct staff to transmit the proposed amendments to the Department of Community Affairs (DCA) for review and comment? Recommendations: Development Review Committee (DRC) Recommendation: On June 2, 2010, the DRC met to review the proposed amendments to the Comprehensive Plan as proposed in the 10-Year Water Supply Facilities Work Plan. The DRC had a brief discussion on the wording of one proposed policy that conflicted with what the Land Development Code required. A subsequent change in wording was agreed to by staff. Based on the above discussions, the DRC recommended approval of the proposed amendments to the comprehensive plan as proposed. Planning and Zoning Commission: On June 8, 2010, the Planning and Zoning Commission acting as the Local Planning Agency met and reviewed the proposed Comprehensive Plan amendments as a public hearing (minutes attached) and voted unanimously to recommend the City Commission approve per staff's recommendation. Staff Recommendation: Staff recommends that the Honorable Mayor and City Commissioners consider adoption of Ordinance 2010- 015 to approve a Large-Scale Comprehensive Plan Amendment which includes: 1) Addition of a 10- Year Water Supply Facilities Work Plan by Reference to the Comprehensive Plan, 2) Additions to the Future Land Use Element, Conservation Element, Potable Water Sub-Element, Sanitary Sewer Sub-Element, and Intergovernmental Coordination Element for the purpose of implementing the 10- Year Water Supply Facilities Work Plan, and 3) Direct staff to transmit the proposed amendments to the Department of Community Affairs (DCA) and SJRWMD for review and comment. WHEREAS, on September 18, 1991, the City Commission of the City of Ocoee (the "Ocoee City Commission") adopted the City of Ocoee Comprehensive Plan pursuant to Chapter 163, Florida Statutes, as set forth in Ordinance No. 91-28, which has been amended from time to time (the "Comprehensive Plan"); and WHEREAS, pursuant to the provisions of Chapter 369, Part III, Florida Statutes, the Ocoee City Commission is required to amend the Comprehensive Plan to include an up-to- date 10-year water supply facility work plan for building potable water facilities necessary to serve existing and new development; and WHEREAS, the City has initiated an amendment to the Comprehensive Plan (the "Amendment") in order to (i) add the 10- Year Water Supply Facilities Work Plan by reference to the Comprehensive Plan, and (ii) add provisions to the Future Land Use Element, Conservation Element, Potable Water Sub-Element, Sanitary Sewer Sub-Element, and Intergovernmental Coordination Element for the purpose of implementing the 10- Year Water Supply Facilities Work Plan; and WHEREAS, on June 8, 2010, the City of Ocoee Planning and Zoning Commission, acting as the Local Planning Agency, at an advertised public hearing unanimously recommended transmittal of the Amendment to the Florida Department of Community Affairs (the "Department"); and WHEREAS, the Ocoee City Commission held advertised public hearings on August 3, 2010 and , 2010 in order to obtain public comment regarding the proposed Amendment; and ORLA_1590059.1 -1- WHEREAS, the Ocoee City Commission has considered all oral and written comments received during public hearings, including the recommendations of the Local Planning Agency; and WHEREAS, the Ocoee City Commission desires to adopt the Amendment as recommended by the Local Planning Agency with such changes thereto as the Ocoee City Commission deems appropriate. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS FOLLOWS: Section 1. Authoritv. The Ocoee City Commission has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Section Chapters 163, 166 and 369, Florida Statutes. Section 2. Incorporation of the to-Year Water Supplv Facilities Work Plan. The Ocoee City Commission hereby adopts the 10-Year Water Supply Facilities Work Plan as set forth in Exhibit "A" attached hereto and by this reference made a part hereof (the "Work Plan") and incorporates it into the Comprehensive Plan in its entirety. Section 3. Amendment to the Future Land Use Element. The Ocoee City Commission hereby amends Subsection XIII (Goals, Objectives and Policies) of the Future Land Use Element of the Comprehensive Plan to add new Policies as set forth on Exhibit "B" attached hereto and by this reference made a part hereof. Section 4. Amendment to the Sanitary Sewer Sub-Element of the Infrastructure Element. The Ocoee City Commission hereby amends Subsection V (Goals, Objectives and Policies) of the Sanitary Sewer Sub-Element of the Infrastructure Element of the Comprehensive Plan to add new Objectives and Policies as set forth on Exhibit "C" attached hereto and by this reference made a part hereof Section 5. Amendment to the Potable Water Sub-Element of the Infrastructure Element. The Ocoee City Commission hereby amends Subsection IV (Goals, Objectives and Policies) of the Potable Water Sub-Element of the Infrastructure Element of the Comprehensive Plan to amend existing Policies and to add new Policies as set forth on Exhibit "D" attached hereto and by this reference made a part hereof Section 6. Amendment to the Conservation Element. The Ocoee City Commission hereby amends Subsection IV (Goals, Objectives and Policies) of the Conservation Element of the Comprehensive Plan to amend existing Policies and to add new Policies as set forth on Exhibit "E" attached hereto and by this reference made a part hereof. Section 7. Amendment to the Inten!overnmental Coordination Element. The Ocoee City Commission hereby amends Subsection IV (Goals, Objectives and Policies) of the Intergovernmental Coordination Element of the Comprehensive Plan to amend existing Policies ORLA_1590059.1 -2- and to add new Policies as set forth on Exhibit "F" attached hereto and by this reference made a part hereof. Section 8. Public Particioation Procedures. The Ocoee City Commission hereby finds that the Amendment has been adopted in conformity with the Public Participation Procedures set forth in Section 10 of the Comprehensive Plan. Section 9. City Commission's Desie:nee. The Ocoee City Commission hereby designates the Director of Community Development as the designee of the Ocoee City Commission to transmit this Amendment to the Department and to advise the Department regarding the dates on which the City held the required public hearings. Section 10. Transmittal to the Department. The Ocoee City Commission hereby authorizes and directs that three (3) copies of the adopted Amendment be submitted to the Department within ten (10) days of the effective date of this Ordinance. Section 11. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 12. Effective Date. This Ordinance shall become effective on the tenth (10111) day after passage and adoption. City of Ocoee 1 a-Year WSFWP 1.0 INTRODUCTION According to The Wekiva Parkway and Protection Act, Chapter 369, Part III, Florida Statutes (F.S.), each local government in the Wekiva Study Area is required to amend its local government comprehensive plan to include an up-to-date 1 a-year water supply facilities work plan. This update must incorporate the building of any potable water facility, if necessary, to serve existing and new development planned for the next ten years. The Act authorizes the development of the Wekiva Parkway and provides for the protection of the Wekiva River System. The mandated 1 a-year water supply facilities work plan is specifically developed to address the following items: . Projects for raw water supply; . Projects for water supply treatment, storage, and distribution facilities; and . Water conservation and reuse. The updated Water Supply Facilities Work Plan and amendments for the Comprehensive Plan will be reviewed and approved by the Department of Community Affairs (DCA) and the S1. Johns River Water Management District (SJRWMD). Pursuant to the Act, the City of Ocoee has retained SMW GeoSciences Inc. for assistance in preparing their 1 a-year Water Supply Facilities Work Plan. This work plan includes an evaluation of the present and projected growth and water demand as well as an analysis of the existing production/treatment facilities and their capacities to meet the City's existing and projected water demands for a 1 a-year planning period. 