Subject: Approval of and authorization for the Mayor to execute a resolution supporting the addition of a
value -based selection process to the Consultant's Competitive Negotiation Act (CCNA) for the
procurement of professional services related to architecture, engineering, and surveying.
Background Summary:
The Consultant's Competitive Negotiation Act (CCNA) presently limits the procurement methods
available for certain professional services to a single, qualifications -based approach in which the cost of
services is not considered until after the qualified firms have been ranked and award made by the
governing body. Negotiations progress from the highest- ranked firm one at a time, with no ability for the
procuring agency to weigh the costs and technical qualifications together to identify the best value option.
The National Institute of Governmental Purchasing has created a best value procurement process that
allows simultaneous consideration of price proposals from all qualified firms. This alternative has been
proposed by the Florida Association of Public Purchasing Officials and the Florida Association of
Counties, among other groups, for adoption as a modification to the CCNA. The proposed legislation
would add the value -based selection process as a second option for procuring professional services. In
most cases, the value -based approach is best suited when the services to be delivered are fairly well
defined. When the value -based approach is not appropriate, the traditional qualifications -only process
would be used.
Issue:
The Engineering and Finance departments propose that the Ocoee City Commission adopt a resolution
endorsing the addition of a value -based selection process to the CCNA.
Recommendations
The Engineering and Finance departments recommend that the City Commission approve the proposed
resolution. Doing so will lend valuable support to the statewide effort to support the related legislation
during the 2011 Florida Legislative Session.

Financial Impact:
There is no financial immediate impact on the City; however, it is expected that adoption of the proposed
change to the CCNA will provide cost savings in the future as the city has more information on which to
base the procurement of professional services.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF OCOEE, FLORIDA,
DECLARING SUPPORT FOR PROPOSED CHANGES TO
SECTION 287.055, F.S., ALSO KNOWN AS "THE
CONSULTANT'S COMPETITIVE NEGOTATION ACT" or
"CCNA ".
WHEREAS, local and state agencies throughout Florida are experiencing severe and
significant reductions in revenue; and
WHEREAS, professional services agreements constitute a significant public expenditure;
and
WHEREAS, many local and state agencies through out the United States routinely
compare fees among competing firms before selecting an architect or engineer or other
professional consultant; and
WHEREAS, current Florida law limits the ability of local and state agencies to conduct
competitive negotiations; and
WHEREAS, several public organizations, including the Florida Association of Counties,
the Florida Governmental Finance Officers Association, the Florida Association of Public
Procurement Officers, and the National Institute of Government Purchasing support the use of
alternative procurement methods for the acquisition of professional services; and
WHEREAS, the proposed language would modify the existing state law and would give
local and state agencies the discretion to competitively compare fees, conduct concurrent
negotiations, and make a best value selection that considers qualifications and price among pre -
qualified firms.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OCOEE, FLORIDA, that the City of Ocoee supports the proposed legislation
amending Florida Statute 287.055 to provide public purchasing officials the option of evaluating
top firms based on a best overall basis that takes compensation and qualifications into account
when evaluating potential professional service providers for award of government contracts.
