Background Summary:
This property was cited on April 3, 2008 for a violation on failure to obtain required inspections for an additional
garage and $50.00 due for Re Inspection Fee, for permit #0602442, issued on October 16, 2006 expired on
April 14, 2007. The requirements were to obtain inspections from the City of Ocoee Building Department.
Perform any alterations /corrections required resulting from permit related inspections. The code violation was
for failure to obtain final inspection for the additional garage and $50.00 due for Re Inspection Fee for permit #
0602442 issued on October 16, 2006. On July 07, 2008, the Code Enforcement Board issued an order to
comply by August 15, 2008 or be fined $100.00 per day. On September 23, 2010 the property came into
compliance with the City.
Issue:
On September 23, 2010, the property was observed to be in full compliance. Remax 200 Realty (Ms. Evelyn
Pilchick) representing Bank of America c/o Countrywide Home Loans Inc. is requesting a reduction of fine /lien
plus City's cost of $492.21 totaling $77,292.21, since they did not take control over property until May 18, 2010
as per OC Property Appraiser. On October 26, 2010 the Code Enforcement Board considered the request for a
lien reduction and recommends reducing the total fine lien to $250.00
Recommendations
Staff concurs with Code Enforcement Board's decision of reduction in payment to the City in the amount of
$250.00

Alt. Member Kelley said that Mr. Driesse said that he borrowed money to pay someone to
clean it up. The member asked when that was. Mr. Driesse said he would have to check his
bank records.
A motion was made. Discussion ensued as follows: Member Hopper said that he thinks that
Mr. Driesse has done a good job cleaning up the property. Vice -Chair M. Godek said that he
felt the same way, it is just a matter of how they got here with the matter.
Member Hopper advised Mr. Driesse to attend the commission meeting when this matter
comes before the commission.
Member Hopper, seconded by Member Osborne, moved in case no. 06 -117 that the board
recommend to the Commission that the fine be reduced to $2, 500. The motion carried
unanimously.

Vice Chair M. Godek, seconded by Member Alexander, moved to re -hear case no. 08 -121
regarding a reduction of fine. The motion carried unanimously with Member Lowery away
from the dais.
Office Siegrist presented the case and gave its history. Attorney Sneed clarified that the
compliance was as of September 23, 2010.
Ms. Evelyn Pilchick, a real estate agent representing the listed property at 2000 Lauren Beth
Avenue, said that this is a property that was foreclosed upon. She met with Officer Bob Frost
to find out what needed to be done to bring the property into compliance by September 23rd.

The bank acquired the property as of June 10th.
Member Osborne asked the listing price on the house. Ms Pilchick replied that the list price
is $51,900. Member Hopper asked if the property is in compliance. Ms. Pilchick responded
affirmatively. Alt. Member Kelley said it appeared that the property was cleaned up in less
than six weeks of notification of the violations.
Alt. Member Kelley moved to recommend the reduction of the fine to $0. The motion died
for lack of a second.
Member Osbornee, seconded by Member Hopper, moved to recommend that the fine in case
08 -121 be reduced to $250. The motion carried with one 'no' vote by Alt. Member Kelley.

Officer Loeffler presented the case and gave its history. He presented exhibits (including
photos). As of September 16 the property was non - compliant and remains so.
Member Hopper asked if the officer inspected the property today or yesterday. Officer
Loeffler answered that he inspected the property yesterday and today.
Alt. Member Kelley asked if the respondent had been spoken to by code enforcement staff.
Officer Loeffler answered affirmatively.
Member Alexander, seconded by Vice Chair M. Godek, moved to find in case no. 10 -271 that
the respondent is in violation as of September 15, 2010, and that the respondent be given until
November 22, 2010, to come into compliance or face $100 /day fines. The motion carried by
4 — 3 with Members Hopper, Lowery, and Kelley opposing.
