HomeMy WebLinkAbout07-27-2010 Minutes MINUTES OF THE CITY OF OCOEE CODE ENFORCEMENT BOARD MEETING JULY 27,2010 CALL TO ORDER Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order at 7:02 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation and Member Lowery led the Pledge of Allegiance to the Flag. The roll was called and a quorum was declared present. PRESENT: Chairman Godek, Vice Chair M. Godek, Members Alexander, Hopper, Lowery, Osborne, Alternate Member Arney, and Alternate Member Kelley. Also present were Code Enforcement Officer Loeffler, Code Enforcement Officer Delgado, Code Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Fire Inspector Sorenson, Administrative Assistant Ballard, Attorney Segal-George, and Deputy City Clerk Sibbitt. ABSENT: Member Sais was absent excused. GUESTS: None. Administrative Assistant Ballard administered the oath to the Code Enforcement Officers, Fire Inspector, and anyone intending to speak regarding a case. Jeremy Bellis stated he went before the City Commission at their last meeting and the City is looking to help create an amendment in the code that would help with exceptions. He came before the board tonight so he can ask for an extension so that fines do not accrue starting August 13th. Chairman Godek inquired if they gave him a timeline. Mr. Bellis stated that he spoke with Principal Planner Mike Rumer who was to get with Development Services Director Craig Shadrix and Deputy Fire Chief Butch Stanley so they could meet and create an exception. Member Hopper inquired if Deputy Chief Stanley would be able to give his recommendation on the matter at hand. Officer Siegrist stated Deputy Chief Stanley is not in tonight but he can speak for the city and ask for an extension until the next CEB meeting. Member Hopper stated he would still like to hear from Deputy Fire Chief Stanley to see what the City plans are for this property. Member Osborne stated the respondent was also cited for no tag and inquired if that was a violation as well. Officer Siegrist stated for a trailer it is not a violation. A brief discussion ensued on how to handle the extension of compliance for the case. Attorney Segal-George stated it would take quite some time to pass an ordinance should an amendment be made to the code. She further stated the appropriate course would be to extend this to the next CEB meeting and request that the Deputy Fire Chief be present so that he could give the board further guidance. Officer Siegrist gave a brief history of the case providing exhibits and further stated, as of today, the property is in non-compliance; however, additional progress has been made. Chairman Godek inquired if this was a complaint or drive by observation. Officer Siegrist stated it was a citizen complaint. Member Alexander inquired as to when they anticipate being in compliance. Richard Wilson stated that he would like to request a 60 day extension. Member Osborne inquired as to why it would take 60 days. Mr. Wilson stated that Joel Buckley is the one having to do the work and he was recently in a car accident which has caused some medical problems which requires several doctor appointments. He further stated they have come a long way and believes that the anonymous citizen complaint is Joel's ex- wife since they were in a bitter divorce. Officer Delgado gave a brief history of the case providing exhibits and further stated, as of today, the property is in non-compliance. She stated some of the debris is gone but the pool is still green and dirty. Catherine Hall stated that she is in between houses and what is being called debris is actually items that are being moved from one house to the other. She further stated most of the items have been moved out of the driveway. The pool is dirty because the pump is broken and she was told if she drains the pool it may crack. Member Hopper inquired if she owned the house. Ms. Hall stated she does right now but she is working with the bank to see if she can refinance. Vice Chair M. Godek inquired if anyone had suggested to her to shock the pool. Ms. Hall stated that shocking the pool would have to be a continual process and she does not see a problem with the pool since it is screened and the door is locked, so there should not be any danger unless someone trespasses, Member Hopper stated that if she were to throw shock in the pool that would bring her into compliance. He further stated for $3-$6 worth of shock she could be in compliance for at least a month. Chairman Godek stated the whole concept is to bring the pool in compliance and debris out of the yard. Ms. Hall argued that she does not understand why this is an issue since the pool is not going to be used and throwing shock into it would be costly to only make the pool look pretty. Vice Chair M. Godek stated that they just want to know if she will/will not clean up the pool. A brief discussion ensued regarding what time frame would be needed to bring the property into compliance. Officer Delgado stated that she has spoken with Ms, Hall and was willing to work with her but Ms. Hall was not willing to speak with her about a resolution. Member HODDer. seconded bv Vice Chair M. Officer Delgado gave a brief history of