(District 3 - Johnson) Background Summary: The City was required to relocate its utility facilities crossing under Florida's Turnpike, as a result of its obligations under the Florida DOT right-of-way utilization permit that allowed the crossing, when that agency decided to widen the Turnpike. This work required of the City included removal of a 12-inch water main and a 12-inch sanitary sewer force main. In addition, the project included installation of a replacement sanitary sewer force main at a greater depth. No replacement water main was immediately necessary, as there are two other crossings of the Turnpike connecting southern Ocoee to the rest of the city, but additional capacity will be necessary eventually to support growth. In order to reduce the cost of the work, the City elected to retain the services of the Turnpike's construction contractor, Ranger Construction Industries, Inc., rather than hire a separate company to do the work. The savings offered by this approach were derived from the ability to utilize existing maintenance of traffic resources and to avoid coordination overhead. It also had the unintended consequence of allowing a considerable delay in the need to remove the water main from service, as that potential conflict would not need to be addressed until late in the project. As a result, the completion schedule was extended for over two years, and the water main was able to remain in service. Recently, the Turnpike's staff concluded that sufficient cover would remain above the pipeline to reduce the risk of pipeline failure to an acceptable level, so it is no longer necessary to remove the water main. In addition to allowing the 12-inch water main to remain in service, this change will permit the City to use the 30-inch carrier pipe for installation of a larger water main later. Issue: The Engineering Department proposes that the City Commission approve a change order that will reduce the contract price by an amount equal to the cost savings of not removing the water main. Recommendations The Engineering Department recommends that the City Commission approve a reduction in the cost of this project equal to the amount of savings provided by deleting the water main portion of the work ($40,479.78) from the contract with Ranger Construction Industries. The contract time period was also extended to recognize the period of time when the work was ongoing. REQUIRED CHANGES This project included removal of a 12-inch water main and a 16-inch sanitary sewer force main crossing under Florida's Turnpike along the east side of Maguire Road in order to accommodate the Turnpike widening project. In addition, the project included installation of a replacement sanitary sewer force main at a greater depth. No replacement water main was to be provided, as there are two other crossings of the Turnpike connecting southern Ocoee to the rest of the city. This change order reflects the subsequent decision to keep the water main in service due to their being sufficient separation being retained between the pipeline and the Turnpike's travel surface. II. JUSTIFICATION This project addressed the need to remove two City utility mains from service and to install a replacement for one of those pipelines at a greater depth in order to accommodate the widening of Florida's Turnpike. In order to reduce the cost ofthe work, the City elected to retain the services of the Turnpike's construction contractor, Ranger Construction Industries, Inc. rather than hire a separate company to do the work. III. NARRATIVE OF NEGOTIATIONS Change order pricing is the original bid price for the avoided work of removing the existing water main where it could be accessed in the shoulder areas and sealing the carrier pipe with grout where it was under the travelway. The reduction in contract price reflects the decrease in quantity for the three pay items related to removing the water main and/or rendering it inert within the Turnpike right of way. IV. APPROV AL AND CHANGE AUTHORIZATION This proposed change to the Contract is to be approved by the City Commission of the City of Ocoee, as it requires additional budget be allocated to the project. The aforementioned changes, and work affected thereby, are subject to all provisions of the original contract not specifically changed by this Change Order. It is expressly understood and agreed that the approval of the Change Order shall have no effect on the original contract other than matters expressly provided herein. CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the adjustments in Contract Price and Time shown hereon constitute full and complete compensation and satisfaction for all costs and modifications of performance time incurred by CONTRACTOR as a result ofthis Change Order. No other claim for increased costs of performance or modifications oftime will be granted by OWNER for the Work covered by this Change Order.