2.0 BACKGROUND INFORMATION 2.1 Location The City of Ocoee is located in west Orange County, Florida, southeast of Lake Apopka. The location of the City is shown in Figure 1. 2.2 Service Area and Water Supply Related Agreements A map presenting the City's Joint Planning Area UPA) and utility service areas (potable water, and wastewater), City limits and Joint Planning Area is included as Figure 2. The City's potable water and wastewater service areas share the same boundary. The City's reclaimed water service area is the same as the incorporated City limits. The City of Ocoee and Orange County have been coordinating with one another based upon the 1987 Joint Comprehensive Planning Area Interlocal Agreement, amended February 11, 1994. SMW GeoSciences, Inc. - 1 - City of Ocoee 1 a-Year WSFWP The City has the following territorial agreements regarding utility services: . Orange County/City of Ocoee Water Service Territorial Agreement (Contract No. W-88- 06), dated November 14, 1988, amended February 11, 1994. . Orange County/City of Ocoee Sewer Service Territorial Agreement (Contract No. S-87- 8), dated June 8, 1987, amended February 11, 1994. The City's JPA establishes Ocoee's annexation limits, and the territorial agreements establish the water and sewer service limits between the City of Ocoee and Orange County. Pursuant to these agreements, Orange County provides potable water and wastewater services to parcels located outside of the City's potable water and wastewater service areas. Note the City's JPA and water and wastewater service area do not match. Additionally, the City's potable waterlwastewater service area overlaps the City of Winter Garden's utility service area along the western boundary. The City of Winter Garden also has JPA and utility territorial agreements with Orange County; however, since Winter Garden or Ocoee are not a party of the other's agreements with Orange County and do not have mutual agreements with each other, there is no procedure for determining whether Ocoee or Winter Garden would provide water or sewer service to any property owner requesting service in any areas that may overlap with the above agreements. Therefore, the population calculations for this CUP renewal application and this Work Plan do not include the parcels in the overlapping areas. The City may revise its CUP to include water demands from these parcel at a later time, when the service provider is established for these areas. This 1 a-Year Work Plan provides potable water demands, water sources and required infrastructure to meet the projected water demands for City of Ocoee water customers. To remain consistent with the City's CUP, this document will refer to the City's utility service area as the potable water service area (PWSA) unless otherwise referenced. As previously discussed, pursuant to the water and sewer territorial agreements, water and wastewater services for parcels located outside of the City's PWSA are provided by Orange County. Projected water demands for these parcels are included in the Orange County 1 a-Year Water Supply Facilities Work Plan pages A-15, A-16, B-4 and C-4 dated May 19,2009. In addition to the JPA and territorial agreements, the City of Ocoee has three (3) other agreements related to water supply. Reclaimed water service for residential and commercial customers located south of SR 50, along Maguire Road and Winter Garden Road, is provided by the City of Ocoee pursuant to the Water Conserv II Agreement dated May 23, 2001. This agreement is for the wholesale purchase of up to 2.1 mgd of reclaimed water for Public Access Reuse landscape irrigation for City customers. The City has one inter-local agreement with the City of Winter Garden, dated May 4, 1999. In this agreement, the City of Ocoee agreed to accept up to 0.75 mgd of reclaimed water for golf - 2 - City of Ocoee 1 a-Year WSFWP SMW GeoSciences, Inc. course irrigation at the Forest Lake Golf Course. In addition, Winter Garden agreed to accept up to 0.25 mgd of wet weather discharge from the City of Ocoee. The City also has an agreement with Forest Lake Golf Course to provide reclaimed water for irrigation. On December 3, 1991, the City entered into a 99-year ground lease agreement with Forest Lake Golf Course, LLC. The agreement included a provision that the City provide reclaimed water for golf course irrigation for the duration of the agreement. This agreement was most recently amended on Apri I 21, 2009. 3.0 DATA AND ANALYSIS 3.1 Water Sources Groundwater is currently the City of Ocoee's primary water source. Groundwater wells are used to extract water from the Floridan aquifer to supply potable water to City customers. Although a small portion of the City limits and JPA are located outside of the SJRWMD boundary, the entire potable water service area (PWSA) and wells are located within the SjRWMD boundary. Therefore, the City of Ocoee is permitted to withdraw groundwater though the SjRWMD's Consumptive Use Permitting Program under CUP 3216. The City also utilizes reclaimed water for irrigation where feasible. Reclaimed water is available from the City of Ocoee's Wastewater Treatment Plant (A.D. Mims WWTP) for use within the City's PWSA. 3.2 Consumptive Use Permit The City of Ocoee is currently in the process of renewing its Consumptive Use Permit (CUP) 3216. Although the CUP expired on December 10, 2006, the City continues to operate under a timely application submittal while the application is under review by the SjRWMD. The CUP allocates the City a maximum annual groundwater withdrawal of 1,580.5 MGal (4.33 mgd) for the public supply system until the CUP renewal is complete. A CUP application was submitted to the District on December 6, 2006 and a Request for Additional Information (RAI) was issued to the City on january 3, 2007. Subsequent responses and RAls have been submitted and issued respectively since. As it is not anticipated that the City will receive its CUP prior to finalization of this Work Plan, the most recent water demand projections submitted to the District through the RAI process are included in this document. 3.3 Potable Water Production and Treatment Facilities The City currently provides potable water to City customers located within the PWSA from two (2) existing water treatment plants (WTP): 1) the Forest Oaks Plant and 2) the South Plant. The location of each WTP is illustrated in Figure 3. In the past, an additional WTP known as the jamela Plant was utilized for potable water service. In 2005, the jamela Plant was taken offline and the associated supply wells have been abandoned and plugged per SJRWMD criteria. - 3 - City of Ocoee 1 O-Year WSFWP SMW GeoSciences, Inc. 3.3.1 Forest Oaks WTP The Forest Oaks Plant is located in the northeast area of the City's utility service area, along Hackney-Prairie Road. The WTP presently has three (3) existing wells for public supply type use, two Lower Floridan aquifer wells and one upper Floridan aquifer well. The City is currently proposing one (1) additional Lower Floridan aquifer well, Well #4, to replace Well #1. The proposed public supply well is included in the CUP application that is currently under review at the District. Well information is presented in Table 1. The well locations are shown in Figure 4. The treatment capacity of the plant is 5.227 mgd. 3.3.2 South Plant The South Plant is located in the south portion of the City's utility service area just south of the Florida Turnpike, off of Maguire Road. This WTP presently has three (3) existing Lower Floridan aquifer wells for public supply type use. In 2006, two Lower Floridan aquifer wells existed at this plant. A third lower Floridan aquifer well was constructed in 2007; however this well is not in use at this time. It is anticipated that Well #3 will come online in 2017. The treatment capacity of the plant is 5.623 mgd. 3.4 Alternative Water Sources 3.4.1 Wastewater Treatment Plant The City of Ocoee operates one wastewater treatment plant (WWTP), the A.D. Mims WWTP, which also serves as the City's reuse facility. The location of the WWTP is presented in Figure 6. The plant is designed to treat 3.0 mgd and has a current effluent capacity of 1.80 mgd. Effluent disposal at the AD. Mims WWTP is accomplished by: o Public Access Reuse for City customers o Irrigation of Forest Lake Golf Course o Application to onsite Rapid Infiltration Basins (RIBs) o Application to Forest Lake Golf Course RIBs 3.4.2 Forest lake Golf Course Reclaimed Water Agreement The City has one large reclaimed water customer, Forest Lake Golf Course. This agreement was originally executed December 3, 1991, and most recently amended on April 21, 2009. Based on the amended agreement, the City is contractually obligated to provide 0.45 mgd of reuse to the Forest Lake Golf Course for golf course irrigation for the remainder of duration of the lease agreement. 