DISCUSSION The subject property is located on the southeast corner of the intersection of West Road and Ocoee - Apopka Road. It is approximately 9.3 acres in size. The subdivision plan proposes the construction of infrastructure for a three lot commercial subdivision. The table below references the future land uses, zoning classifications and existing land uses of the surrounding parcels: Direction Future Land Use Zoning Classification Existing Land Use North Commercial Planned Unit Development PUD Fountains West development East Low Density Residential Orange County Agricultural Single- family residence South Light Industrial Orange Count C -3 Nightclub use West Commercial C -2 (Community Commercial) Vacant The Preliminary /Final Subdivision Plan for the West Road Commercial Subdivision proposes the construction of infrastructure for a three lot commercial subdivision. The total acreage is 9.3 acres. Lot 1 is proposed at 2.12 acres and has frontage along West Road and Ocoee - Apopka Road. A Walgreens drug store is proposed for construction on Lot 1. The Walgreens is a Small -Scale site plan and is currently being reviewed by staff. Since it is a Small - Scale Site Plan, it is not required to be presented to the Planning & Zoning Commission or City Commission for final approval. Lot 2 is proposed at 1.02 acres, and Lot 3 is proposed at 1.07 acres. Lots 2 and 3 have frontage along Ocoee - Apopka Road. The subdivision will be accessed via a full access point adjacent to the southernmost portion of the development on Ocoee - Apopka Road. Additionally, a right -in /right -out between Lots 1 and 2 on Ocoee - Apopka Road, and a right -in /right -out on the easternmost portion of Lot 1 on West Road will be provided for access. A cross - access easement will be provided across all three lots. Stormwater will be contained within a master stormwater pond. Approximately 4.01 acres of the site will be preserved in a Conservation Area that is noted on the plan as Tract "A ". Within this tract is a Bald Eagle nest. A permit was obtained by the applicant from the Florida Fish and Wildlife Conservation during the review of the Fountains West PUD that specifies a distance around the nest reserved for a "No Construction Zone." The area that is reserved for the No Construction Zone is noted as a 142 -foot radius on the Fish and Wildlife permit and is shown as such on the plan. There are approximately 2.46 acres of wetlands on the property that will be preserved within the Conservation Area. The Environmental Assessment that was submitted indicates there will be impacts to 0.12 acres of less than average quality wetlands and 0.45 acres of impacts to surface water impacts to upland cut ditches that are located on Lot 1. These ditches have been utilized to convey runoff from the property and are not considered to be wetlands. A total of 2.34 acres of wetland area will remain on the property. A 25 -foot upland buffer will be provided around the wetlands. Per the Comprehensive Plan, the 0.12 acres of wetlands that will be impacted by the effects of the development will be mitigated at a 2 to 1 ratio. Two wetland areas consisting of a total of 0.24 acres will be created in the Conservation Area to mitigate the impacts to the existing wetland area. These areas will be planted with various types of vegetation that are common to wetland areas. Additionally a 0.04 acre "Temporary Wetland Impact Area" will be created to establish grades for the wetland mitigation area in the northeastern corner of the property. This area will be created to help remove exotic canopy and groundcover species. Staff is awaiting an approval letter from the St. John's Water Management District for the wetland mitigation plan. This letter will be required before the project can be presented to the City Commission for final approval. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION: The Development Review Committee (DRC) met on October 20, 2010, and reviewed the applicant's request. The applicant was notified of several outstanding issues that had yet to be resolved. No additional concerns were addressed, and the DRC voted unanimously to recommend approval of the Preliminary / Final Subdivision Plan for the West Road Commercial Subdivision subject to the satisfaction of the outstanding staff review comments. PLANNING AND ZONING COMMISSION RECOMMENDATION: The Planning & Zoning Commission met on October 27, 2010, to consider approval of the applicant's request. After deliberations, the Planning & Zoning Commission unanimously recommended approval of the Preliminary/Final Subdivision Plan for the West Road Commercial Subdivision, subject to the satisfaction of the outstanding staff review comments, and the receipt of an approval letter from the St. John's Water Management District for the wetland mitigation plan prior to the plan being presented to the City Commission for final approval. STAFF RECOMMENDATION Staff recommends that the Honorable Mayor and City Commissioners approve the Preliminary / Final Subdivision Plan for the West Road Commercial Subdivision subject to the satisfaction of the outstanding staff review comments, and the receipt of an approval letter from the St. John's Water Management District for the wetland mitigation plan prior to the plan. Not Resolved. 2. Please see the attached comments in regards to the stormwater system by the City's Stormwater Engineering Consultant ( Singhofen). Not Resolved — Attached please find an updated memo from Singhofen. Subdivision Plan & Site Plan Sinhofen & Associates Inc. These comments pertain to stormwater related issues we've identified in the response to comments dated October 21, 2010 for the subject project. Comment 1. The following relates to the Stormwater Management Calculations: a) Previous comment did not require a response. b) Comment is repeated: Underdrain calculations are provided for recovery of the treatment volume in three (3) days and the attenuation volume in fourteen (14) days per St. Johns River Water Management District requirements. Please submit a drawdown analysis to ensure these requirements are met. c) Storm sewer calculations and plans still include a few inconsistencies (e.g., inlet elevations at STM -3, STM -7 and STM -8), however, calculated HGL elevations at those locations are well below the gutter /road elevation identified on the plans.. No further action is required for this coment. d) HGL requirements are still not met at STM -1 (Inlet top = 113.00 ft, HGL = 112.92 ft). Revise and resubmit corrected plans and calculations. e) Comment has been addressed f) The comment was not addressed relative to underdrain design and is repeated: The seasonal high water level for the wetland in the vicinity of the discharge point of the pond is at elevation 106.2 feet. This elevation must be used for underdrain design and drawdown calculations. g) The comment does not appear to have been addressed and is repeated: The geotechnical reports have been reviewed and are acceptable. The geotechnical recommendations include the likely need to over - excavate the pond site as well as specific backfill and construction techniques necessary to ensure the pond will function as designed. Please include notes in the plans to require these recommendations during construction. Page 1 of 2 Renaissance Planning Group Renaissance Planning Group has agreed to defer comments on the Ocoee- Apopka Road driveway location to Orange County since they maintain the road and impacted intersection. Orange County has received the plans, but has not issued a review letter. We can only offer a conditional approval, if Orange County approves the driveway location as it is depicted on the site plan. If Orange County does not approve, the site plan will have to be revised to address their comments.
