Background Summary:
The West property is located on the north side of Palm Drive, between East Crown Point Road and SR 429.
The subject site is approximately 8.89 acres in size and is zoned R-1 (Single-Family Dwelling). The property is
currently vacant and undeveloped. The table below references the Jurisdiction, Future Land Use, Existing Land
Uses and Zoning of the surrounding properties.

The applicant/owner is requesting a Small-Scale Comprehensive Plan Amendment which consists of classifying
the subject parcel of land from "Low Density Residential" to "Light Industrial." The subject property came before
the Local Planning Agency back in November 2008, as part of a Large Scale Comprehensive Plan Amendment.
The Large Scale Comprehensive Plan Amendment did not proceed after the meeting. The rest of the properties
involved received a Large Scale Comprehensive Plan Amendment from Orange County with Ocoee's support.
This Small Scale Amendment will amend the Land Use of the final 8.89 acres.
SITE ANALYSIS:
Floodplain Impacts:
Based on FIRM map number 12095C021 OF, the site does not lie within the 100 year floodplain.
Wetland Impact:
Based on the PUD Land Use Plan, associated analysis, and City of Ocoee wetland map, there is a small ditch
that is considered jurisdictional wetlands. Compliance with the Land Development Code and Comprehensive
Plan regarding development within and around the area is required.
EndanQered and Threatened Wildlife:
Based on a threatened and endangered wildlife study and a species of special concern survey performed by
Bio-Tech Consulting Inc., and Stillwater Technologies Inc, the only listed species found on the site was the
gopher tortoise. Resolution of the gopher tortoise issue will need to be permitted through FFWCC prior to any
construction activities.
Utilities:
The site is located within the City of Ocoee utility service area and is proposing to connect to public utilities for
water and sewer. There is an existing 12" water main running along the south side of Palm Drive and an 8"
forcemain running along the north side of Palm Drive. Approval of the proposed water and sewer utility plan is
required prior to the approval of the final subdivision/site plan.
Transportation / Traffic:
The proposed PUD accesses East Crown Point Road and Palm Drive. East Crown Point Road and Palm Drive
has a measured Level-of-Service "C". Neither roadway is programmed for improvements in the County or City
of Ocoee 5-Year Capital Improvement Program.
Schools:
No school impacts are proposed since the proposed use is Light Industrial.
Public Safety:
The nearest Fire Department is approximately 1.7 miles from Station Number 1, located at Bluford Avenue. The
estimated response time is 2-4 minutes. The Police Station is located 1.4 miles from the subject property. The
estimated response time is 3 minutes.
Drainaoe:
The subject site is located within the Apopka Drainage Basin and therefore must meet the requirements of
Section 11.7 (a) SJRWMD Management and Storage of Surface Water Handbook and Wekiva Study Area
BMP's. Design of the drainage system will be evaluated in more detail prior to final engineering approval.
Recreation and Open Space:
No impacts on recreation facilities are proposed. The applicant will be required to provide thirty (30) percent
open space.

Issue:
Should the Honorable Mayor and City Commissioners approve an ordinance for a Small-Scale Comprehensive
Plan Amendment from "Low Density Residential" to "Light Industrial" for the West property?
Recommendations
DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION:
The Development Review Committee (DRC) met on 10/29/2008 to determine if the subject parcel's land use
designation of Light Industrial was appropriate for the area. The DRC voted to recommend the City Commission
proceed with staff's recommendation.
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The proposed Small Scale Land Use Amendment was reviewed at a Public Hearing by the Planning and
Zoning Commission on September 14, 2010. The Planning & Zoning Commission voted unanimously to
recommend approval of the Small-Scale Comprehensive Plan Amendment from "Low Density Residential" to
"Light Industrial" for the West property.
STAFF RECOMMENDATION:
Staff recommends that the Honorable Mayor and City Commissioners approve an ordinance for a Small-Scale
Comprehensive Plan Amendment from "Low Density Residential" to "Light Industrial" for the West property.

AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA AMENDING THE
OCOEE COMPREHENSIVE PLAN AS ADOPTED ON SEPTEMBER 18, 1991
BY ORDINANCE NO. 91-28, AS AMENDED, AS FOLLOWS: AMENDING
THE FUTURE LAND USE MAP TO REDESIGNATE FROM "LOW DENSITY
RESIDENTIAL" TO "LIGHT INDUSTRIAL" CERTAIN REAL PROPERTY
CONTAINING 8.89 ACRES (MORE OR LESS) LOCATED NORTH OF AND
ADJACENT TO PALM DRIVE AND WEST OF AND ADJACENT TO ST ATE
ROAD 429, PURSUANT TO THE APPLICATION SUBMITTED BY THE
PROPERTY OWNER; PROVIDING FOR AND AUTHORIZING THE
REVISION OF THE OFFICIAL FUTURE LAND USE MAP; PROVIDING
FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE,
FLORIDA, AS FOLLOWS:
SECTION 1. In adopting this Ordinance the City Commission of the City of Ocoee,
Florida ("City Commission") hereby makes, expresses, and incorporates the following findings,
purposes, and intent:
a. On September 18, 1991, the City Commission adopted a new Comprehensive
Plan pursuant to Chapter 163, Florida Statutes, which has been amended from time to time
("Ocoee Comprehensive Plan").
b. The Property Owner initiated Amendment Number SSCPA-_-_ in order to
amend the Future Land Use designation of its property.
c. Amendment Number SSCPA-_-_ constitutes a Small Scale Comprehensive
Plan Amendment within the meaning of Section 163 .3187( c), Florida Statutes.
d. On Septernber 14, 2010, the Planning and Zoning Commission of the City of
Ocoee, Florida, acting as the City of Ocoee Local Planning Agency held an advertised public
hearing and recommended adoption of Amendment Number SSCPA-_-_.
e. On October 5, 2010, the City Commission held an advertised public hearing and
adopted Amendment Number SSCPA-_-_.
f. All required public hearings have been held after due public notice in accordance
with Chapter 163, Florida Statutes, and Sections 1-8 and 1-10 of Article I, of Chapter 180 of the
Code of Ordinances of the City ofOcoee ('Ocoee Land Development Code").

SECTION 2. The City Commission has the authority to adopt this Ordinance pursuant
to Article VIII of the Constitution of the State of Florida, Chapters 163 and 166, Florida Statutes,
and Section 1-8 of Article I of the Ocoee Land Development Code.
SECTION 3. The Future Land Use designation as set forth on the Future Land Use Map
of the Ocoee Comprehensive Plan of the following described parcel of land containing
approximately 8.89 acres located within the corporate limits of the City of Ocoee, Florida, (the
"Property") is hereby changed from "Low Density Residential" to "Light Industrial."
SEE EXHIBIT "A" (METES AND BOUNDS LEGAL DESCRIPTION)
ATTACHED HERETO AND BY THIS REFERENCE MADE A PART
HEREOF.
A map of the Property is attached hereto as EXHIBIT "B" and by this reference is made a part
hereof.
SECTION 4. The City Planning Director is hereby authorized and directed to revise the
Official Future Land Use Map of the City of Ocoee as set forth in the Ocoee Comprehensive
Plan to incorporate Amendment Number SSCPA-_-_ consistent with the provisions of this
Ordinance.
SECTION 5. If any section, subsection, sentence, clause, phrase, or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and
such holding shall not affect the validity of the remaining portion hereto.
SECTION 6. This Ordinance shall become effective on the 31 st day after passage and
adoption if no affected person has filed a petition with the Division of Administrative Hearings
in accordance with Section 163.3187(3), Florida Statutes. If such a petition is timely filed, this
Ordinance shall become effective on the date the Department of Community Affairs or the
Administrative Commission issues a final order determining that the adopted Amendment
Number SSCPA-_-_ is in compliance.