3.4.3 Reuse As previously discussed, the City's reclaimed water service area (RWSA) and incorporated City limits share the same boundary. The reclaimed water master plan is presented in Figure 7. The City has two sources of reclaimed water available for Public Access Reuse at this time: reclaimed water from the AD Mims WWTP and reclaimed water from Conserv II. Reclaimed water from the A.D. Mims WWTP is utilized within the City's PWSA. Reclaimed water from Conserv II is currently utilized within the RWSA, south SR 50, along the Maguire Road and Winter Garden Road corridor. It is the City's intent to divert reclaimed water from Conserv II for use within the City's PWSA via a new pipe/interconnect on White Road. This interconnect project will include the construction of 4,800 ft of reclaimed water pipe and will allow the City to divert up to 1.0 mgd of the 2.1 mgd of reclaimed water available - 5 - City of Ocoee 1 O-Year WSFWP SMW GeoSciences, Inc. from Conserv II to the City's PWSA. Construction for this interconnect is expected to begin summer 2010. The City does not provide reclaimed water to the portion of the RWSA north of the PWSA. The City may provide a lower quality water source (reclaimed water or other AWS) for irrigation to this area in the future; however, no lower quality waters source is available at this time nor is it expected to be within the 1 a-year planning period of this document. As previously discussed, water service for residents located outside of the City's PWSA is provided by Orange County pursuant to the Orange County/City of Ocoee Water Service Territorial Agreement (Contract No. W-88-06), dated November 14, 1988, amended February 11, 1994. Water demands for these residents are included in Orange County's 1 a-Year Water Supply Facilities Work Plan. Table 3 presents the projected reclaimed water availability for Public Access Reuse for the 1 a-year planning period for properties located with the City's potable water service area (PWSA). Reclaimed water service for properties located south of the City's PWSA is provided through an agreement between the City of Ocoee and Conserv II. The City has two AWS projects identified in the 2005 District Water Supply Plan, Ocoee Reuse System SMW GeoSciences, Inc. - 6 - City of Ocoee 1 O-Year WSFWP Expansion Project (Project No. 37) and the City of Ocoee Northwest Reuse Re-Pump Station and Interconnection Mains Project (Project No. 84). The Reuse System Expansion Project consisted of retrofitting the following subdivisions: Waterside, Silver Glen, the Reflections and the Reserve to provide reclaimed water service to approximately 752 residential homes. This project was completed in fall 2007. The City has identified a Re-Use Pump Station and Interconnect Mains Project (Project 84) in the District's Water Supply Plan as part of its efforts to implement AWS. The project description from the District Water Supply Plan 2005, 4th Addendum, is provided below. Project number: 84 Project name: City of Ocoee Northwest Reuse Re-Pump Station and Interconnection Mains Project Project sponsor(s): City of Ocoee Project type: Reuse Purpose: The purpose of this project is to increase availability of reclaimed water for distribution. Water source: Reclaimed water Water use/destination: Landscape irrigation in Ocoee and vicinity Quantity of water to be made available: 1.20 mgd Estimated construction cost: $2,300,000 Project components: This project consists of construction of reclaimed water transmission pipelines and pump stations Construction of this project has not begun since it is dependant on an agreement for the wholesale purchase of reclaimed water from Orange County. The City is currently working with Orange County on the agreement; however, no agreement has been reached at this time. Note that Project No. 84 will only be constructed if an agreement between the City and Orange County is reached. The City has also attended the District-sponsored regional water supply meetings but has at this time deemed the proposed projects as not feasible based on cost and proximity to the City. The City is committed to the development of AWS and will continue to explore potential AWS projects with other utilities. Since cost and distance from the alternative source playa critical role in the feasibility of the project, the City is exploring the possibility of a long-term wholesale purchase agreement of reclaimed water from utilities within close proximity of the City. The City and Orange County have been and are currently negotiating a long term contract for a retail/wholesale agreement for the County to provide reclaim water to the City for use within the City's reclaim service area. It is the City's intent to continue the negotiations with Orange County, explore other locally available alternative water sources and continue to participate in regional planning of alternative water supply projects. - 7 - City of Ocoee 1 O-Year WSFWP SMW GeoSciences, Inc. The City is also reviewing small scale stormwater reuse projects where feasible, on a project by project basis for commercial landscape and residential common area irrigation. 3.5 Water Use and Population Projections 3.5.1 Water Use for 2009 According to water usages reported to the SJRWMD (EN50s), the City of Ocoee's total year- end groundwater use for 2009 was 1,331.6 Mgal (3.65 mgd). Raw water pumpage from the Forest Oaks WTP and the South WTP were estimated to be 666.08 Mgal (1.82 mgd) and 665.52 Mgal (1.82 mgd) respectively. In addition, according to Daily Monitoring Reports submitted to FDEP, 334.69 Mgal (0.92 mgd) of Public Access Reuse was used for urban landscape and residential irrigation. 3.5.2 Population Projections Population projections presented in this work plan were generated in cooperation with the City's planning consultant and the District's consultant, GIS Associates, Inc., but have been adjusted to reflect the current decline in the rate of new home construction. Population projections have been reviewed by SJRWMD for consumptive use permitting requirements but have yet to be finalized by the District. When the CUP is issued to the City of Ocoee, the DCA will be provided a copy of the CUP, and at that time, modifications to this report may be necessary depending on permitted groundwater withdrawals. 3.5.3 Projected Water Demands The City of Ocoee's water demand projections were obtained from the City's current CUP application. Projected water demands are presented in Table 4. The City does not serve retail customers outside of its municipal limits. City of Ocoee water customers only. 2. The City estimates water service is provided to 45 homes (served population of 135 persons) located outside of the City limits. 3. Projected water demands take water conservation into account. The City is located within the Central Florida Coordination Area; therefore, no additional groundwater withdrawals can occur after 2013. The City will use reclaimed water from the A.D. Mims WWTP and reclaimed water from Conserv II and supplemental alternative water sources (AWS) to meet the additional water demands after 2013. 