General Location: The property is located on the southwest corner of Silver Star Road and Bluford Avenue.
Parcel Identification Number: 18-22-28-1360-02-010
Physical Address: 33 W. Silver Star Road (Units 33 & 35)
Property Size: Land area for the entire shopping center parcel is approximately 5.87 acres. However, the
requested Special Exception project area totals 1,669 square feet.
Actual land use, proposed land use and unique features of the subiect property:
The "0coee Plaza" Shopping Center contains a variety of business such as: Tropic Save Supermarket, Family
Dollar, Los Primos Restaurant, Franco's Pizzeria, Money Pawn, Hair Salon and H&R Block. The subject unit
spaces (storefronts) are vacant and adjacent to each other, and both are situated on the north side of the
Shopping Center. The Applicant has proposed to convert these two spaces into one church space. The Future
Land Use designation for this entire property is "Commercial" with a current zoning classification of "C-2"
Community Commercial.
The table below references the future land uses, zoning classifications and existing land uses of the surrounding
parcels:

According to "Table 5-1: Permitted Use Regulations" contained in the Ocoee Land Development Code, Church
uses are a Special Exception in the following zoning classifications: R-1, R-1A, R- 1AA, R-1AAA: Single Family
Dwelling, R-2: One & Two Family Dwelling, R-3: Multiple Family Dwelling, RT-1: Mobile Home Subdivision, C-1
Neighborhood Commercial, C-2: Community Commercial, and C-3: General Commercial.
The Land Development Code defines Special Exception as a use that would not be appropriate without
restrictions throughout the zoning division or district. However, if controlled as to number, area, location or
relation to the neighborhood, would promote the public health. safety. welfare, morals, order, comfort,
convenience, appearance, prosperity or general welfare, such uses would be appropriate. (Emphasis added).
In accordance with Section 4-8.B. (2) of the Land Development Code, the proposed use must be considered in
relation to the compatibility with the surrounding land uses. As previously mentioned, the adjoining land uses are
commercial. Also, the Church is not proposing to establish a school or child care facility beyond what is used for
a typical Sunday service. Based on this, the use is anticipated to be compatible with the surrounding uses in the
proposed location.
Additionally, the proposed use is not anticipated to:
. Violate the health, safety, welfare, and/or convenience of those working or owning land in the vicinity of
the proposed use or structure
. Impair pedestrian or vehicular movement in adjoining streets so as to violate adopted level of service
standards
. Result in noise, odor, glare, vibration, or other similar characteristic which is detectable at the property line
and which exceeds the level which will result from permitted uses
. Prevent an adjoining landowner from the legal use of his property pursuant to the Land Development
Code
. Violate a requirement of limitation of any applicable state or federal law or regulation
. Exceed the applicable density or bulk regulations except as specifically authorized, nor shall the use or
structure result in overcrowding of land or buildings
. Create a fire hazard
Issue:
Should the Mayor and City Commissioners approve a Special Exception to allow the City of Hope Church in the
unit spaces 33 & 35 within the A & 0 "0coee Plaza" Shopping Center?
Development Review Committee Recommendation:
The Development Review Committee (DRC) met on August 31, 2010 and reviewed the Special Exception
application and corresponding Site Plan. There were some minor technical changes to the Site Plan that were
presented via written memorandums. All of the changes were discussed and agreed upon by the Applicant.
There was also some further discussion on existing alcohol sales in the Shopping Center and its proximity to the
proposed Church location. Consequently, the Applicant was made aware that the location of the proposed church
may preclude other alcohol sales from locating in the Shopping Center.
When the discussion was finished, the DRC voted unanimously to recommend approval of a Special Exception to
allow the City of Hope Church in unit spaces 33 & 35 within the A & 0 "0coee Plaza" Shopping Center, subject to
resolving the outstanding staff comments before the P&Z Commission meeting.
Subsequent to the ORC Meeting, the applicant has submitted a revised site plan that incorporates the changes
that were agreed upon at the ORC meeting.
Planning & Zoning Commission Recommendation:
The Planning and Zoning Commission reviewed the proposed Special Exception application and corresponding
Site Plan on September 14, 2010. City Staff presented a brief summary and overview of the requested actions.
City Staff and the Applicant (Pastor David Young) answered several questions regarding the church activities,
number of expected members and the impact of future business regarding the sale of alcoholic beverages. In
addition, the Planning and Zoning Commission raised the issue of property owner notification letters should be
increased to 1000 feet in order to match the 1000 feet alcoholic separation requirement per Ordinance 2003-33.
Currently, the adopted notification letters requirement is 300 feet for all land use actions. The City Attorney
advised the P&Z Commission that it would take a Land Development Code Amendment to change this
requirement. As a result, the Planning & Zoning Commission agreed to discuss recommending a Land
Development Code Amendment to the City Commission at the next P&Z Commission meeting. There was no one
from the public to speak regarding this proposal.
After finishing its deliberations, the Planning & Zoning Commission voted unanimously to recommend approval of
a Special Exception to allow the City of Hope Church in unit spaces 33 & 35 within the A & 0 "Ocoee Plaza"
Shopping Center.
Staff Recommendation:
Based on the recommendation of the DRC and Planning & Zoning Commission, Staff recommends that the
Mayor and City Commissioners approve the Special Exception to allow the City of Hope Church in unit spaces 33
& 35 within the A & 0 "Ocoee Plaza" Shopping Center.