the case providing exhibits and further stated, as of today, the property is in non-compliance of 165-3. Member Hopper inquired if there are residents in the home. Officer Delgado stated that since several of the violations were corrected she contacted the HOA president who told her that someone was living in the home; however, she personally has not spoken with a tenant. Member Osborne inquired if this would still be the same complaint since the original vehicle she observed is gone and there is a new vehicle in its place. Officer Delgado stated she is citing the tenants for the violation and this vehicle falls under the same violation since it also has flat tires; whether it is a blue truck or a white truck is not the issue. Attorney Segal- George explained that 165-3 does not specify a particular vehicle and she further read the code to the board. She explained that if they choose too they could find the respondent in compliance with regards to what was originally cited and then cite them separately to give them specific notice with regards to the current vehicle. Vice Chair M. Godek and Member Hopper both felt precedent has been set by this board and they should continue to rule based on the violation that was cited. Member Osborne, seconded bv Member HODDer. moved in Case No. 10-132 to find the respondents in violation as cited as of June 8,2010, but in compliance of 165-4, 115-3. 115-5 and 115-6 as of Julv 27, 2010: but still in violation of 165-3, and be $liven until August 17, 2010 to complv or be fined $100/per day thereafter. Fire Inspector Sorenson gave a brief history of the case and further stated, as of July 22, 2010, the property was in compliance. The City's administrative cost is $433.42. Member Osborne inquired as to why this cost was so much higher than the last case he presented. Fire Inspector Sorenson stated that he realized after the fact that the administrative cost he gave for Case No. 10-138 was incorrect. The actual cost to the city was $441 and he mistakenly stated $141. Member Osborne, seconded bv Vice Chair M. Godek, moved in Case No. 10-165 to find the respondents in violation as cited as of June 14, 2010. but in compliance as of Julv 22, 2010, and the respondent pav the fine of$500. Attorney Segal-George stated she is not aware of how they have handled mistakes in testimony in the past, however, should they want to re-hear Case No. 10-138 to allow the Officer to give the correct testimony they can make a motion to do so. Fire Inspector Sorenson stated that he wanted to clarify that the administrative cost for this case is $441.80. He accidently testified that the amount was $141.80 which was not correct. The city is asking to abate the nuisance by removing the debris and securing the home. Member Osborne inquired if the windows were still broken. Officer Loeffier stated they were still broken but a screen is over the windows which makes it secure. Vice Chair M. Godek inquired if it looked like any progress was being made with the rest of the violations. Officer Loeffler stated no and the lawn mower is still sitting in the front yard. Godek. moved in Case No. 10-169 to find the respondent in violation as cited as of Julv 12,2010, in compliance of 165-3 and 168-4 A as of Julv 14, 2010, and be $liven until August 13, 2010. to come into compliance with 115-3. 115-5. and 108-35 or be fined $200/per dav per violation. Officer Rodriguez gave a brief history of the case providing exhibits and further stated, as of today, the property is in non-compliance. Staff is requesting the board to allow the city to remove the vehicles from the property. Chairman Godek inquired why these violations were not brought to the board before, Officer Rodriguez stated this was brought to the board before but it was never requested by staff that they remove the cars. Member Hopper inquired as to how long the Cadillac as been up on jacks because a resident is allowed to work on his car within a reasonable time frame. Officer Rodriguez stated it has been that way for a long time. She further advised that this is not a repeat violation case because the violations she cited were not used in the past so it has to be treated as a new case. Alternate Member Amey inquired if the respondent has called her. Officer Rodriguez stated that he did call and asked for a 6 months extension; however, these cars have been there since 2006 and the city does not believe more time will help. Officer Loeffier reminded the board that this is the respondent that is paying a $1 a month on his previous fines. Officer Rodriguez stated the City wants to tow the vehicles on July 29th at 8 a.m. Attorney Segal-George briefly explained the violations that they board needed to make a motion on. Member Osborne, seconded bv Vice Chair M. Godek, moved in Case No. 10-170 to find the respondents in violation as cited of 165-3 and 165-4 as of Julv 15, 2010. and be $liven until Julv 28. 2010. end of business dav (5 p.m.) to come into compliance or be fined $200/per dav per violation thereafter. Also authorize the Citv to abate the nuisance using codes 165-7, 165-8, and 165-9 and add the cost to the fine. Motion carried unanimouslv. OTHER BUSINESS Case No. 10-105 - Alberto R.