3.6 Capacity Analysis The City of Ocoee's water supply facilities were assessed to determine whether the projected five-year and ten-year demands can be met. In 201 a, the City's water treatment plants had a combined well production capacity of 12.24 mgd. When the proposed well at the South WTP comes online in 2017, the well production capacity will increase to 17.28 mgd. Well production capacity was calculated by maximizing daily pumpage for each City well, excluding the well with the highest pump capacity. The existing permitted treatment capacity for the combined water treatment plants, Forest Oaks WTP and South WTP, is 10.85 mgd. SMW GeoSciences, Inc. - 9 - City of Ocoee 1 a-Year WSFWP Based on the analysis, the City's existing water supply facilities are sufficient to meet the projected five-year and ten-year water demands. A summary of the analysis is provided in Table 5. The most recently adopted CIP, adopted in September 2009, does not reflect recent changes to water and reclaimed water project updates that are included in the City's updated Utility Department 10 Year Capital and Project Schedule. Projects identified in the Utility Project Schedule will be included in the updated CIP, which is scheduled to be adopted September 2010. A copy of the City's Utility Department 10 Year Capital and Project Schedule for water and reclaimed water is included as Attachment 1. The City does not have any projected well or treatment capacity deficiencies for the 5-year planning horizon. For the 5-year planning horizon, the following water projects have been identified: . Forest Oaks Water Plant SCADNPLC Replacement The City is committed to AWS development and has identified funding for AWS and continued implementation of reclaimed water for Public Access Reuse landscape irrigation. At this time, SMW GeoSciences, Inc. - 10- City of Ocoee 1 O-Year WSFWP design for the White Road reclaimed main is being finalized and construction is expected to begin summer 2010. Project costs for reclaimed water extension along White Road are included in the fiscal year 2009/2010 budget. Additional projects indentified in the 5-year planning horizon for AWS development include: . Alternative Water Supply Planning Study (evaluation of available reclaimed water sources from surrounding municipalities) . Maguire Road Reclaim Pumping Facility (1.0 mgd storage tank to meet peak demands and provide storage to allow up to 1.0 mgd of reclaimed water to be diverted to the PWSA) . Reclaimed Water Retrofits (Lake Olympia subdivision) . Reclaimed Watermain Extensions 1. Kennsington Manor 2. McCormic Road 3. Forest Brook to Westyn Bay connection It is important to note that the Kennsington Manor, McCormic Road and the Forest Brook to Westyn Bay reclaimed main extensions will be constructed only if the City enters into an agreement with Orange County for the wholesale purchase of reclaimed water; therefore, for these projects the City has identified bonds as the revenue source. If the City does not enter into an agreement with Orange County, these projects will be postponed and re-evaluated at a future date, when reclaimed water or other lower quality water source is available. The City does not have any projected well or treatment capacity deficiencies for the 1 a-year planning horizon. For planning years 6 through 10, the City has identified the following water and reclaimed water related projects in the Utility Budget: o North-side Potable Repump Facility and Ground Storage Tank . Connect Existing South WTP Well #3 to the Plant and Existing Tank Aeration Tray Modification . South WTP High Service Pump Change-out/additions to VFDs (#1 and #6) . Forest Oaks Well #2 or New Well Project . Annual Water Plant Minor Repairs and Upgrades . Water Line Upsize Associated with Development . Fire Hydrant (Replacement and New Hydrants) .. WWTP Ground Storage Tanks (Tanks #1 and #2) . Reclaimed Water Retrofits (Westmere Phase I and II, The Hammocks, Cross Creek Phases I and II) The City will continue to evaluate water and reclaimed water projects indentified in this Work Plan as well as other projects that may be necessary to meet projected water demands and will update the Utility Budget and ClP accordingly. 5.0 FUTURE WATER SUPPLY PLANS. In order to promote the efficient use of water and offset groundwater withdrawals, the City of Ocoee has committed to various alternative water supply plans. These include: 1) continuation of SMW GeoSciences, Inc. - 11 - City of Ocoee 1 a-Year WSFWP water conservation practices, 2) expansion of the reclaimed water distribution system and 3) pursue AWS partnerships. 5.1 Water Conservation Practices The City has implemented a variety of conservation programs to protect and conserve the Floridan Aquifer. As time progresses, the City plans to maintain these conservation programs and where possible, improve upon them. For the 10-year period of this Work Plan, the City will focus on the following conservation strategies: o Maximize the use of existing sources and supplies, eliminating unnecessary uses and developing plans for managing water shortages Conservation Policy 7.1 The City shall maximize the use of existing sources and supplies, eliminating unnecessary uses and developing plans for managing water shortage. Intergovernmental Coordination Policy 1.6 The City will continue to coordinate with the Orange County School Board, the East Central Florida Regional Planning Council, St. johns River Water Management District, the South Florida Water Management District and other State or Federal agencies and any other special districts on projects that fall within their "jurisdictions" or are multi-jurisdictional in "nature" to identify and resolve any conflicts with the City's Comprehensive Plan, and in turn, amend the plan as needed to ensure coordination. Intergovernmental Coordination Policy 3.8 The City shall coordinate with the St. johns River water Management District, Orange County and other local governments or private utilities to develop efficient, cost-effective, and technically feasible water sources that will satisfy and supplement future demands without causing adverse impacts to water quality, wetlands, aquatic systems or the environment. The City will continue to attend regional water planning seminars, committee meetings, and conferences in support of regional water planning in itiatives. Proposed Intergovernmental Policy The City shall maintain and revIse as necessary the following agreements: . Joint Planning Area Agreement . Proposed Future Land Use Policy The City shall issue no development orders or development permits without first seeking assistance with the applicable utility (Orange County or City of Ocoee Utilities Department) to determine whether adequate water supplies to serve the development will be available no later than the anticipated date of issuance by the City of a certificate of occupancy or equivalent. The City will also ensure that adequate water supplies and facilities are available and in place prior to issuing a certificate of occupancy or its functional equivalent. Proposed Potable Water Policy The City shall identify additional potable, non-potable and alternative water supply sources and facilities required to provide adequate services to existing and future development consistent with the Future Land Use Element. - 17- City of Ocoee 1 O-Year WSFWP SMW GeoSciences, Inc. 5.4 Water Source Protection Practices For the lO-year period of this Work Plan, the City will continue to focus on the following waters source protection practices: . Protect the quality of all surface water bodies and groundwater quality Conservation Objective 2 The City shall protect the quality of all surface water bodies and groundwater quality Conservation Policy 2.1 The City shall regulate development activities to protect natural water-cleansing features and reduce or prevent discharges of contaminants from urban and agricultural land uses through the land development regulations. The land development regulations include provisions such as (but not limited to) the use of such natural features in the treatment of storm water runoff, limitations on destruction of native vegetation and/or land clearing within such natural features, and maintenance of upland buffers and/or environmental swales within a minimum width of twenty-five (25) feet surrounding such natural features. For the purposes of this policy, natural features shall include DfP jurisdictional wetlands (9j-5.013(2)(c)(3), FAC). Conservation Policy 2.2 The City shall ensure the protection of groundwater sources by restricting Commercial and Industrial future land uses known to adversely affect the quality and quantity of identified water sources within wellhead protection areas, existing cones of influence, and aquifer recharge areas. In addition, other land use activities such as hazardous waster facilities, fuel storage facilities, and groundwater injection wells known to adversely affect the quality and quantity of groundwater sources will be prohibited within wellhead protection areas, existing cones of influence, and aquifer recharge areas Conservation Policy 2.3 As of the effective date of this Comprehensive Plan, future development, as defined by the Ocoee Land Development Code, shall not occur within 25 feet of an approved 1 DO-year floodplain elevation or jurisdictional wetland boundary except where exempted by State Statute or in cases where offsetting on-site environmental mitigation or enhancement of these areas is demonstrated to improve natural functions or to provide low-impact uses or recreational amenities which encourage enjoyment of such areas. Conservation Policy 2.4 The use of septic tanks in developments and redevelopments shall be permitted in accordance with Chapter 10-0-6 FAC to prohibit septic tanks in flood plains, CONSERVA nON ELEMENT CPA- SMW GeoSciences, Inc. - 18 - City of Ocoee 1 O-Year WSFWP 2002-7 -7 5- 33 wetlands, areas adjacent to lakes and in areas designated with soils unsuitable for septic tanks. Potable Water Objective 2.1 Ocoee will continue to set procedures and mechanisms established to ensure a safe and acceptable withdrawal rate from the aquifer, meeting the needs of the City. Potable Water Policy 2.1.3 The City Engineer shall coordinate with Water Management Districts to closely monitor the drilling of new wells, enforce the capping of abandoned wells, and require the placement of valves on existing free flowing wells so water will be used only as required. The City will also ensure that adequate water supplies and facilities are available and in place prior to issuing a certificate of occupancy or its functional equivalent. -6- EXHIBIT "C" (Amendments to the Sanitary Sewer Sub-Element of the Infrastructure Element) Sanitary Sewer Obiective 2.3 The City shall continue to promote the use of reclaimed water and other alternative water supply sources to reduce groundwater use for irrigation Sanitary Sewer Policy 2.3.1 The City shall require the installation of dual-line distribution systems for all new developments if applicable. Sanitary Sewer Policv 2.3.2 The City shall require the use of alternative water sources for irrigation, including reclaimed water and surface/stormwater, at sites with existing dual-lined systems and on existing groundwater sources for irrigation when alternative sources becomes available. The City shall maintain a Water Conservation Program that meets the requirements of the SJRWMD CUP and implement the Water Conservation Plan submitted as part of the CUP process. The Water Conservation Plan shall be updated as necessary to ensure that the programs address customer water use habits. Such management plans shall include but are not limited to: adoption of a water emergency conservation ordinance consistent with the recommendations of the water management districts, distribution of information on water conservation practices, and review of codes relative to water conservation practices. Intere:overnmental Coordination Policv 1.12 The City shall work with the Water Management Districts, during updates to their regional water supply plans and water supply assessments as well as other water-supply related initiatives facilitated by the Districts that affect the City. -11- MINUTES OF THE JOINT MEETING BETWEEN THE COMMUNITY REDEVELOPMENT AGENCY (CRA) BOARD AND PLANNING AND ZONING COMMISSION ACTING AS THE LOCAL PLANNING AGENCY HELD TUESDAY, JUNE 8,2010 CALL TO ORDER Chairman Campbell and Chairman Vandergrift called the joint meeting to order at 7:01 p.m. Following a moment of silent meditation and the Pledge of Allegiance to the Flag, a quorum was declared present for both boards. PRESENT: Chairman Sills, Vice Chair Golden, Members Campbell, Conkling, Dillard, McKey, Morris, and West. Also present were City Attorney Rosenthal, CRA Administrator Wagner, Development Services Director Shadrix, Senior Planner Howell, Principal Planner Rumer, and Deputy City Clerk Sibbitt. Chairman Vandergrift, Vice Chair R. Johnson, Board Members Hood, Wilsen, Keller, Corless, and C. Johnson. ABSENT: Member De La Portilla was absent unexcused. City Attorney Rosenthal explained the presentation that would be presented tonight and explained why this was a joint meeting. He further stated following the CRA meeting, the Planning and Zoning Commission (acting as the LPA) will continue their meeting to allow the actual actions aDd'public hearings. The CRA Members are invited and encouraged to stay through the public hearing process of the LP A. CRA TARGET AREAS SPECIAL DEVELOPMENT PLAN Development Services Director Shadrix stated it has been almost a year since they started the CRA process and they now have something before them that they are ready to take through this iterative process of adoption. They have a good document before them that will do a lot of things for the city but is in no way in final form so they are expecting some really good dialogue as they move through the process up to adoption. He further stated that this special development plan for the CRA target areas is intended to provide a more streamline process for a majority of stakeholders and they have met with most of the stakeholders in each of the target areas. One of the overwhelming majority issues has been that they do not want to go through a lengthy PUD process so they are all trying to figure out how they can get to the same point, which is getting a good street network in. Development Services Director Shadrix explained they are looking to get a mechanism in place so they can guide high quality development so that they can create the type of mobility based network that the city wants. He further explained Planning and Zoning Commission Meeting June 8, 2010 the importance of the growth patterns in the city, green field areas, and the interim steps the city will be taking. Frances Chandler-Marino stated she is with AECOM and is very happy to be back to speak with everyone about the special development plan. She further explained that the process was as much about collaboration as it has been about planning. When they came to initiate the process about a year ago they had a very aggressive schedule that they wanted to meet, partially because the city was seeing a lot of development activity and people who wanted to come in wanted an easier way to go through the process. Ms. Chandler-Marino explained this was a long process because it was about getting it right and she further presented her power-point presentation which is attached for review. Overview of the presentation included the following: ~ Project Outcomes ~ CRA Project Area ~ Community Participation Process ~ CRA Framework Plan ~ Transportation Network ~ Open Space ~ Land Use Strategy ~ Target Area Opportunities ~ Regulatory Construction - (Phase 1) CRA Impact Area Special Development Plan, (Phase 2) Form-based Regulations ~ CRA Target Areas - Three (3) areas ~ Recommendation/Next Step After the presentation, City Attorney Rosenthal stated his recommendation is for the CRA Board to handle all staff level questions before it goes before the Planning & Zoning Commission as a Public Hearing. CRA Board Member Keller stated in the 3rd target area he noticed that they could basically pick and choose what they wanted to put in there and inquired if there was a limit to how much of anyone type they could pick and choose. Ms. Chandler-Marino stated that there is a limit because the land use is still establishing the maximum limits for that area. What they were trying to do because of the multiple land uses in that area was trying not to be so parcel oriented about it. They still do have the cap in the land use and zoning but it would now just apply to the whole of the area instead of just a piece of it. City Attorney Rosenthal stated that Board Member Keller's question is specifically addressed in the ordinance that the Planning & Zoning Commission and City 2 Planning and Zoning Commission Meeting June 8, 2010 Commission have in the section entitled "Underlying Zoning". It indicates that the underlying zoning remains in effect so there will not be a need for any rezoning; however, for each parcel within the target areas they can basically mix horizontally and vertically and move around within the property the uses based upon an agreement between the land owner and the city. He further explained that section of the ordinance as well as the comprehensive plan that is in effect. CRA Board Member Keller stated in target area 2 it seems they are looking more at roads but the rest of areas as long as they kept the grid pattern it seems they can move to accommodate what they are looking at doing. Ms. Chandler-Marino stated it really is about connections and there is nothing about setting an alignment for those roads. CRA Board Member Keller commented that he really likes the 16ft. sidewalks. CRA Board Member C. Johnson inquired what the next step would be in going into the approval process. City Attorney Rosenthal briefly explained the public hearing process, overlay mapping process, and noticing all individual property owners within the three (3) target areas. He further explained that as mentioned in the presentation this is in some respect an interim step so there will be some unanswered questions, but they have provided in the ordinance a process for a resolution of answered questions which they think will also protect the rights of the property owner's. He briefly explained the process the land owner would be able to take should they disagree with their interpretations. CRA Chairman Vandergrift inquired about the first reading being a public hearing and also what would stop them from going to a second reading. City Attorney Rosenthal stated that it falls within the particular statute of the Florida Statutes which requires two advertised public hearings and two readings of the ordinance. CRA Chairman Vandergrift further inquired if the option was available should they have any objections to any of the target areas (1, 2, and 3), to be able to adopt and move forward with just 1 and 2 or 2 and 3. City Attorney Rosenthal stated that would be within the legally permissible options available to either the Planning & Zoning Commission or the City Commission. CRA Board Member C. Johnson stated there are some clauses in the ordinance that specifically state these provisions are made applicable to all development and redevelopment within the CRA target area. She further added that they define the CRA target area as both unincorporated and incorporated areas, so she would like to know how that would effect unincorporated parcels and whether it may be better not to reference unincorporated parcels in this exercise. City Attorney Rosenthal stated she is correct and in the ordinance under Section A5, it states that any land located within the CRA Target Area but are in unincorporated 3 Planning and Zoning Commission Meeting June 8, 2010 Orange County, the ordinance does not apply. He further explained that what they try to do is as those lands are annexed into the city, they will give them notice before they annex that they will be subject to the regulations. He briefly spoke about the Hawthorne Property off of Maine Street which was annexed into the City but is not within the CRA. CRA Board Member C. Johnson stated there is no specific reference to the JPA and was inquiring if it would be appropriate at a minimum to be mentioned. City Attorney Rosenthal stated the JPA only really relates to land comprehensive plan amendments and they are not making any amendments to the comprehensive plan. They did not really view this as a JPA issue but if the county has some questions about that, they do not have any concerns and would be happy to add a recital regarding consistency with the JPA. CRA Board Member Corless commented that they are moving forward toward the goals that they set forth in the CRA several years ago. She further inquired as why there is no discussion on uses for area 3 but there are for areas 1 and 2. City Attorney Rosenthal stated they did clarify that in the ordinance. The ordinance has the prohibited uses as being specifically applicable to all of the target areas. CRA Administrator Wagner stated that on page 69 there is a paragraph under zoning regulating plans but he realizes there is a typo since it should read: "Target Area 3 shall conform to the prohibited uses..." CRA Board Member Corless inquired if they had specific break out sessions with target area 2 because she did not recall seeing it in the presentation. Development Services Director Shadrix stated that they had a lot of meetings and discussion with the stakeholders in target area 2; not in the same formal way as they had with areas 1 and 3. He further stated of the 114 meetings he has had over the last several months, a number of them occurred in many of the target areas. He believes in order to balance it out and be more consistent, he certainly would welcome a sit down collective meeting with target area 2 landowners to work on individual issues. Development Services Director Shadrix briefly pointed out the differences of the target areas. CRA Board Member Corless inquired if they would have another chance to make comments as it relates to the height, develop form, and other issues that provide the framework as they go through the process of the development and adoption of the form-based code. Ms. Chandler-Marino stated the answer is yes and what they had envisioned as well as the city is that in the form-based code they would really get into the regulations and clarify all of the internal inconsistencies. She further stated this is partially why Craig wanted to have some interim steps. Development Services Director Shadrix added that the code has been both their friend and their enemy and with this time table that they are on, now is the appropriate time to start thinking about collective consensus. 4 Planning and Zoning Commission Meeting June 8, 2010 Member McKey stated that transportation has been mentioned several times and he was wondering if the CRA board has addressed or looked into the light rail system and whether West Oaks Mall would be the trail head or the target areas. CRA Board Member Keller stated he believes we are about twenty years out before they have us possibly getting a light rail system. He further stated he does not recall any real discussion with it from the CRA point of view and does not believe at this point that it has been put through onto the plans. CRA Board Member C. Johnson stated that she works closely with Lynx and also through the MetroPlan process and she knows that with Lynx they are initiating their long range study to identify the bus rapid transit corridors which will be the precursor to the longer term vision for rail. The SR 50 corridor is one of those workforce corridors and they feel it will be prudent to keep that in mind as it relates to the CRA planning efforts. CRA Board Member Corless added that as they go through the form-based code they can reinforce transit oriented developments and that they are actually helping support our redevelopment activities so they are set- up to receive transit in the future. Development Services Director Shadrix commented that he is glad that these issues were brought to light because these questions are excellent building blocks for long range planning for the City of Ocoee. He further briefly discussed transportation and the possibility of a joint meeting with Winter Garden regarding rail. Member West commented that the CRA has done a heck of a job and it is really exciting to see what they have done. Vice Chair Golden stated he has heard that this urban design will not really have a market to in fill. He further inquired if they have looked at other markets as well as how does staff feel with the grid they would be putting over the properties to in fill development. Ms. Chandler-Marino stated they would have to look at all the target areas differently because it was not one type of standard that applied to all of them. She further reviewed each target area and explained the design regulated for that area. Vice Chair Golden stated the list of prohibited uses looks similar to the activity center uses but is more expanded. He further inquired as to how they developed this list. CRA Administrator Wagner explained that the list prohibits more suburban highway commercial types of uses and reflects uses that they have already put into development agreements to create a more urban character development. Member Sills commented that that this is a beautiful project but he knows it will require a lot of funding for this which may include options such as a bond, property tax increase, or a fire fee. CRA Board Member R. Johnson stated in the last year or two they have had economic development problems but one of the things that will help is to push this process. He further stated he feels they are far way ahead of other areas for doing what they are doing with the CRA. They need to look at the long view of 5 Planning and Zoning Commission Meeting June 8,2010 what is happening and since the developers are almost all in favor of this, he feels it is something they should be proud of. ADJOURNMENT The CRA Board adjourned at 8:22 p.m. Planning & Zoning Commission Meeting continued. Vice Chair Golden stated he noticed the traffic intersection access for many of the target areas were not at the major intersections that abuts those target areas and inquired as to why it was done that way. Ms. Chandler-Marino stated there is a good State Department of Transportation reason for that since they limit how close you can have access points to your major intersection and they adhered to all state regulations when they cited the access points. The Public Hearing was opened Shaman Foradi, 1575 Maguire Road # 102, stated he is here on behalf of American Land Developers and the owners of the Orange Plaza. He further spoke in favor of the CRA approval explaining they would like to go along with the city's vision and the urban design which they feel will attract people to this area. Scott Glass, Shutts and Bowen, LLP, addressed the board on behalf of his clients who stated that no one has ever met with them. He further stated there is a letter that was provided to the city and is included in the board's packet which addresses their concerns. Mr. Glass further explained his client's concerns and stated they are requesting to defer consideration and adoption of the CRA Target Area 2 Special Plan Overlay until they are able to reassemble the stakeholders in that area to address those concerns and requests they may have. Randy June, 132 W. Plant Street, thanked staff for the process and stated he voices some of the similar concerns that Mr. Glass presented but they do not want to stop the approval of Target Area 2. He further stated they are ready to move forward and look forward to meeting with the others in that area. Development Services Director Shadrix stated that he agrees with the comments presented by Scott Glass and Randy June. He further stated they have been very gracious with being up front with them and he does agree with some of the points made in the letter by Mr. Glass. Development Services Director Shadrix stated he feels it is a good time to get the Target Area 2 group together and have some dialogue. Chairman Campbell clarified that Mr. Shadrix will be meeting with Target Area 2 prior to the 2nd Reading. Development 6 Planning and Zoning Commission Meeting June 8, 2010 Services Director Shadrix stated that he wants to reiterate that they have had a lot of meetings individually one on one with different stakeholders in Area 2 and will commit to calendaring some defined timelines. The Public Hearing was closed DISCUSSION Member McKey thanked all staff, consultants, public, and CRA members since he can recognize their efforts and time that they have all spent on this. He further stated he is in favor of this and would like to keep it rolling. Member Dillard stated the one thing he has not heard is how this dovetails with the adjacent property owners not in the target areas so that this looks seamless. Ms. Chandler-Marino stated while these plans just speak for the Target Areas when they do a form-based code one of the things they find most useful about it is that it is able to do a couple of things that this level of planning can not do. She further explained phasing in and addressing the adjacency to redevelop without being over burdensome. Vice Chair Golden stated this is a great plan but he wanted to caution that they do not water down the plans too much in these final negotiations going toward approval and adoption. He feels they should really stick to what the city wants and envisions for these areas while guiding the developers. He further commented that since these are green field sites there is an opportunity to have really nice parks. Member Sills thanked CRA Administrator Wagner and consultants for doing a fantastic job. Chairman Campbell stated this is a tremendous amount of work and really shows where a lot of people have put a lot of thought in the vision of where we want the City of Ocoee to go in the next 20-25 years. He further stated he feels they have an opportunity to raise the caliber of what Central Florida thinks of Ocoee as a City. Motion carried unanimouslv. 7 Planning and Zoning Commission Meeting June 8, 2010 CONSENT AGENDA Minutes of the Planning and Zoning Commission Meeting held on Tuesday, April 13, 2010. Member West, seconded bv Member Sills, moved to accept the Minutes of the April 13. 2010. Plannina and Zoning Commission meetina. Motion carried unanimouslv. OLD BUSINESS - None NEW BUSINESS RT OCOEE, LLC - REZONING Senior Planner Howell gave a brief presentation on the subject property stating the applicant is requesting to rezone the property from 1-2 to 1-1 (Restricted Manufacturing & Warehousing). He further explained that the rezoning is being requested to permit a wholesale/internet vehicle sales location where customers will be invited onto the premises by appointment only. The applicant has agreed to place limitations in regards to operation on the property in an effort to limit traffic impacts to the site. These use limitations include: no transport trucks on site; and, only wholesale or internet used vehicle sales. Rezoning the property to 1-1 to permit the proposed use is logical, given that it is adjacent to several automotive related uses and since there are several areas in the City where used car sales are permitted. Additionally, it is anticipated the proposed rezoning from 1-2 to 1-1 will result in a less intense use than can currently be permitted on the property with the 1-2 zoning designation. DISCUSSION Member McKey stated he is curious as to how the vehicles will be transported if there is a restriction allowing large carrying type vehicles onto the premises. The Public Hearing was opened Thomas Skelton, American Civil Engineering Co., stated they agree with staff comments and to answer Member McKey, each car will be driven individually to the site and the sale will be by appointment only. Chairman Campbell inquired if the sales would be high end or specialty type vehicles. Robert Thomas, representative for the owner, answered it would be any and all motor vehicles within a reasonable size. Chairman Campbell clarified that any and all vehicles would be up to and including motor homes. Mr. Thomas stated that it would not include motor homes. 8 Planning and Zoning Commission Meeting June 8, 2010 Ed Newman, 553 Roper Parkway, stated that what Mr. Thomas is trying to do is being done now throughout the industrial area. He further stated others have been refused to rezone their property to retail. Mr. Newman stated in 1989 and 1993 he tried to change his zoning on his property and was denied. He commented that he feels that retail needs to be in a retail area and the area of the subject property is in a wholesale area. He further explained his objections. Senior Planner Howell interjected that there will be a development agreement that will address use limitations, such as: no transport trucks on site. Robert Thomas stated they have a comprehensive agreement with the city on what can and can not be done. He further stated they have also provided the city with a copy of their leases, which require no mechanical work, no transport or unloading, and no complete detail work. It also stipulates that their sale can not be any more than the 90% wholesale and 10% retail, which the retail will generate off the internet. Mr. Thomas further explained this property will be a place for people to have offices to be able to display 4-6 cars (depending on the size) inside and outside. They may possibly have 100-150 cars a week that leave and come back but as he mentioned this is all written in his lease agreement which goes with the use of the land. Member Sills stated that he mentioned he would have cars on the lots for display for sale and it seems to him that it is a retail lot rather than an internet wholesale. Mr. Thomas stated the concept of the vehicles being there is that people come to the auction on Tuesday and now they will have a place close by where they can fill a load with; it will be a wholesale operation. They need the retail internet part because they feel you should have some way to be able to work with both and he feels the 10% is fair. Member Conkling inquired how his business will coexist with a large whole sale auction such as the Florida Auto Auction near by. Are they not both investors doing the same business in that area? Mr. Thomas stated they are but they purchase from the auction, individuals, and car dealers and have been in the car business since 1976. Member Dillard inquired from staff how the 90%/10% would be enforceable. Senior Planner Howell stated the only mechanism they have to enforce that is through the development agreement. He further stated it is stipulated under the agreement with them but they can not physically go out and watch what they are doing on the internet. City Attorney Rosenthal stated that as a practical matter if they had a complaint or it became apparent that there was a lot of traffic and public going in/out then it may be something the city could monitor. There are no reports that get submitted to the city, it is a condition that would be violated and if it is violated it is enforceable by specific performance. Mr. Thomas stated that if DMV has those figures available then it is something that 9 Planning and Zoning Commission Meeting June 8, 2010 can be provided to the city without a problem. Member McKey stated it lookslike this property is adjacent to an 1-1 zoned property. Senior Planner Howell stated that the property across the street is 1-1 as well. Member Conkling asked for Mr. Thomas to please explain the transporter process. Paul Bruegger, 601 Roper Pkwy, stated that the transport trucks are unbearable, they leave oil and they come at night. He stated he will be directly across the street from this. He stated he knows Mr. Thomas and he is a business man, if he can do what he says he is going to do then he does not have a problem. Dennis Jones Sr., 651 Roper Pkwy, stated he has owed property in Ocoee for an excess of 37 years and he has never been able to retail cars off his property. He further stated as late as this year they have been turned down to retail cars as well as his tenants who lease a space from him. Mr. Jones further voiced his objections to the rezoning of 1-2 to 1-1 of the property across the street from his and added since they have been denied for a retail license then he feels it does not need to be done now. Mr. Newman stated that as Mr. Tomas mentioned they will have 150 cars a week; however, the way the property is laid out they have an average of 40 parking spots, with 20 employees, plus the owner, secretary, and receptionist. Where are all the cars supposed to go? Mr. Thomas stated that if they divide approximately 140 cars a week by 7 days, they would only have 20 cars a day on the property. Mr. Bruegger expressed his concern to Mr. Thomas about not detailing cars on the property. The Public Hearing was closed Member Conkling stated they have heard from several of the owners here who have stated that they were denied retail licenses and was wondering if staff could state whether or not that was accurate. Senior Planner Howell stated he is not aware of that and some of the issues were before his time with the city dating back approximately 20 years ago but he can check and see if any formal applications had been submitted. Vice Chair Golden inquired if they could add in the development agreement that the DMV transaction report be submitted to the city annually so they can refer to it. City Attorney Rosenthal stated that is easy to add into the development agreement. Member McKey inquired how they would control the truck issue. Senior Planner Howell stated other than what is in the development agreement if they receive complaints they can refer them to Code Enforcement. City Attorney Rosenthal added that if the complaint is in the public street they can refer that to the Police Department. A brief discussion ensued regarding the transport vehicle that would be used to deliver/pick-up 10 Planning and Zoning Commission Meeting June 8, 2010 vehicles. Senior Planner Howell stated the site plan is still under review so staff could ask the engineer of record to demonstrate that no transport trucks would be able to go on site including smaller car carriers such as F250's. Member Sills stated he feels they are opening a can of worms by changing the zoning from 1-2 to 1-1 and is not in favor of it. He feels they may suddenly get others on Roper Parkway wanting to change their zoning and soon it will be a retail sale in an industrial park. Member Sills. seconded bv Member McKey, moved to recommend to the Citv Commission denial of the proposed rezoninq of RT-Ocoee. LLC. Project #RZ-09- 11-08. After a brief discussion. motion failed 4-4. Member McKey. seconded bv Vice Chair Golden, moved to recommend to the Citv Commission approval of the proposed rezoninq of RT-Ocoee. LLC. Project #RZ-09-11-08 with the condition that the DMV report be filed with the citvon an annual basis and subject to the execution of a development aareement when the ordinance comes before the Citv Commission. Motion carried 5-3. ~ 10-YEAR WATER SUPPLY FACILITIES WORK PLAN - PROPOSED COMPREHENSWEPLANAMENDMENTS Principal Planner Rumer gave a brief presentation stating that according to the Wekiva Parkway and Protection Act, Chapter 369, Part III, FS, each local government is required to amend its comprehensive plan to include an up-to-date 10-Year Water Supply Facility Work Plan to include an evaluation of the present and projected growth demand for a 1 O-year planning period. Over the past year, the City's consultant has been working with SJRWMD on the development of the 10-year plan. Staff reviewer for SJRWMD has afforded the City the option of going through a pre-transmittal review of the 10-year plan and associated comprehensive plan amendments and has provided comments that staff has addressed. DISCUSSION Vice Chair Golden inquired if any maps in the comprehensive plan were updated since it is not shown in the Policy 2.2. Principal Planner Rummer stated they had map updates to the comprehensive plan that dealt with aquifer recharge or class "An soils but not to well heads. A brief discussion ensued regarding well head protection areas. 11 Planning and Zoning Commission Meeting June 8, 2010 Member McKey commented that in the document it states they allow 10% of the water to be lost and he feels that is horrid in this day and needs to be tightened up. Utilities Director Smith explained that the 10% loss is not uncommon and they are required to do some of the flushing. They do have a little bit less loss but that is just a goal that was established. The Public Hearing was opened. As no one wished to speak, the Public Hearing was closed. Vice Chair Golden, seconded bv Member McKev. moved to recommend to the Citv Commission the approval of: 1) addition of a 10- Year Water Supplv Facilities Work Plan bv reference to the Comprehensive Plan. and 2) additions to the Future Land Use Element.
